Pu Zhiqiang: China rights lawyer gets suspended jail sentence

Prominent Chinese human rights lawyer Pu Zhiqiang has been released from detention after receiving a suspended jail sentence.

Mr Pu was found guilty by a Beijing court earlier on Tuesday for "inciting ethnic hatred" and "picking quarrels" in social media posts.

The court sentenced him to three years in prison but also said the sentence would be suspended.

He is the latest to be tried in a crackdown on dissidents in China.

Mr Pu was released from Beijing's Number One Detention Centre on Tuesday afternoon, where he had been held for 19 months.

He is now under "residential surveillance", and has 10 days to decide whether to appeal against his conviction and sentence, his lawyer says.

Experts say the suspended sentence means Mr Pu can avoid serving time in jail - but could be monitored during the suspension period.

The guilty verdict means he can no longer practise law.

Mr Pu could have faced a maximum sentence of eight years in prison.

State news agency Xinhua said that during his sentencing Mr Pu had "acknowledged the reality of his crimes", apologised, and accepted his sentence. However, his lawyers said he had not pleaded guilty.

Rights group Amnesty International said that the sentence was "a deliberate attempt by the Chinese authorities to shackle a champion of freedom of expression".

However, foreign ministry spokesman Hong Lei said Mr Pu's case had been handled "in accordance with the law" and that "foreign governments should respect China's judicial sovereignty".

Mr Pu has been in detention since May 2014, after he posted several messages on microblogging platform Weibo that were critical of the government.

He had questioned the "excessively violent" crackdown on Uighurs in the restive Xinjiang region, alleged the Chinese Communist Party was an untruthful party, and mocked government rhetoric over disputed islands in the East China Sea.

Supporters say his arrest was politically motivated, as he is known for representing dissidents in sensitive human rights cases.

Pu Zhiqiang represented artist Ai Weiwei in a tax evasion case that critics complained was politically motivated. He also campaigned for the eventual abolition of the labour camp system, under which suspects could be detained for years without trial.



Scuffles
Prior to the sentencing, a small group of activists and foreign journalists gathered in front of the court. There were brief scuffles with the police, in a repeat of scenes seen last week during Mr Pu's one-day trial.

A BBC team witnessed supporters and journalists being dragged away by dozens of plainclothes policemen. The BBC team was later asked to leave.
Amnesty said at least 12 activists were detained on Tuesday.

Human rights activist Hu Jia told the BBC that China's authorities had "attacked a leading human rights lawyer... as a warning to other rights lawyers [in China]."

International interest in his case could have contributed to his jail sentence being suspended, Mr Hu said, but added that Mr Pu was still at risk of being persecuted by the authorities.

Pu Zhiqiang is something of a celebrity as a lawyer. He's a big, bear-like man with a baritone voice who has defended a range of causes, especially those involving freedom of speech and detention in labour camps.

He mixes popular street speech with allusions to classical literature in a powerful rhetorical fashion. "Feisty" is an adjective often used to describe him.

He has also been a thorn in the side of the authorities since his imprisonment in 1989 as a student pro-democracy protester.

His defenders say his current treatment is not because of the content of the seven posts on social media cited by the authorities. Rather, they say, it is to send a warning to dissidents - and the lawyers of dissidents.

Chinese Internet users on Wednesday hit out at a "global" Internet conference hosted by the ruling Chinese Communist Party, as their president Xi Jinping called for more control by governments over cyberspace.

"Freedom and order are both necessary in cyberspace," Xi told the conference in the eastern province of Zhejiang.

"Cyberspace should not become a battlefield for countries to wrestle with one another, nor should it become a hotbed for crime," the official Xinhua news agency quoted him as saying.

Xi called for an Internet with national borders, analogous to the concept of national sovereignty enshrined in the United Nations Charter.

"Sovereignty ... is one of the basic norms in contemporary international relations," Xi said. "It covers all aspects of state-to-state relations, which also includes cyberspace."

China already extends tight control over what its netizens may see online, via a complex system of blocks, filters, and human censorship known collectively as the Great Firewall.

Now, Xi appears to be arguing that Beijing's censorship model of Internet governance should extend its influence far beyond its physical borders.

"We should respect the right of individual countries to independently choose their own path of cyber development and model of cyber regulation and participate in international cyberspace governance on an equal footing," he said in the keynote speech to the conference.

'Tell some truths'

Henan activist Qin Zhao said she had evaded arrest in her hometown to travel to Wuzhen, where the conference is taking place, to register her complaint at the banning of overseas social media sites to regular Chinese netizens.

"I heard that President Xi has a Facebook account, but we aren't even allowed to open one," Qin said, en route to Wuzhen. "I am hoping to find out why that is."

She said the Great Firewall had been temporarily suspended in Wuzhen for the duration of the conference.

"I want to experience that, because there's a whole lot out there on the Internet that we normally can't see," Qin said.

"I also want to take the opportunity to tell some truths online about how the government has caused huge numbers of complaints with its land grabs and its forced evictions, and how they detained me," she said.

Political event

Meanwhile, Beijing resident Li Wei said the conference is far removed from the concerns of most Chinese netizens.

"I am extremely interested in the Internet, but I don't think that this event has anything to do with me," Li said. "It's just a political event for the highest-ranking leaders."

"It's just a move in their diplomatic game," he said.

Li cited the trial on Monday of top human rights lawyer Pu Zhiqiang for "incitement to ethnic hatred" on the basis of seven tweets.

"A lot of people had their [social media] accounts shut down around that time, just canceled, and all of their tweets deleted," Li said.

"So a conference of this kind has absolutely nothing to do with ordinary people."

He said the conference was only attended by two countries out of the G20, while most were developing countries.

"What have they come for? Are they hoping that China will give them money or aid?" he said.

Temporary freedom

Beijing-based rights activist Huang Qi, who founded the Tianwang rights website, said the temporary freedom granted to Wuzhen for the duration of the conference was ridiculous.

"A lot of people have been drawn to Wuzhen, because they have turned it into a special zone," Huang said. "Normally, you can only read stuff beyond the Great Firewall by using circumvention tools."

"This is a joke."

He said no discussion of Internet policy would be complete without addressing the question of how to protect people's basic human rights.

Meanwhile, veteran Hangzhou-based dissident Chen Kaipin said he had been under surveillance by state security police since Sunday.

"It's all because of this Wuzhen Internet conference," Chen told RFA on Wednesday. "I am now being watched ... It started three days ahead of time."

"[The police] take me out to do stuff, and take me to dinner."

Tightened security

Wang Qunlan, a rights activist from Huzhou city, said many people were under threat of surveillance or house arrest because of the conference.

"If you plan to go there, they will put you under house arrest, although there aren't so many people going there because of the huge crackdown that is on at the moment," Wang said.

"Basically there are huge numbers of people with complaints against the government, and they have cracked down on us pretty hard," she said.

Wuzhen residents said the entire city is currently under security lockdown.

"Everything has shut down and we are all on vacation because of the Internet conference," one resident told RFA. "There is nothing open on the streets, and all the businesses have been taken over for the use of the security personnel."

"We can't even go out, because you need a special permit for that," he said. "This conference is driving us crazy."

周二,中国维权律师浦志强涉“煽动民族仇恨”及“寻衅滋事”的案件一审宣判。浦志强被判罪名成立,判刑三年,缓刑三年。这一判决的另一后果是,浦志强今后将无法取得律师执照,无法以执业律师的身份从事法律工作。

 
(德国之声中文网)代理浦志强案的律师之一尚宝军周二(12月22日)通过其个人社交平台宣布,法院判决浦志强“罪名成立,判三缓三”。

中国官媒央视新闻当天对浦志强案作出简短报道称,“北京市第二中级人民法院依法对浦志强涉嫌民族仇恨罪、寻衅滋事罪一案公开审判。依法对其两罪并罚,执行有期徒刑三年,缓刑三年。”

官媒:浦志强“感受法治进步”
中国官方通讯社新华社也在周一发表文章,其中大量引述法庭判决书内容,并称浦志强“认可公诉机关指控的犯罪事实,多次向公众和被害人真诚致歉,愿意接受法律的处罚。浦志强同时表示,从自身的经历,感受到了法治的进步、法律的完善及社会的进步”。
新华社报道中提及,浦志强已决定不上诉。这一消息也得到了该案另一名代理律师莫少平的确认。

 

法院认定浦志强案罪名成立的主要证据是他在2012年1月至2014年5月间发表的 7条微博 。
对于一审判决结果,尚宝军接受德国之声采访时表示:“作为他的辩护人,我们并不认为他的两个罪名成立。法院判决理由是浦志强认可公诉机关提供的犯罪事实,积极认罪悔罪。前半句是符合事实的,浦志强并不否认他写了这些微博,但我并不认为浦志强是认罪的,更何况还是‘积极地’认罪悔罪,我没有听到浦志强有这样的表示。”

定罪意味无法获得律师执照
而现年50岁的浦志强被定罪的另一个后果是,他今后将无法得到律师执照,不能作为执业律师为他人能提供法律帮助。同为律师的尚宝军表示,浦案让他对中国律师的生存环境“十分忧虑”。

尚宝军坦陈,虽然并不认同法院判决书中的部分表述,但目前判决结果让他与另一位代理律师莫少平“松了一口气”。据称,浦志强已经在办理相关手续,周二当天便可以结束关押状态,离开看守所。从2014年5月6日与外界失去联系以来,浦志强已经失去人身自由19个月。

针对浦志强案的判决结果,中国作家慕容雪村在推特上写道:“浦志强只应该被法庭宣布为无罪,当庭释放,然后他再为自己无辜系狱的600天寻求公正。除此之外,任何判决都是政治迫害,任何处罚都是对法律的玷污。缓刑一是宣判他有罪,二是污蔑他承认了自己的罪,这种双重的污辱尤其不可容忍。”
人权组织大赦国际的中国问题专家倪伟平(William Nee)表示:“浦志强很可能不需要在狱中再度过一晚显然是一件好事,但这无法掩饰针对他的严重不公……他是中国最为勇敢的言论自由捍卫者之一,而他受到迫害仅仅是因为践行这一权利。”

上周一(12月14日)本案 一审开庭 后,浦志强的另一名代理律师莫少平曾对德国之声表示,浦志强承认7条微博是他所写,也提出如果微博用词有些尖刻、粗鲁,伤害到他人,愿意道歉,但不承认有“煽动民族仇恨”和“寻衅滋事”的目的。

推特上多家外媒驻华记者与社会活动人士发布消息显示,负责本案一审的北京第二中级法院门前出现多名警察和疑似便衣警员,推搡记者,封锁法院附近区域。另有多名前往现场声援浦志强的民众被警方带走。浦案一审开庭时也曾发生类似情况,多名驻华外交代表和记者遭到推挤甚至暴力殴打。

浦志强曾代理艾未未税案、谭作人案等多起“政治敏感案件”,被视为中国维权律师的代表人物之一。浦案引发国际社会高度关注,包括 德国 在内的西方国家政府多次呼吁中国释放浦志强。而中国政府与官方媒体则拒绝外国干涉中国“司法主权”。

The door of my room was prized open by chinese agent twice at my various house because i moved to new room. i had called german police.

I was illegally detained by Italian Military police, placed in prison with fake accusation, all secret and special service have my picture and fingerprints.
If i go around in the city, i'm stopped by various services twice at day.
For example today i have 6 policemans looking at me from distance of 1 to 15 meters.

I have a illegal perquesition by DIGOS at my house, made by 4 agents.

  “秀柱不会放弃党,台商要大团结!”立法院副院长洪秀柱昨天跨海辅选首站到上海,她一下飞机就冲到台商“挚爱蓝天、和平两岸”造势大会,登高疾呼“团结拼胜选”,500多名台商一路簇拥着她走上舞台。另外,大陆“南方人物周刊”日前以洪秀柱为封面,下标“党的女人”,洪秀柱表示:“封面很好”。

  洪秀柱昨天替国民党新北市立委参选人站台造势后,再赶搭班机赴上海动员台商返乡投票。她说,一路走来浑身是伤,但是替台湾找出路、找生路、找活路,感到光荣。她要台商返台投票,“虽然交棒,要让这一棒达标,拼逆转胜守住蓝天”。

  她强调,两岸政策绝对是台湾前途的重中之重,必须往前走向深水区,“两岸要订定和平协议!”确保两岸关系和平稳定。

  上海市台协会长李政宏打包票说,上海台协“包机”,送台商回台投票,包一架不够,二、三架都没问题,就是不可以输掉台湾。

  李政宏说,上海台商一向不落人后,不但是全大陆130家台商协会“唯一”包机送台商回台投票,且“返台投票、春节过年机票一加一只要人民币3980元(约610美元两张来回机票)”,更是史上创举。李政宏说,“九合一选举上海台商返台投票只有6万人,总统大选,一定会冲10万,再冲第一名。”

  台商士气大振,高唱“龙的传人”、“蓝天白云”唱得慷慨激昂,还有人热泪盈眶,当场有台商表态,要申请回复国民党籍,请洪秀柱当引荐人,“要努力改变国民党,让它更好!”

  台商说,与其担心民调不好,变天怎么办,就应该不认输,“泛蓝大团结,不是抱团取暖,一定要拼逆转胜。”

  另外,大陆“南方人物周刊”日前以洪秀柱为封面,标题是“党的女人”,洪秀柱在造势大会前受访时表示,“封面很好”。她还说,这份报导对她并不都好,但大部分是正面的。

  晚会结束前,洪秀柱还特别上台高歌。她表示,有人说她是党的女人,所以特别要唱一首情歌,也希望社会更有爱。

  上海台商喊出,号召百万商力挺洪秀柱下一步选国民党主席,不过洪秀柱说,没有个人下一步,她关心的是台湾的下一步。

  在首站上海催票后,洪秀柱20日转战苏州、再到昆山,一站接一站见台商催票辅选。

才回北京出差2周,就粉尘中毒了,机票改签,提前返回国外。



内部员工手册上写着,中国自来水质量普遍非常劣质,出差建议用纯净水刷牙。



去客户那里看到领导把下属训的跟孙子一样,虽然挨训的人不是我,但是我觉得看到这一幕很不舒服。



在北京的出入境管理局门口遇到老头骑车摔倒,我正准备去扶,可能因为长得太傻,旁人拉住我了:“你想和这老头纠缠一辈子么!”



回国办新身份证,在北京,被我们街道的户籍警察大姐呼来喝去。让我3周后自取,我说,“能加急办理吗?”人家就特别不耐烦说“不行不行,凭什么给你加急呀?大家都急。”然后我问“能让我舅舅帮我代取吗?三周之后,我不在国内了。”她说:“他手指头上有你的指纹吗!?”句句都是反诘句,一句正常的陈述句都不会说,而且分贝特别高。我没有耳背啊,不用吼。



需要出生证明,我就打电话给北京的某派出所,他们说:”你户口在北京,但你不是北京生的,你去找出生地办。“。。。我就给出生地的派出所打电话,他们说:”你户口在北京,找北京去办。“我一直在和他们扯皮,后来朋友帮忙走后门给我办了一个。。。(我本来很希望遵纪守法,可是遵纪守法没法办)



客户的工人小弟,看见我们工作,检修设备,他幸福陶醉的说了好几遍:“祖国富强了!你看,德国人都来给我们拧螺丝。”我特别想问他:“这么富强,为什么你们的洗手间里连洗手液都没有?为什么没有厕纸?为什么90分贝的工作环境,你都没有防噪音耳塞?”



客户痛斥水污染、空气污染、土壤重金属污染,然后说自己所有的生活用品、食品、牛奶、果汁都在麦德龙买进口食品,家里装了最高级的净水器和空气净化器。我说:“垃圾分类,就会一定程度减少水污染、土壤污染。”他说:“那多麻烦呀!”



去苏州拙政园,游人攀花折柳,吐痰扔垃圾,推推搡搡,大声喧哗。



去秦皇岛旅游,好多很穿着漂亮长相可爱的小孩在海滩上随手扔垃圾,父母视若无睹。我刹那间觉得这些小孩面目可憎起来。



和金发碧眼的同事出差,酒店服务员帮我同事拖行李,不管我,但是,我还比同事多拿一个箱子。



最强大的是,我这个同事信不过中国的酒店,他不允许酒店用他的信用卡作“押金预授权”(德国/瑞士入住酒店都无需信用卡押预授权),然后,酒店前台不同意,我刚准备开口给同事解释,中国必须要押信用卡或者押现金,才能入住酒店。可是,酒店大堂经理说:“好吧,不用押信用卡预授权,也不用押金。”。。。我瞠目结舌,如果是中国人,酒店会答应吗?



很多场合被陌生人问过:“你赚多少钱?开什么车?买房了么?住多大的房子?”



在河北,出租车司机要骗我的德国同事,开了15元左右的路程(我们每天都开这段路,理应11-13元之间),开口要50元,我说:“太贵了,20吧。”(因为我觉得他穿得很破,也蛮可怜的,所以我想在国外给小费也要给1欧,无所谓,就当给他小费了)司机说:“汉奸!”



我的职务比德国同事高,可是去客户那里,他们都以为我是翻译,对我的金发碧眼同事礼遇有加。



我的一个好朋友,生在新疆的上海知青家庭,一直在新疆,但是回家都说上海话。他返沪之后,别人问他从哪里来,他从小一直坚定地说自己是上海人,他也没思考,就这么直接说“我是上海人。”结果大家都笑了,说“你新疆人冒充上海人!生在哪里就是哪里人!”。。。最讽刺的是,我几个朋友移民去加拿大,说加拿大的第二代华人不和她们一起玩儿,她们说:“这些人生在加拿大,就数典忘祖,忘了自己是中国人,炎黄子孙!”(这时候就不是“生在哪里就是哪里人”了)



司机开高速送我们去机场,我猛地醒来,睁眼,看见一辆大卡车在高速路上错过了一个出口,立刻刹车,在全速倒车,我突然大喊:“这个卡车在倒车!我在梦里,对不对!”我的德国同事忧虑地说:“我也希望这是在梦里!可是这不是梦!这是真的!”



某客户听说我在国外读过书说:“好多人在国内上不下去学了,才出国读书的。”(本人毕业于国内名校,国外亦毕业于名校。。。而且即使他真的遇到在中国读不下去书的那种小孩,他也不该见面就揭短吧?)


在深圳,我们的司机开帕萨特,然后送我去银行办手续,这个银行的停车场很小很挤,出口和入口就一个车道,正常人都会先出再进(停在里面的车要腾地方给准备开进来的车呀)。我们的车,马上就要开出去了,这时候来了一个奔驰S系列的车,司机大婶一脸的蛮横说:“给我倒车!”我们司机说:“我不开出去,你根本进不来呀,当然我要先开出去。”大婶说:“我不管!”然后叫来了保安,银行的保安,一看见她开着奔驰,我们开的帕萨特,就立刻对我们很不耐烦地说:“倒车倒车!”。。。(其实我们车后面没有地方可倒了)

经常住在瑞士酒店(误以为住客素质会比较高些),早晨进电梯的时候,电梯空间狭小局促,为了避免尴尬,就狠傻气的说:“早上好!”我拎着公文包、西装革履,电梯里的一个人对我说:“我不买保险。”

客户在中国已经习惯,总觉得我们要骗他们,我们说/答应的事情他们都不相信。大小客户也从来没有长期规划,所有的方案都要催促。可是拼命加班赶工期,交给他们之后,他们其实也没有用,在厂房里搁置着。。。

在中国,每次扔所有的垃圾,都有强烈的负罪感,因为无法分类。

在一个世界最先进的厂房里面,摆满了德国产的各种机器,包括厂房的设计也是德国做的。国企客户在下属面前说:“美国马上就要完蛋了,欧洲也不行了。中国马上就要超越德国了。其实GDP已经比德国强了。”过了一会儿,散会了,人都走了,他问我:“怎么移民德国啊?我儿子20多了,我们也想帮他办移民。”


某国企大领导看了我同事的手机照片,对我外国同事说:“你什么时候准备离掉你老婆?中年妇女了。中国大把的年轻漂亮姑娘。”我听了以后觉得很羞耻……这是什么价值观啊。



参加同学聚会,看到同学小孩被随便放在车座位上乱爬,我说:“买个儿童安全座椅吧?这样对小孩安全。”同学说:“那东西就是骗人的,破塑料,还这么贵!”可是他开一个全新的奥迪A6L啊(我同学都比我有钱)。



去客户工厂,厂门口贴着招工广告,上面写着:“体健貌端、年龄24岁以内,性别:女”。。。我一想,德国的招工广告,普遍都写着“同等条件下残疾人优先录用”,而且万万不敢直接年龄歧视,性别歧视的。。。



和德国同事去客户那里,客户一边和我们喝酒,一边说:“你看你们来了个白人,就很好,XX公司派来的现场工程师是个黑人,我都不和他一起吃饭,我嫌他脏。”德国同事听了赤裸裸的种族歧视,彻底崩溃。



亲戚、朋友、邻居、同学都在问我:“你在外国,融入他们社会了么?”我心里默默地说:“我在德国比在中国融入得好。”



漂泊在异乡,最大的悲哀,就是"异乡永远是异乡,故乡还是异乡"。

这个改编,对得起原作,也对得起观众,对得起演员的努力,对得起所有人。希望大家尽力进场去看,支持国产佳作。我记得,有人曾经吐槽,“韩国有改变国家的电影,我们只有改变电影的国家”。现在电影在努力改变国家,那么请你支持一下电影吧。光靠电影孤军奋战,那就真的只是一个白日梦。PS:意外看到有人气愤的指控“这电影抄袭!”这个抨击真是让人哭笑不得。感谢用户能有如此强烈的知识产权概念,这是时代的进步。但这部电影是“翻拍”,制作方从来没强调过这是自己原创,而是翻拍经典,肯定也是获得了原著授权的(当然这个我没有证据,如果有人能证明制作方并未获得美国方面相关授权,欢迎出示证据,我铁定支持!)另外这也不是《十二怒汉》第一次被翻拍,俄罗斯,日本,也都曾拍摄了富有本国特色的《十二怒汉》。既然洋人拍得,我们中国人当然也可以拍得,获取授权就好。

为期三天的第二届世界互联网大会在浙江乌镇落下帷幕。德国墨卡托中国研究中心的网络问题专家对德国之声解读习近平提出的"网络主权"、"网络治理"等概念。
 
德国之声:在乌镇举行的第二届世界互联网大会上,习近平强调了"网络主权"。在一些批评者看来,这不过是网络审查和封闭的另一种说法。这一主张背后的诉求是什么?

阿尔萨巴:中国领导人习近平在第二届世界互联网大会上重申了"建立多边、民主、透明的全球互联网治理体系"的要求。就是说,每个国家应该通过本国的法规自主管理网络。按照这一观点,一个国家个领土主权延伸到互联网。习近平对西方的呼吁是,对中国"不干涉他国内政"的原则在网络中也给予尊重。

互联网管制的核心是信息监控。在中国,这是通过自我审查、内容过滤和屏蔽等手段的综合来实现的。中国领导人当然不会承认这是信息监控和审查,而是称之为"网络安全"。对这个概念在中国与在西方有着完全不同的含意。在中国,它指的是抵御来自网络的对稳定和秩序的威胁,比如谣言、批评共产党的言论、反对现行体制的动员呼吁等。

中国试图对互联网进行的管制在反恐的框架内也在西方获得了认可。美国共和党总统竞选人特朗普"关闭互联网某些领域"的主张并非绝无仅有的例外。但中国人知道,鉴于数字经济的发展潜力巨大,不可能"关闭"互联网。在这个语境下习近平被引用最多的一句话是"网络安全和信息化是相辅相成的。……没有网络安全就没有国家安全,没有信息化就没有现代化。"

 
德国之声:北京一方面要推动互联网经济,另一方面则要严格监管网络,这两个目的能同时达到吗?

阿尔萨巴:许多人,尤其是人权活动人士、社会学者和西方观察家普遍认为,信息审查和发展创意是相互矛盾的。确实如此吗?我并没有把握。除了色情、贩毒等内容,中国也在网络中审查政治敏感话题,但对于信息、通讯、基因、生物、物理等前沿领域的创造性人才来说,他们的发展空间比我们想象的要自由得多。

乌镇的互联网大会同时也是一场成果秀,中国要向世界展示本土企业的实力。我们必须坦率地承认,中国的信息通讯产业比许多欧洲企业更成功、更有创造力。使用极广的微信早已不仅是一种通信服务,而是成为了自成一体的经济系统,用户可以购物、买特价电影票、叫出租车、预约挂号看病;百度不仅有出色的语音识别,而且在开发无人驾驶汽车;华为、小米的手机日益成为优质价廉的产品;阿里巴巴更是全球最大电商,在中国的"双十一光棍节"创下了910亿人民币的销售记录,是美国企业在"黑色星期五"销售额的5倍。此外中国还有一批活跃的、得到政府的扶持创业企业。

德国之声:中国希望通过世界互联网大会这样的活动达到什么样的预期?

阿尔萨巴:一个中心目标无疑是在"全球互联网治理"的讨论中树立"网络主权"的观念。但我们也不应忽略经济方面的因素。过去30年中国经济的支柱之一是海量消费品的出口。鉴于中国人口结构和工资成本的变化,这一经济模式已过时。中国领导人很清楚这一点。习近平和李克强一再强调,中国经济发展的下一阶段必须靠技术创新来推动。因此像云计算、大数据、物联网和机器人等技术都得到政府项目的大力支持。

在中国依靠创新的发展战略中,私营经济应扮演重要的角色。我认为,让世界和中国领先的信息通信技术企业走到一起,也是为期3天的乌镇互联网大会的一个重要目的。

德国之声:本次大会上可以看到中国互联网政策的一些新动向吗?

阿尔萨巴:中国网信办主任鲁炜在乌镇大会前宣布,中国正在"探索一条有中国特色的治网之路",出发点是"正确处理好自由与秩序的关系"。这也是两年前成立的中央网络安全和信息化领导小组办公室(简称网信办)的任务。中国目前的互联网政策仍有很大的随意性因素:官方的"红色底线"往往不很清晰,没有法律界定。但这种情况在逐渐改变。中国领导层似乎在审查和信息管制的议题上也越来越自信。因此,未来数月及数年里,中国的网络治理会表现出更多的"透明度"。

    “世界互联网大会”召开地——浙江乌镇
   
    12月16日,为期三天的第二届“世界互联网大会”,在浙江的水乡乌镇开幕。诸多国内外互联网巨头与会,不过,还是国内的互联网高管比较多,以及相关部门的官员,包括网信办主任鲁炜,最引人瞩目的当推中共总书记习近平,其次是俄罗斯总理梅德韦杰夫,还有一些已经过气的亲共外国政要,参加大会的官员的数量显然比网络人士的数量要大得多。
   
    “世界互联网大会”看似名称很响亮和大气,实际上,从第一届开始,就名不副实。第一次外国的与会者更是寥寥无几,而这一次虽然多了一些,但是,仍然给人的感觉是一个局域网大会,即使有个别的国际互联网大佬出现,但也只不过是拉大旗作虎皮而已,他们只是来看看热闹,享受下外宾的待遇,然后顺便看看沿途的风景。
   
    不可否认,在国内媒体上,此次大会的造势工作做得非常成功。会议尚未开始,就已经成了国内媒体关注的焦点。宣传部门联络各大官方媒体组织评论写手,与官方媒体的报道一唱一和,使得受众耳濡目染。那些传播最广,被各大网络媒体推到显要位置的评论文章,几乎都是被宣传部门全网推送的。还有官方媒体汇总的那些所谓的海外的网友对此会的盛赞之词,也大多出自海外“五毛”之手,还有一部分是选择性收纳的溢美之词。
   
    众所周知,中国的互联网并不纯正,因为将不计其数的境外网站屏蔽,对于不掌握“翻墙”技术的互联网用户而言,这个所谓的互联网只能算是局域网。所谓的“世界互联网大会”主要探讨的不是如何开放互联网,如何维护互联网自由与安全,而是寻求控制互联网、遏制网络言论的“良策”。从这种意义上讲,这个大会动机非常不纯。
   
    果不其然,习近平在开幕式上的致辞中,呼吁各国尊重“网络主权”,允许各国自主选择网络发展道路和管理模式。每个国家根据各自的实际情况,在管理上有所不同原本可以理解,但是,必须恪守的一个共同和基本原则应该是,真正实现网络的互联互通,并且要充分保证用户的言论自由以及个人隐私。习近平口中的“各国自主选择”实际上是在为中共对互联网的严厉控制寻找所谓的合理合法性借口。
   
    众所周知,中国的政治制度是独裁专制制度,很多法律和规定以及管理模式本身就与真实的民意背道而驰,但是,却符合中共统治集团的利益,也符合广大官员的利益,所以,官方会极力推行。中国所选择的“网络发展道路和管理模式”其实就是要让官方牢牢掌控互联网,最大程度地遏制敏感信息的传播,遏制互联网用户的言论自由。
   
    在互联网进入中国之初,由于当局的网络封锁技术不成熟,所以,那个时候的互联网才是真正的世界互联网,之后,封锁日益加剧,等到金盾工程竣工时,中国网民一般所能接触到的就是名副其实的局域网,诸如美国之音、BBC、德国之声、法广等等媒体都无法直接登录,即使是港台的一些包含敏感政治信息的网站也被屏蔽。另外,在境外上网的时候,一些中国国内网站甚至还不让境外的IP浏览,可见,中国的互联网是在自绝于世界。
   
    中共向来声称“主权高于人权”,事实上,在一个人权状况恶劣的国度,很多民众都会对移民到自由国度梦寐以求。现如今,移居海外的中国人越来越越多,不仅有流亡的异议人士,更有高官的妻小们。高官们都清楚,西方的教育和社会环境比中国优越得多,所以,都争先恐后地将孩子送往西方国家留学,有的官员甚至独自留守在国内贪污受贿,让妻小远走高飞。这充分证明,在人的内心还是倾向于认为人权高于主权。
   
    习近平强调“网络主权”实际上是很荒唐的一种说辞,首先,网络不存在主权问题,任何网站,只要知道其网址,在世界任何地方都应该可以自由登录。如果不让人登录,那就没有必要开办,实在是需要拒绝特定人群登录,也应该有值得理解的合情合理的理由,否则就是自己将自己隔绝于互联网文明之外,“网络主权”一说显然有悖于互联网理念。
    美中科技文化交流协会会长谢家叶博士认为,习近平重申“网络主权”,意在强调中国政府在互联网使用政策、使用范围上有其主权,其他国家不应干涉。这种“不干涉”,也包括不干涉中国政府屏蔽如脸书、推特、谷歌之类的敏感网站。谢家叶博士表示,这和中国政府强调“领土主权”是一样的。
   
    资深媒体人、网络评论人士北风认为,中国没有主导国际互联网治理新秩序、新协议建立的能力。这次在中国举行的世界网络大会的49个国家中,以政府名义派出高层官员出席的超级大国只有中国、俄罗斯,前20名的只有俄罗斯、韩国。当然国际上有不少互联网公司派代表参加了这次会议,但北风认为,这些公司国际不太可能在明确的申明或协议中,去承认中国对国内网络管理模式有一个自我制定的、可以否认国际通行的普世价值和人权标准的模式。
   
    从已经过去的一年看,中国主办的所谓“世界互联网大会”只会在遏制网络自由方面发挥作用,而丝毫不能促进互联网在中国的发展,更不可能促进世界互联网的发展。就在此次大会召开前两天,中国国务院发布了新版的《地图管理规定》,该规定将于明年1月1日开始实施。据悉,所有向社会公开的地图必须报送各级相关行政主管部门审核,任何单位和个人不得出版、展示、登载、销售、进口、出口不符合国家有关标准和规定的地图,不得携带、寄递不符合国家有关标准和规定的地图进出境。
   
    更为荒唐的是,规定还禁止任何地图显示危害国家统一、主权和领土完整,危害国家安全、损害国家荣誉和利益,泄露国家秘密,影响民族团结,违反法律、法规的内容。在古代,地图对于打仗太重要,可以算是国家秘密,但在热兵器时代,“飞者非鸟、潜者非鱼,战不在兵,造化游戏”。一般的地图不应该成为敏感信息,因为地名、地势、道路都是公开的,只要地图不涉及军事机密即可。所以,国务院完全没有必要发这样的规定,很有可能,在今后,谷歌以及百度等网络地图会受到严厉管制,给网民的查询造成障碍。
   
    此次“世界互联网大会”,不仅不能促成中国互联网的开放与发展,而且成了一个扰民的大会,乌镇因为承办此次大会,被封锁得像铁桶一般,即使是离得很远的周边地区的一些主干道也被封锁,让出行的民众叫苦不迭。这样的会议劳民伤财,不开也罢。不过,中共看中国在经济上已经雄踞世界第二,所以还自不量力,想在互联网上主导世界,将中国的互联网大会命名为“世界互联网大会”显示出其勃勃野心。可以断言,只要中国不实现宪政民主,互联网大会开得再热闹,也只能是权力者的盛宴,而绝不会是互联网用户的福音。

people in mainland china normally use VPN to overcome GFW censorship as far as i know

Wrong. That is your subjective opinion. Moderators have the right to asses the situation and decide then, also the banning process takes time (i.e. admins review it before acting upon it). Your ban(s) was deserved. The best thing that you could do now is try and improve your habits.

I think you need to take a step back and breath.  Honestly getting worked up and going after mod's/admin's is not going to help you.   I would assume if anything you would annoy them and either ignore or another ban happens.

Looking at first post just a little bit of it:

You realize this is a online forum not a country?   There is not like a bill of rights or something for it.... we are guests and have to abide by rules of the forum.   If mod's/admin's want to ban someone they could for no reason..... but as far as I have seen there is always a good reason and if not they let you talk it out in meta which they don't have to do.  That is for the users benefit.
