lemonte - duly noted, thanks for the offer.  10% is too much at the current difficulty, but I'd hope we could come to an arrangement that would benefit both parties if required.  Will be in touch if needed.

Magazine - I'd prefer BTC but yes, I'd consider cash.  Meet up trade works for me as it means I don't have to faff around with shipping.

I hate to break it to you, but him developing and building a board, is not charity. Customers paid, so it is just regular old business. There is absolutely no need to 'look after' the person you made a business deal with.

As much as I sympathise with the board builders, burnin took his own risk in developing a board for Avalon chips, and taking pre-orders dependant on pre-ordered hardware. It is not right that all this risk is fully offloaded to his customer base, and I'm quite sure what he offers is unlawful in the EU. You can't deliver nothing and still take a part of the money for yourself (be it in fiat or electrical components). I am quite (90%) sure that falls under the label entrepreneurial risk, at least here in the EU.



You are missing the point I am making here mate, I am not suggesting that this is a charity, but if assemblers start losing money, there is no incentive to do it anymore and we have to go down the route of buying plug and play devices at a much higher cost.

I am more than happy to get a refund on my chips and 70% back on the actual assembled PCB price if it means I can then buy new (Non Avalon) chips and have assembled further down the line.

Investments in bitcoin are always high-risk and no one should invest more money then he is comfortable to lose.
I was already writing a mail to you, but it seemed better to put it out here for everyone.

So definitive answer you are looking for:
Bad news first:
I am by law not obligated to give any refunds for customer specific equipment like the bitburners as stated in my AGB (Terms of Service).

Nevertheless I value my customers, and i am nice guy.
I will (on request) refund any money that has not yet been spend on parts.
that will be about 50%.

I have to crunch some number to get the exact per board amount.

I do plan to reuse a lot of components for the bitfury design.
But some can not be reused and will be thrown away, like the PCBs for example.

For those that received a refund i could give a discount on a new bitfury order of about 70% of the not-returned funds.
But we all have to ask ourselves: is bitfury going to deliver?

Executive summary:
50% refund guaranteed.
70% money recovered when ordering a BitFury product.

This looks like it is going to get messy for everyone involved.  
Messy would be a bold understatement.

With ASICMINER today announcing blades for as low as 3.5BTC, it appeared that Avalon chips that do not mine today are not going to break even any more. While those blades went already out of stock after some hours, the new price for mining rig is officially set. Essentially this means that if Avalon does not ship the remaining chips fully within the next two weeks, they become worth less than their shipping costs.

After reading the above in another thread I would like to ask whether burnin could offer some kind of upgrade option for existing and paid Avalon orders to BitFury chips - in a way that he retains his well-deserved profit, of course.

It is really a pity that his excellent work is overshadowed by Bitsyncom's inability to keep its promises.

That would be great, as 100% refunds seem to be quite difficult.



All for that, I plan to put my refunded money into Bitfury chips, or maybe Cointerra if anyone ends up doing a group buy. I'd happily let Burnin keep my money as credit until a time arrives where he can produce boards for those chips.

But there are no guarantees that these will arrive, could literally be the same thing all over again.. Loads of even later gen 1s and a bunch of late gen 2s.

Obviously it is up to the Group buy organisers, but I'm going to vote YES to a refund.

Man, you've got quite some nerve for posting this. A full refund will not solve the issue. Please explain the 1+ million chips delivery that showed up in pictures from June? So, where did they end up?

batch 3? the amount was never 1+ million chips. if one 1+ million chips did show up in june, none of this would be happening and difficulty would NOT be this low, do some math.

also people seem to not make the connect to sudden raise of difficulty to us shipping batch 3 and bitfury's http://ghash.io pool coming online...

that number stopped forwarding a while ago, since people are so hell bend on thinking we are selling chips to somebody in china first I'll address that.

there is a lot of people who bought chips purely for reselling, however the stock is 10k or so at most like all the other orders. I hope people did not think only people outside of china bought Avalon chips. ( out of the 800k chips, more than 50% are chinese orders.)

In addition, these resellers only have small quantity of chips ( since we didn't ship that many yet.) whether is alibaba or the chinese forums, I'd love to see anyone make a large purchase from these "resellers", because they simply do not have the chips, despise what they may advertise.

In other news, we are shipping as per usual like our last update and are doing the best we could but probably simply going to offer full refund soon, I am tired of this toxic community malformed by greed.

Don't make out like you're the martyr here Yifu, most people aren't concerned because they are greedy, more because they are worried they are being ripped off due to your lack of communication.

More information on refunds please, I'll happily take one right now.

You've clearly not kept your promises from your last update, if you had then a lot more people would have received their chips by now.

PS, I did not insinuate that you were selling in to China as its entirely plausible your suppliers are screwing you, so I withheld judgement.

Even though lemonte had luck some days ago i think persistence wont work. And negotiate a time when someone is calling will break at this point too. I called him many days, one after another, each hour 2-4 times... nothing. After those days i realized he will not ever answer me again.

By the way...i had a really hard time to understand only a part of what he said in english.

My thinking is that if we keep calling him, leaving him voicemails and pressuring him to address the issues he will step up.

It also would make for great evidence in a legal case if we kept records on the amount of calls that had been ignored/ not answered.
