This type of action is EXACTLY what you guy really don't want.  You are literally asking for trouble.  

I'm telling you: Handle it internally, you don't want to invite the govt via any of their departments or agencies involved more that they already are.  


You're asking for the WRONG kind of help.  

If he gets locked up (criminal) or locked down (sec) either way you get locked out (funds frozen).



I suspect you are right. OTOH, I suspect it is inevitable. Some adult supervision is clearly needed here. Karpeles refuses to deal seriously with the situation.

Another question for the OP. Will your attorney ask for an order freezing all Mt. Gox accounts immediately?

It seems like one could make the argument for irretrievable harm given the possibility of someone taking off with the BTC. This could possibly justify freezing all their accounts, both their fiat accounts and BTC wallets.

At this point, I suspect it would be best for all concerned, and the BTC markets in general, if some legal authority was over-seeing this process.

MtGox has lost all credibility. As soon as they allow transfer of bitcoins off their site all the people who bought cheap there will take delivery of their bitcoins, and the price will rise above the rate at other places as people scramble to get some of their money away from MtGox. Fiat withdrawals are still hard, so I expect the price to resume its 30% above the rate at other places.

I concur. I think the differential will reverse, perhaps at an even higher rate. People will be more anxious than before to move funds out of Gox.

IMO you're all morons for trying to sue Gox. All you're doing is giving them extra problems and thus delaying their progress to make things right more and more. I don't believe Gox is trying to run away with our money, but they are stalling.

I suspect you are right about the not trying to steal and the stalling. OTOH, the markets might be reassured at this point by having the authorities involved. It most certainly is true that Gox's behavior is a classic series of steps taken by companies that are staving off insolvency. They may not be insolvent, but their steps and PR certainly make it appear they are.

While the multi-party lawsuit is an interesting civil case against Mt. Gox, it may be that a better approach for locking down records and increasing pressure on Mt. Gox to fix the withdrawal problem would be reporting them to the criminal justice system, with complaints of fraud.

It appears that both the Antimonopoly Act and the Unfair Competition Prevention Act in Japan may cover making deceptive promises and statements.

The other advantage of a criminal complaint is that it would hold the CEO responsible, versus the corporation itself.

Is there anyone in Japan who could contact the appropriate authorities?

If true, it is sort of silly. Any decent PI can find them in Japan.

Please go and sign the petition. No matter what happens with Mt. Gox, I don't think it is appropriate for Karpeles to stay on the board, given his attempts to blame the problems of his exchange on the bitcoin protocol.

Perhaps they are all going to be working from home, either to reduce exposure to physical threats, or to reduce expenses? It doesn't really seem like their business would require a lot of physical office space.

I suppose there is also the possibility that they are getting ready to liquidate, though you would think they would just go ahead and do that, rather mess around with the virtual office.

My guess, based on Karpeles previous actions, would be that they are nervous with all the negative attention (an employee on the #mtgox IRC reported that some of the employees "felt threatened" with the protests) and will simply work from home or from another location.

If they are just trying to use this to cover another physical location, that would seem quite silly, as I imagine any good private investigator can figure out where they are actually located.

But when only "counter-arguments" I got, were "but..but.. government regulations are bad!" or "but.. but... the banks are also bad!"... Then I lost all hope... No one is interesting in creating a self-regulatory system that would build integrity and trust around the bitcoin market system. No one got worried that if MtGox falls, then people will think "how can I trust any of those exchanges?".. All I got were silly excuses on why we should just keep burying our heads in sand and hope that the problems will solve itself.

One of the beauties of Bitcoin is that if you think there is a market for some type of more regulated exchange, exchanges with better guarantees, etc., there is nothing stopping you from starting one or a community of like minded individuals who want to follow the rules of the community.

Perhaps make some proposals and try and start something.

I suspect they may be breaking several laws recently by freezing withdrawals. I would not be surprised to see Mark Karpeles marched out of the office in the next few days in handcuffs. This won't be good for bitcoin acutely, so I hope they get their act together soon. Holding onto other people's assets while making no attempt to return them when requested, given Mt. Gox's representations as an exchange, is likely to be bad news.

I think if this is the case and the banks and the governments are tying up their bank accounts it would be in the best of interest of MtGox to explain themselves as things could turn around more in their favor, instead of giving people their bullshit.

One of the biggest problems which Mt. Gox has, in addition to technical incompetence, is a lack of transparency about what is going on.

I've been tracking several threads on this and the overall feeling seems to be 'unfathomable incompetence' rather than 'straight up Ponzi scam.'

Yes, while it likely is hard to properly sort the transactions and which outputs to use and then having to wait for acceptance on the chain before using the change, it can be done in a proper multi-threaded way. Not properly testing software in such broad use on a test network with good stress testing is a bit ridiculous if it wasn't done. OTOH, race conditions in multi-threaded programs are some of the hardest to debug.

Just withdrew 0.1 BTC, it arrived on the blockchain in less than 1 second.
Withdraw for 5 BTC produced a transaction hash but it never made it to blockchain.

Gox's outgoing transactions, which are often in error, and so not accepted as part of the blockchain.
