Well that's a crappy conclusion after all these years.  Sad

Quite surprised to read the primary angle of attack was the classification of the "instruments". Securities or not securities. What bearing does that have on what was thought to be the main and single contention that Uncle Stu ran or had input to run the entire operation?

Unless the article reconfigured the verdict to highlight the securities aspect. But if that was the primary angle of attack it seems to me to be irrelevant and probably harder to prove than just that Uncle Stu had input into the running of the scam.

They "also" found:

The customers alleged all four of the products — Hashlets, Hashpoints, Paycoin and HashStakers — were unregistered securities, and that Fraser was liable for the sales because his role at the companies was comparable to that of a partner or director.

But the jury disagreed, finding none of the products were securities, not even Hashlets, which the SEC described as a security in its case against Garza. Weiner said the defense had argued, apparently convincingly, that Hashlets were not a passive investment and that customers actively controlled their investment.

The jury also found Fraser didn't aid in any common law fraud that may have been committed by GAW Miners. Fraser had argued he too had been a victim of the scheme, losing roughly $12 million, and that he didn't have decision-making power over the operations.

the nine-member jury found that none of the four crypto products at issue in the case was a security, so Fraser could not be liable for securities fraud.

As Suchmoon mentioned, probably fake and sitting on a dealer car lot with those scribbles being the stock number / other. Probably a window sticker on the right side that he is hiding as well. Also did a cursory search for Porsche dealers near Friendswood with a star bucks and burger king across the road, not much luck. Also just one white cayman used or new in the area from a dealer in Houston, no dealers it seems around Friendswood.

I wonder if the victims have a right to have him audited or monitored or something via the state exactly like this what he is buying what is he doing, look at his accounting books to see how much restitution he has paid etc etc. More so if I remember correctly he's on probation for like 2 years or something,( checking 21 month jail then 3 years supervised release with first 6 months house confinement), can the victims get the exact terms of the release like does it include no social media posts, no antagonizing the victims (quite clear that in this picture), other?  The FBI had that victims hotline or direct access or was it the prosecutor?  Perhaps a victim can find out. Guaranteed Homero's going to fuck up if he hasn't already. It's what he does best  Cheesy we just need to be vigilant.

Reading some of the old threads on various "prison" forums it does indeed seem it was almost a vacation for many early on, but newer discussions also seem to indicate that things have tightened up considerably and its not as relaxing as it used to be.

Immediate thinking is we need someone on the inside and that prison pen pals always seem to make the news. Quick checking shows that there are many prison penpal sites dedicated to this, some even official. Quite surprising when looking into it, always thought that weirdos seeking these friendships took a flyer and fired of mail unsolicited to whatever ever nutjob in en vogue. Whole damn sites dedicated to these match ups.  Selecting an inmate according to location doesn't seem to be an option, need to dig deeper etc.

Thanks truckin, well that's relativity good news  Grin "BOP - in prolonged transit" appears to a a real thing and fairly common.  As suggested he's in between facilities and still holed up in county or other for now. According to prison talk chatter out there people can be stuck in this position for up to 7 weeks from sentencing.  The even better news is that Homero's actual sentence does not start until his safely locked up and registered in a Federal facility. He can remain in limbo in a country lock up, or some sort transition house for however long and it does not count as part of his sentence. Federal Crime, Federal sentencing, Federal prison time. Clock only starts ticking once actually incarcerated in the Federal jail. Absolutely must make it even more trying for the loser. Apparently its a huge big deal for others that their pathetic loved ones are suffering so unnecessarily boo hoo Roll Eyes

Let's wait another month and hope his foul rotten name finally shows up where it belongs...

What does Shinner's have to say about that? He's supposed to depose Homero in jail, so where is he exactly? Got to say I am quite surprised by this. It is a whole separate bureau just to analyze where to send a prisoner. There is a whole  Offender Classification System includes medical, health, education, and some other determining factors as to where they go. The judge can just make a recommendation but they need to run it through this operation. Seems like an extraordinary waste of resources but looks like it is old law since 1930.

The whole tone of it was off for me. It should have been an authoritative instruction to the judge on what to do. Instead it reads like a narrative from this thread  Cheesy I was half expecting to see an OMG in there. OMG and he even rented this jet for x amount dollars. The whole thing reminded me of the childish banter between Uncle Stu's lawyer and the gawsuit lawyers at one stage.   They were arguing back and forth in writing on some lame point, it just read "petty".  And so did this.  This should have had a more serious measured tone to it.
