I paid in USD.  Have wire transaction records, e-mails from Hashfast confirming receipt and that the order is okay, etc.  Can't imagine how they could DQ me.  The evidence is irrefutable.

Then again, if their shipping update posts are to be believed, they are on the verge of actually filling the remaining Batch 2 upgrade card orders, which would remove me from this action.... regrettable, since at this point seeing the bastards taken out is of more interest to me than the upgrade card.

Unless the suit will also be advancing Batch 1 MPP claims, in which case I'll happily stay in!

Technically the MPP didn't promise a particular batch, so no legal handle there.

Yes, but the MPP promised to protect against network hashrate increases, among other things.  The language used with the MPP creates a reasonable expectation of delivery within a useful timeframe.

There's probably room for debate as to what point (day), exactly, on the network hashrate curve "reasonableness" expired.

But assuming that HF only provides 1.6TH as the MPP for each BJ, I know that the "point of reasonableness" passed some time ago.  The MPP was for hashing power, not space heaters.

I suspect a legal handle could be found, although I'm hardly an expert.  Just my gut feeling.

An edit because maybe it's not clear enough. The forced bankruptcy thing fails, by definition, if the debtor pays the creditor. This can happen after that the forced bankruptcy has been filled. HashCrap might decide not to pay anyone but to be ready to pay people forcing them into bankruptcy. That's the worst case scenario i was talking about before.

That's not necessarily bad, provided that the creditors who get paid don't keep quiet about it (i.e. no nondisclosure agreement!).  If Hashfast pays off people filing a suit like this, then the smaller guys band together and file suit themselves.  Several groups of smaller guys.  Recycle similar paperwork from case to case to keep the cost down. I would hope that we, the creditors, big and small could cooperate if that scenario unfolds.

Yes, but how does engaging in some sort of nonbinding discussion (all of 2 hours!) with Eddie and him providing "some" units to you to evaluate make any difference to hundreds of customers who should have received petahashes of power many months ago?  Please specifically explain.  "Documentation" doesn't cut it.

Really.  What's your economic interest in this?  You have "some" boards that likely are more rightly the property of others.  You are apparently set to receive a large number of chips which, I presume, you will use.  I have an unfilled Batch 2 order and the MPP from Batch 1. You say you are doing good for the community, but how, specifically?  That's not sarcasm, it's a real request for an explanation, with specifics.

Can't this really be interpreted as just another person, like the Garret the Teenager, who Hashfast Eddie, the Adult, makes some pledge to, and who then comes forward to testify on Hashfast's behalf, and in the end it amounts to nothing for Hashfast's customers?

About the only way you can make up the lost value to me - the differences between your promises and reality (i.e. "make good on expectations set forth before") - will be to host, for free, about 6-7 terahashes.  With every day that goes by without delivery, that number goes up.  

(Edit:  Oh wait.  And then there was the upgrade card, still undelivered.  Make that about 8-10 terahashes, off the top of my head.  I suppose it could be calculated.  If Batch 1 had shipped on time, if the upgrades had shipped, and the f*%*#ing MPP delivered in some reasonable timeframe.  You know, the MINER PROTECTION PROGRAM, remember that joke? Edward and Simon's pledge to protect me against network hashrate increases !!!???)

And while you failed to ship, CoinTerra shipped thousands and thousands of machines. Which Hashfast tried to deny and deride, childishly "showing off" their one (1) functioning "Yoli" miner in Austin.  As if it made it a difference.  Losers.

And your e-mailed "apology" to your customers is still denying key aspects of reality. Metaphorically-speaking, Edward and Simon need to have the shit beaten out of them, repeatedly, until they really acknowledge how badly they have fucked up and present a real plan for making amends that meets the approval of a substantial majority of Hashfast's victims.

It doesn't matter if they produce a handful of "Yoli" boards, and give "some" to Dalkore to evaluate.  What difference does that make?  Documentation?  WTF, String Theory?  That won't make one rat's ass of difference to Hashfast's customers, unless HF moves to host petahashes for free for their early batch customers.  Now.

What a disaster.  Edward and Simon, I for one intend to follow your careers and remind your future employers and investors of what you have done.

No.  I have a Batch 2 paid upgrade card.  Not received. 

So there are at least some upgrade cards, in addition to the Sierras, that have not shipped from Batch 2. 

At last check, there's a guy in Houston without a handful of upgrade cards too.

3) they "pre-ordered" it 6 months ago and couldn't get a refund, didn't want to show up with angry customers around. Mediabistro proposed a voluntary refund and release agreement and they signed it. Mediabistro hasn't stop laughing since then.

I'm hearing for the other mining companies that they've missed the last 2 conferences, Texas was the last time they were seen.


They probably made the Austin conference because Joe and the other paid their own way, because they wanted to hang around at SXSW the week after. To look for new employers.

All I'm trying to say is that I don't put much stock in a CNN report one way or the other.  If it goes badly, it doesn't impact my view much. If it goes well, it may not excite the right people.

Yeah okay, money owns media but media is also frequently brainless. Very brainless.  Short attention span.  Chases its own tail. Especially infotainment kind of media like CNN. There's very little news purpose left at that subsidiary of Time Warner. This kind of media acts like an 8 year old at Disneyworld most of the time.  It's tuned to about that intellectual level and degree of focus.

And it doesn't seem to me that any CNN report will necessarily be of great influence among the folks whose adoption of the currency is the lynchpin of its survival.  Even if the CNN thing got canned, or they did a crappy job of it (very possible), it's probably not nearly as material to the coin's future as some people think it might be.

I'm not trying to argue, I just don't place great stock in this development.

The CNN news coverage (there will be people debating this was a scam) from what I have discussed with Payu is legit. There will be some cameras on site this month to film. From what I know about big media, this could make it to the air or not but if it does, the price will go up another 100x for a short term IMO. If it doesn't air, the FUD spewers will have a field day and this price will drop into single digits with no hope of coming back IMO. Either way, do I invest? Yes. I still mine Bitcoin and make buys of MZC to hold. It has the biggest potential to grow the most this years so it is a cheap investment but there is risk that comes with it. Just not a coin you are going to see news updates every day as there is a lot of stuff Payu deals with that isn't published.

You know, I'm what you would call an activist, I suppose, in "real life".  I'm happily, and I really mean happily, settled out of the spotlight these days, but a few years ago I had lots of major media attention focused on my cause and sometimes me personally.  Yes, CNN, yes, personal profiles in newspapers and magazines, debate the bad guys on the BBC or whatever. The Tonight Show. Fictionalized versions of your stuff on TV and movies. It went on and on.

What I learned about most of this media, though, is that almost all of them aren't really marching to any intelligent beat.  And unless the particular media you are talking about has specific influence with the constituency you need to convince, while it might create a lot of noise, it may not have any particularly beneficial effect in the end.  So a CNN piece might impress somebody in the city, but if I understand the dynamics here correctly, I kind of doubt that what CNN has to say really carries much weight among people with influence in the Lakota nation.

So, okay, great, the exposure of a CNN story gets the palefaces excited, and that's probably not bad if the piece doesn't make any major errors, but I don't really see how it would be determinative of the coin's future.  Just my $0.02.

And, definitely, they will jerk your chain forever and then drop the planned coverage in a heartbeat if something else comes up. Once they cough up the money to send a crew out there and film, however, that becomes less likely, especially since the location is "remote" and probably expensive as far as the big media are concerned.
