Думаю статус самозанятого это как метка и действует в одну сторону. Т.е. став самозанятым - вы для всех органов себя помечаете как предпринимателя, у которого есть доходы от предпринимательской деятельности, и потом этот статус в случае каких-то изменений убрать будет тяжело (формально то может и можно, но фактически не уверен). Да, пока никто не заставляет декларировать, но уже идут разговоры в эту тему, и что нужно декларировать, и что в случае если не задекларируете штрафы итд итп. Да и зная уровни безопасности баз, которые в данный момент работают - предполагаю что хранить перепись людей, у которых имеется криптовалюта в Российской государственной базе данных - не безопасно как минимум, но это просто мое мнение Кто вам такое сказал? Друзья и знакомые закрывали ИП или открывали по несколько раз, никаких преследований потом не было, кроме писем заплатить пени или старые штрафы В России все выписки из ЕГРЮЛ/ЕГРИП открыты, там ФИО, адреса учредителей, предпринимателей, открыта бухгалтерская отчетность. Сегодня криптовалюта чтото новое, через 5-7 лет это будет обычным делом. Количество компаний, криптоматов, пользователей в Мире растет. У вас паспортные данные кто-то спрашивал  квитанцию выдавали По закону любая выдача наличных денег строго по РКО, а там пишутся фио и пасп. данные. Если у кандидата 3 платежа по 500000 тысяч, можно заморочится и привлечь или штраф выписать. А если у человека 150 приходов по 10 тыс в разных банках, то надо доказать что все эти переводы от незаконной предпр. деятельности. Не один прокурор/налоговик на это не подпишется, только если человек сам не признается. Уже писал, регистрируйтесь самозанятыми платите 4% налогов, мало 2.4 миллиона в год. - жена брат другие родственники. надо лимит до 150 миллионов - ИП на УСНО 6%. Разоритесь на кассу и пенс взносы. Про мск сити только слышал + читал что-то на форуме. На самом деле я понимаю что всё это не законно и законно быть не может, но они же как-то существуют. Видимо однодневки, да, другого варианта не вижу. По-поводу самозанятого и криптовалют - есть знакомый юрист в сфере налогообложения, он вскользь говорил, что вряд ли это долго просуществует в таком виде, потом начнут зажимать тех же самозанятых в плане - откуда деньги, предъявите документы. А с крипты - какие документы могут быть. Да и налоговая не поймет прикола, так как в цифровые финансовые активы есть слово финансовые, а к этому относятся довольно строго и никто не даст самозанятым работать с финансовыми инструментами. Да и вообще, мне в другой теме отвечали - если уж раскрываться, то лучше в более стабильной (в плане режима и законов) стране, возможно дружественной к криптовалюте. Что значит откуда? ФЗ о "Самозанятых" не требует от самозанятого вести документы, да и какие документы могут быть у учителя, фрилансера, няни и пр? На изменения в ФЗ наложен мораторий на 10 лет. Прежде чем чтото требовать, надо изменения в закон внести. Не с технической стороны, конечно, а больше с юридической. Т.е. как люди меняют на карты, при этом не боятся вопросов со стороны органов. Даже не смотря на большие обороты по счетам, еще ведь вопрос в том, что могут прийти не совсем, скажем так, законные деньги на карту - и тогда вопросов от органов будет в разы больше. Как тогда обменники принимают различный фиат?
Если просто, то законов нет, значит и нарушений нет Фиат контролировать невозможно. 1. Способ максимально приближен к законодательству. Обменник партнерится с биржей и все платежи идут на биржевые счета обменника. Если что не так, КУС и другие процедуры. Биржа не блочит все счета, а только сомнительные переводы. Насчет "сомнительных" очень много вопросов, но это все идет в карман биржи 2. Этот способ работает через сеть дропов, со счетами в банках, на биржах и тп. 3. Смесь 1 и 2 вариантов. Банк не видит обмен криптовалюты, а только перевод от лица А к лицу В. Если провести анализ, можно выявить кто чем занимается. Что делают продвинутые физлица: Заводят 10-20 карт в разных банках или разные счета и переводят небольшими суммами по 10-15 тысяч, эту мелочь не отслеживают. Ищут обменники, которые не переводят на счет, а пополняют через банкомат как будто это владелец пополнил свой счет. В пределах разумных сумм у банка даже вопросов не будет. Спасибо. Т.е. по сути счета на "левых" людей и всё такое. Просто есть же ребята, которые вроде как даже официально работают, в Мск сити, вот это странно. Мне кажется не отслеживают мелкие переводы ПОКА, и со временем начнут, ведь "люди теперь новая нефть" по сути. А по-поводу налички мне кажется вопросы так же могут возникнуть, если это делать регулярно. Банк может подумать что похоже на отмывание с обналичкой, или там иначе всё выглядит?
