The original site was hit with a substantial DDoS attack while hosted at rackspace.

The news site has now been moved to linode as Bitcoinica has a fairly large credit there.

The list of no updates is genuinely an attempt to notice people that someone is still alive at bitcoinica but that there is actually nothing new to say.

We're all waiting on the proper legal process to go forward.

Thanks for these updates, genuinely appreciated.

Can you say anything more about the "proper legal process"? Is that the Nov 4 court date which tihan has announced?

It's happening as we speak, 2 weeks ago we were at low $13, now we are at high $11. But as I said in the 3rd post, it'll take several months to play out.

The longer we go sideways, the less chance we'll see a downturn. So far, seems pretty sticky around $12 (the new $5).

Now about that PGP message.. who is it to? If you're sending an encrypted message to someone then just PM them.

If you're trying to sign a message, post the message (---PGP SIGNED MESSAGE--- ) and the signature (----PGP SIGNATURE-----). Then it can verified with your public key.

lol, that's a little harsh. Relatively speaking, dank is semi-famous in bitcoin securities and lending. More than can be said about you, CharlieContent!

I left for a short trip and when the hack happened i wasn't home. I tried to manage the crisis from my laptop and while on the move, but it escalated up and as i've later learned the criminals spent away almost the whole mtgox balance, while not being able to withdraw, they still managed to create thousands of sell transactions and waste it on mtgox fees. That caused a flash crash in the price that can be clearly seen in the charts.

Thousands of sell transactions would just leave USD in the account. To deplete the funds, someone with the mtgox api key would need to do an equal number of alternating buys and sells (paying the spread each time, which is much greater than the mtgox fee).

Are you saying that after the hack, you shut the site down but you left the mtgox api key active?

You assured that all funds were safe.

Not even one bitcoin was withdrawn from Bitdaytrade.com under today's attacks, and all funds are safe. Server will be kept offline for further investigation, and gathering of evidences to be presented upon filing a criminal deposition with all the legal authorities i am/will be able to.

What did you do with the funds bro? They were earmarked for BDT, were they not? If so, they should be at bitdaytrade's broker (he broker used to hedge users' positions).

So, where did it go that you now need to get it back?

What are you talking about? there's bids for more than 50k BTC over $10. And we just bounced off $10.75 - quite the wick dangling on that candle.

How many weeks above $10 for the bears to calm down? A nervous market doesn't wait weeks.. look what happened August 18. We're 7 weeks above $10 and three above $12, going on 4.

I think most are hovering over the buy button right now. Volume has slowed to a drip again, shouldn't be long before Mr. M pulls his asks and flips the walls to get everyone racing to click "MARKET ORDER!!1".

I know, > $15 seems too good to be true. But if there's new money in this market, then that means new prices. Reminds me of how it felt to imagine $7 from $2. And to imagine $12 from $5. So I'm very wary of pressing my luck for a third time.

Then why do I think it can still go up? Because even though I am (obviously and inherently) bullish, I am *still* 100% cash. I'm too scared to make the same mistake I did in January, with a very untimely buy-back-in at $6. So if I'm cash and adamstgBit is cash, how many others must be cash?

How much patience is enough? This week's candle looks critical. If it doesn't go down, it will only be rational to start scaling in. The asks between here and $14 really don't look threatening anymore, could be their last stand.

As to the monetary size of the scam, Dank has made public guarantees that he is soon to be one of the most famous and well known musicians in the world.  The value of a personalized performance and recording from such an artiste early in his career is vast.

Absolutely not.  Dank is an exceptional musician who my niece and myself are fans of, he has made assurances he will be one of the most famous and talented musicians in the world.  These are the reasons I stood to gain personally and economically in negotiating to receive a recording of Mary Had A Little Lamb from him.

I would like to remember you that the Intersango's are not the only responsible for our problems.  From Zhou to Tihan everyone who delegated the responsibility of our accounts and fund had a duties of doing so correctly.

Definitely. I'd say 95%+ probability that it was Zhou who did the last theft using the LastPass password. I think he only found out the source code was leaked five days after the fact (source leaked on monday, theft happened on friday). And it was on top of the prior theft due to bitcoinicaconsultancy's email being breached (and intersango crew still tried to blame that on zhou). So zhou was doubly mad already, then decided to check if they had changed the LastPass password he gave to Tihan.

If tseale ever accomplishes whatever legal paperwork is necessary to give customer funds back, I'm still curious about how he plans to process bitcoinica deposit claims without the database. I'd like to know if the Intersango guys gave him their progress on claims verification or if they are holding it from him.

We do know that Zhou had access to the database during the original refund process so it's possible that Tihan or Zhou had a complete copy of it.  we know that Zhou has at least a partial user list because he used it to spam Bitcoinica users about NameTerrific. If Wendon doesn't have access to the database, that's one of the things first things the liquidator will look to obtain from the Intersango guys - taking control of all company records is one of the first duties of a liquidator.  Patrick has said he'll co-operate with the liquidator - I guess we'll just have to see how that pans out with respect to user records.

I'm not sure what you mean here by "database". The database was on RackSpace and it was deleted, no current copies existed at the time. Zhou only had some old copies (he never said how old because that would've made it easier for people to file false claims). That's why Intersango had to reconstruct it from blockchain deposit records, mtgox code records, and claims filed. If I remember correctly, they said they believed they had verified 80% of the funds to valid claims but they were still in the process of collecting more information from claims filers before SHTF. For example, I filed my initial claim but then later sent them my mtgox deposit code when they requested them to their claims.bitcoinica@gmail address (or whatever it was). So there was a lot of still-in-progress work on verifying the claims which was being done, and still remains.

Its rather lucky that there was so much stability around $5 prior to the hack. Had there been some volatility, there would have been much incentive for users to file false claims with respect to positions they had right before the hack and they would have been difficult to falsify. Claims like "I made a 10k BTC deposit" two days before the hack are easily falsified by lack of blockchain or mtgox code records.

There's no question that the High Court will make an order for Bitcoinica to be put into liquidation.  Tihan will have nothing to do with the distribution process beyond co-operating with the liquidator when requested (identifying the MtGox account and any other accounts in which funds are currently frozen would be an example of this).  

Best case outcome would be for Intersango to turn over all their records (claims by users and all additional info sent) and the progress they made. Then for MtGox to continue handling the claims and payouts (they already did this once when they bought the polish exchange bitomat.pl after all the coins and data there was lost).

Mining companies are pretty high yielding but on the flipside they lose value faster than a $2 hooker. I hope some of the changes glbse makes going forward allows real sustainable companies to attract investment. Instead of more ponzis.

Attracting investment is not a challenge for real sustainable companies. The ones with growth potential have to use a stick to fight off hordes of drooling investors. Most don't, instead they give the VC's a run for their money (pun: by running off with it).

The CPA's and "fund managers" here and on GLBSE are the laziest of all, real bottom of barrel types now coming here from the from the forums where they ran their HYIPs using LibertyReserve. At least pirate contracted someone to build GPUMax and Alberto made some plausible front-ends for bitscalper and bitdaytrade.

I really hope that GLBSE starts using LTC instead of BTC. Speaking of LTC, where are the LTC HYIPs?

What did you do with the coins that now you have to sell real estate to pay the debt back?

If the funds were used to generate profits for bitdaytrade, then they should still be deposited at its brokering service (which you once claimed was instaforex, but then renegged and said you only get the gold price feed from instaforex but hedge the positions using a "custom platform").

You should have staged a "hack" where the coins, which were in cold storage, still got stolen from a deleted wallet file (deleted but not purged, aka still in the recycling bin).

144 BTC and sent many emails with no replies after the site went down. Last respond from bitdaytrade was Aug 16 2012. all transactions was sent to the same bitcoin address.

I don't know why this isn't how it's progressing in the pirate case. Maybe that sort of approach is an American thing, though it has a Britishy feel to it. Maybe that is pointless.

Because pirate is telling his lenders that only those who leave him alone will get their money back (oct 12 at the earliest possible), and they want to believe him.

No, at least not by most of us. Those holding lots of cash usually don't want the market to know, so they use exchanges which promise to keep their account funds secret. When they want the market to know, they'll show it on the order book.
