This is another scam by ScamDave Inc. Nothing more.

Dave's location is listed as Everett, WA, and it is reasonable to assume the warehouse is nearby (WA has cheap power).

Dave: I live in Seattle and would gladly drive up to take a look at your facility and post a report on these forums.  I am also a potential customer if the business is real and the rates are competitive.

The point is that I ignored ASICMINER because investing in their option is not possible for me, as a US Citizen. If I did buy ASICMINER I would probably cause them a lot of legal problems as their offering surely needs to be registered with the SEC. So, I didn't ever bother to check into friedcat and others involved in this project because it is a waste of time for US Citizens.

I believe the major legal implication was in "them" selling you a security, not "you" purchasing them.

Please see the section about how "directed selling efforts" exclude an offering from safe harbor under Regulation S.

The reason for this is that the vast majority of these offerings are scams & frauds.

Avalon does a newsletter (I would suggest you get on it especially being batch #1).   Now to answer your question (which was answered in the newsletter),  wait, relax, no news is good news and March 5th is the deadline for shipping all of Batch #1 (I'll correct if its the 1st).   I am speculating that old store was not cutting it and they have moved over the the new store.  You can also open a support ticket with them and ask about your order.

Selling securities to just one person in the USA means you must register with the SEC.
I've bought plenty of non-US securities that are not registered with the SEC. I'd purchased these through a foreign brokerage account registered under a non-US address. Of course, I still have to report gains to the IRS, but that is a different issue altogether. The blanket statement above is not correct.

Would you mind PMing me a non-US brokerage I can setup and account like this?

Yep.    Everyone gets worked up easily just because something doesn't work perfect.  This whole Bitcoin experiment is filled with talented people that may be doing things completely outside of their expertise because they have too, we are creating basically a new currency and financial system, we will make mistakes.  If you don't have thick skin then this is not for you.

They missed their deadline for 298 out of 300 units (sorry, shipping less than 1% of orders does not count). They refuse to keep those customers up to date. They claim to be open source but they keep delaying the source with poor excuses. They completely fucked up the batch #2 ordering. Again, they're not keeping batch #2 customers up to date. They don't even know when they will open batch #2 again for orders.

I think it's pretty reasonable for people to be annoyed at Avalon right now, and it's also pretty reasonable to be asking for them to release the source when they claim to be open source and use GPL software.

If you're a troll, I'm actually going to give you 4/10 because you managed to quite accurately imitate an Avalon fanboi.

Since we're summing claims here, how about the claim that avalon is producing 12 units per day?

And what deadline are you talking about? Their deadline for releasing source? Where in their license agreement did it state they can prospone the release to a convenient date?

I would like to know as well, I am assuming they are in-route and held up for CNY.   Deadline mentioned is for Batch #1 being fully shipped.   

I hope they would release the code on a convenient date compared in an inconvenient date.   Do you need to state that now?   Again this bickering out the source code sounds like people are having hurt egos because they can't force a little company that is juggling many balls to do what they want, when they want.
