Just gets better every time I come in here for an update.

Well, Alpha paid for risc-lot chips, and they got what they paid for. Whenever a company opens its doors to everyone to buy in, that's an immediate black flag in my book. Cashflow issues = no-go.

Good to hear some folks have been able to get chargebacks.

Yeah alpha tech wants to come across that they are unbanning people out of the kindness of their hearts.  The reality is they want to maximize their source of new capital by pitching them a new scam because the first one failed.

Welcome back unbanned friend.  Oh by the way we would like to introduce you to a new exclusive once in a lifetime opportunity.

I wouldn't be surprised if they announce that they cant deliver their miner - BUT they made an awesome deal with one of the legit scrypt asic companies, so they can buy their miners with a little discount with your preorder money. Wink

I would LOVE that !!!

Never gonna happen.  They already lot a lotta money on their "Risk chips"  (LOL)  That money is gone.  Do you think they are even going to be able to afford wholesale prices on competitor miners?Huh  Any competitor would prefer Alpha Tech to fail so they can get the customer base.  If Alpha tech survives (on the snowballs chance they do) then it may become competition to them.

The announcement should be today, if it isn't please don't freak out it will be soon, it will also be announce in news articles and it will be great news for you guys that everyone, alpha-t customer or not, will want to be a part of.

edit: Anyone who has been previously banned from this forum is now un banned. Can I also kindly ask everybody post here for the moment regarding this so we can discuss this together. a) winding down the company, starting a new one … giving customers shares in a new company and soliciting new funds ?

I've seen this so many times in penny stocks.  They blow up existing shareholders of some shell company.  Start a new one and  buy out the old company offer the existing shareholders a fraction of what their original shares are worth all under the illusion that they "might" make more money if they give up money now.  As a shareholder that is underwater what have you got to lose at this point.

But instead of shareholders here its customers.  AT is basically trying to wipe out their existing customers and give them less now with the "hope" that they "might" make more money in the future.  The reality is always so much different in every case.

So THAT is the big announcement?!?!?!?  They purged their forum of all threads and locked a thread so customers can vote if they want a share of the company if they hold out till Sept and don't sue their asses off?  So its a swindle.  Alpha Technology asks the customers to agree to new terms and conditions and to provide business names on their accounts and in turn the customers give up any consumer protections.


So what are you getting for a share of the profits?
An ASIC company that failed to make tape-out
An ASIC company that is in break of its original terms and conditions.
An ASIC company that is having lawsuits started against it.
An ASIC company in violation of Distance Selling Regulations.
An ASIC company with  he majority of their assets frozen.
An ASIC company that cannot get a card processor to work with them.

This is getting worse than Hashfast.  At least Hashfast pretended that everything is okay all the way to the day they filed bankruptcy.  Alpha Tech is floundering and admits its floundering and won't survive and they need angels to come in and save them from extinction.  My guess is that Alpha is begging them to take the offer.  Probably passive aggressively alluding that they will tank the company and go int bankruptcy and no one will get anything and this is their only chance to get something.

I give Alpha 30 days before it shuts its doors.  O wait those steel curtains have been shut the whole time huh?

You ordered a product which was due for shipping worst case scenario 15th July. That did not happen. People have every reason to be upset with AT.

Your price is *WAY* off.  Current NICEHASH price is 0.00078810btc Per Mh = 0.197025 BTC Per day
If, and ONLY IFF, that price remains steady, = 9,254 dollars / $118 per day or 78 days.  But since the difficult rises by about 10% ever 4 days.  When we get our machines 60 days from now (if that) It'll be making around $24 a day, before electricity. At that rate : You're looking at 380 days... but we all know that in those 380 the difficulty will rise so much that you'll have to shut the machine off because the cost of electricity is more than you make.  So in other words.  There is a 0% chance of us making our money back if the delivery date is Sept.

What I like is that over the last several months they have been posted how they are fully funded and have not financial problems.  So what does this mean.  Were they lying these past few months about being fully funded and how MOST of their customers have paid the remaining 70%.  That's the thing about talking from both sides of your mouth.  Either statement you commit to still makes you a LIAR!!!

I love grammar.  This is what lawyers thrive on.  Notice the word A.  which is legally A business practice and taxable activity.  A business practice.  They did not add the word ONLY in front of that A.  They just said A.  They just left that statement hanging.  IF you read that statement as all inclusive you would have been left with believing that HMRC says that mining is a business taxable activity.  But its all about what Alpha Technology LEFT OUT OF THE STATEMENT.  Let me show you...

You see HMRC made the following statement for those that can't be bothers to ready the HMRC guideline

Notice who they identify first in that statement.  Individuals.  Notice what it is followed up by the word... OR.  So the law is for individuals first or if you happen to be a company yet you count too.

Alpha Technology is hoping that you do NOT fight them on this.  Do you know why.  If you don't they then you accept that they have labelled you a corporation.  You are complicit because you did not say hey, I'm NOT a corporation and this is NOT for business use.  Because then you are a consumer and protected by consumer law.  If you let Alpha Technology decide you are a company then you are screwed because you let them decide.  But if you say you are not then now the burden of proof is on Alpha Technology.  Now they have to prove that your are a company.  That they have your business id on file.  Your company name and all the documents validating you as a business.  If they don't have that then it doesn't count.

Everyone that thinks they have lost their 30% down payment of full payment, that is simply not true.  If you say you are a consumer you are a consumer and you get 100% of your money back if you are not happy.  Distance Selling Regulations.

The rest of this letter is just blah blah blah we have been so kind to you our customer and we having given you everything and you shouldn't be asking for more you ungrateful... ehem.  We told you minimum 25MH/s  That is all your getting.  I bet if they found that they could edit the terms some more they would drop the hashrates back down to the first guarantee.

1. Well I must say just again, that I'm not a business customer, I'm an individual. Ask MJAkram, your Accounts manager, he understands it , see attached Tax01. You don't even know for what I would use purchased hardware, so the statement "the hardware we are selling can only be used for mining cryptocurrencies which is a business practice according to HMRC" is completely nonsense. What if I use it for science/experimentation purposes?

2. I have no business license, I am a standart consumer and I'm not acting as a business. That's only your fradulent claim. There is NO WHERE in the HMRC does it say that mining cryptocurrencies is only a business activity. HMRC do not classify mining as a business activity, it can be done as an individual and profits treated as a Capital Gain not income. See this:
HMRC identified that all generation of profits from cryptocurrency transactions are taxable as corporate OR personal income tax.  There was not specification that the income generated was specifically corporate tax.  I hope this puts this B#$@#HIT that Fiaz is spouting to rest.

Corporation Tax, Income Tax and Capital Gains Tax treatment of Bitcoin and similar cryptocurrencies
As with any other activity, whether the treatment of income received from, and charges made in connection with, activities involving Bitcoin and other similar cryptocurrencies will be subject to Corporation Tax, Income Tax OR Capital Gains Tax depends on the activities and the parties involved.

Whether any profit or gain is chargeable or any loss is allowable will be looked at on a case-by-case basis taking into account the specific facts. Each case will be considered on the basis of its own individual facts and circumstances. The relevant legislation and case law will be applied to determine the correct tax treatment. Therefore, depending on the facts, a transaction may be so highly speculative that it is not taxable or any losses relievable.. For example gambling or betting wins are not taxable and gambling losses cannot be offset against other taxable profits.
For businesses which accept payment for goods or services in Bitcoin there is no change to when revenue is recognised or how taxable profits are calculated.
Corporation Tax: The profits or losses on exchange movements between currencies are taxable. For the tax treatment of virtual currencies, the general rules on foreign exchange and loan relationships apply. We have not at this stage identified any need to consider bespoke rules.

For companies, exchange movements are determined between the company’s functional currency (usually the currency in which the accounts are prepared) and the other currency in question. If there is an exchange rate between Bitcoin and the functional currency then this analysis applies. Therefore no special tax rules for Bitcoin transactions are required. The profits and losses of a company entering into transactions involving Bitcoin would be reflected in accounts and taxable under normal Corporation Tax rules.

Income Tax: The profits and losses of a non-incorporated business on Bitcoin transactions must be reflected in their accounts and will be taxable on normal income tax rules.

Chargeable gains - Corporation Tax and Capital Gains Tax: If a profit or loss on a currency contract is not within trading profits or otherwise within the loan relationship rules, it would normally be taxable as a chargeable gain or allowable as a loss for Corporation Tax or Capital Gains Tax purposes. Gains and losses incurred on Bitcoin or other cryptocurrencies are chargeable or allowable for Capital Gains Tax if they accrue to an individual OR, for Corporation Tax on chargeable gains if they accrue to a company.


3. About the terms - what terms did you fulfiled? The one about updates every week? With video and/or pictures? Or the one about project completion on 15.7.2014 (See the roadmap attachment.)? If you are going to consider your news items as contractual terms, then what about the other terms you are violating??? See the roadmap attachment.

4. There has been UK Citizens Advice Bureau contacted and they clearly explain this about distance orders:
Your rights and obligations
When you enter into a contract with a trader by means of a distance communication (telephone, internet, mail order etc.) you will often have cancellation rights under what is known as the Distance Selling Regulations. These state you are entitled to a written notice confirming the details of your order and the fact you have cancellation rights. If you have been given the notice at the time you place the order, your cancellation rights run from the time of order until  7 working days starting from the day after  you receive the goods. If you have not been provided with this written information, your cancellation rights are extended for up to 3 months and 7 working days. The trader must provide this refund within thirty days.

So as is written in my first email, I did everything according to law and now you have 30 days starting from 21.07.2014 to do a full refund to me.

Interesting they aren't touting the HMRC designates you as a business.   Looks like they got a second legal opinion from real lawyers rather than the magic 8 ball they used previously.  Not sure if they were advised to remove it or they are really scared that they are really doing something illegal as they deleted the Tax Geek blog very quickly after the discussions here about the HMRC guidelines.

You may have support once and if Alpha Tech ever ships.
