Yeah i withdrew 5 BTC 24 hours ago and nothing has turned up.  Also no response from email after 24 hours.

Also I don't use an API key, I don't even type in my password, it's copy-pasted from Keepass (although the keepass password...).

Just be grateful you're getting your refund.  Me (and 2 of my mates, we split the costs) all missed the link to the Google Docs spreadsheet until it was too late (we did request a refund through the official support site promptly though) and now we are the disappointed owners of a Batch 3 Avalon that will likely only generate about 60% of its cost at the current network hash rate increases Sad

The problem with stupid people is they're too stupid to realise how fucking stupid they are.

Fuck you.  I want my refund.  You know, the one I applied for a month ago through your official support site. Not some outdated tech that will probably only pay for 60% of its cost.

Also, the Avalon site still says Batch 3 is shipping on 'May 5st' -> http://launch.avalon-asics.com/

What refunds?  If you submitted a support ticket (as you were told to by bitsyncom HIMSELF here: https://bitcointalk.org/index.php?topic=236348.msg2515773#msg2515773) then your refund gets ignored.
If you managed to get the newsletter and see the Google Docs link (Google Docs, really fucking professional guys) then you had 3 days to apply for said refund. 3 days. Even if you already asked for a refund through the fucking AVALON SUPPORT SITE.
Not to mention it's been several weeks and I think only one person has received their refund.
I know a lot of people got in, but a lot missed out too.  Avalon has generally been a bit of a clusterfuck lately. This is no way to treat your customers.

Does anyone with a more level head then me know if there is any legal recourse?  If the items were sold in the country I live in then the BS Avalon T&C's would be declared null by a court as they're against the law here. However internationally this becomes a bit of a grey area.

You got a source for this or did you just pull a number out of your ass?

By my (limited) calculations the total BTC mined per day is:

24 hours x 6 blocks per hour (maybe 7 in reality) x 25 coins per block = 3600 BTC (or maybe 4200).

The total value of these coins at the time of writing is about 3600 x US$87.9 (from BTC-e) = $316 440.

ASICMiner has about 10-20% of this which is $31 644 - $63 288 per day.

How do you know Friedcat takes half of ASICMiner's profit?  Isn't he entitled to make a lot of money since he had the balls and foresight to start up ASICMiner? This is a capitalist economy, if you don't like it get out of ASICMiner/BTC.

^I'm not sure I follow that last post there, but have to agree with mem.
There is no confusion, Yifu lied (or has no control over his employees which is just as bad if you're running a business) about where he would mine to test the hardware.  Now he (well, technically Avalon) has both the initial payments (minus costs), plus the money mined with the equipment produced with those initial payments.

To be clear I have no problem with Yifu/Avalon making a profit, even a large one.  They were first to the market and deserve the spoils.  But the way customers have been treated is unacceptable, apparently there are still some Batch 1 Avalon's to be delivered (going from memory here so I could be wrong).  Assuming it's just a stock availability issue (again, could be wrong as I know there have been payment issues) delayed batch 1 customers should have received the first of the batch 2 units imo. Then depayed batch 2 customers get the first batch 3 units...

I'm also not sure how lying about whether you have a horse make you a criminal...  Undecided

That's irrelevant if you deciding whether to get a refund or not.  If you get a refund you've still got the BTC you paid for the unit up front (in theory).  If you don't you have to wait god knows how long to get your BTC back, if at all.
If you get a refund then you can invest in other things like ASICMiner, which still has a pretty decent ROI all things considered.

I don't think it will unless you overclock it severely.  There was a good difficulty-adjusted calculator (http://www.coinish.com/calc/ - link doesn't work now) which showed that they wouldn't ROI in BTC if delivery was later than about 2-3 weeks from now.
I think there are still a lot of batch 2 units in transit as well, when they are all plugged in the difficulty should rise quite a bit.  Then there's at least another 40 THash/sec from all the batch 3 units (conservative -assumes all 3 module units).  That's nearly a 6m difficulty increase just from Batch 3.
BFL will probably finish shipping 'in two weeks' so there's more too...

I don't think they'll ROI personally.  I had a play with this calculator a few weeks back (http://www.coinish.com/calc/ - link doesn't work anymore) and found that if delivery was later than about 5 weeks (~3 weeks from now I think) then they wouldn't ROI in BTC.  If anyone knows of another good mining calculator that takes difficulty increases into account let me know.  Apparently you can get 100 Ghash/sec out of overclocked 4 module Avalons but I would assume it needs water cooling (or good aircon at a minimum) and it would be a bit risky as it would reduce the lifespan of the chips I think.

Sure but that only confirms you bought them previously, not that you still own them.
Could you please PM friedcat and get him to confirm in this thread that your wallet address is linked to the shares.
