For all those willing to sue Mt.Gox because we will be making trades void, please remember that criminality usually falls under "force majeure" by its externality (not like we would have ever wanted that), unpredictability and irresistibility (we resisted most hack attempts, this one was "strong" enough to go through).

This is an interesting stand on that.

In other cases I know, it varies.

If someone would say tap into your phone line and make your number call these high-payment numbers (that cost x10 or x50 more per minute), then it is no excuse and still the person needs to be pay the due bill.
Even if it is just a regular person, versus hackers and versus big telecom.
Not saying that this is good thing. This is probably bad that it works this way especially as phone (land line) user can't really be at all responsible or can at all defend from someone tapping into cables box near his home.

Same thing with viruses popular in older days which called a high toll numbers from computer modem - dialers. But perhaps there where exceptions, not sure how it worked in most jurisdictions.

Sleeping over it, I thing most juts thing to do would be if any hacked exchange in this position, e.g. mtgox here, would reverse trades, then refund all lost income to people gaining on the fall, then try to find and sue the hackers responsible or sue other responsible.

In mtgox case, I would "kill" the auditor already. And sue the crap out of him.

Questions arise

1) Was it a private auditor brought in voluntarily by mtgox, or was it some forced, government thing to audit your company?

2) what with few people gaining with say @10 trades, @12 trades, @15 trades and so on

OT isn't a easy concept to get your around your head... however once you 'work it out' it changes your prospective of how finance should be done.

This is awesome - it should be possible to make exchange of BTC, and much more options too (say. emit own put-options, or own "bonds" that would work like a loan, etc).

And, the messages should be able to one day work as totally pure, separate, contracts.

So that everyone can verify that user Foo indeed placed some Ask on BTC (or bonds or other money instrument), and everyone could verify if site, like exchange site, delivered what was promised. All PGP signed or alike.

Then we can all be investigator if any exchange or site or seller/buyer would not deliver, while still being decentralized Smiley 

And we can audit without this "auditor" that leaked entire user DB to internetz while auditing Wink

Caveat emptor.  Do not invest money that you are not willing to lose.  Do not complain if you lose when playing a game, do not part with money in a game that you actually need in real life.  Do NOT call the cops when you are playing with untaxable money.  Those boys in blue only get paid when you pay your taxes.  If you expect to make a fortune from gambling instead of from producing real value, you are a part of the problem and not a part of the solution.  I hope it hurt bad to be stupid and greedy.  That would be just.

1. E.g. I pay ALL TAXES ON BITCOINs - you make it sound like FUD that BTC is "tax evasion money". Bullshit.

2. "from gambling instead producing real value" - so you call everyone that made fortune on 0.1->0.8  or 0.8->5 or 5->15 value increases not "early adopter" or "brave investor"(that risked often thousands on USD to buy BTC or on mining rigs to make this network work);
But basically you call us all (big traders, ArtFortz, Donators like da2ce7) - greedy gamblers, and in true communist style you imply it is bad to get richer on capitalistic ventures?

So let me get this right. An account was hacked, some guy put in a bunch of orders at basically a penny and was able to make out with 600 plus bitcoins valued at well over $7000 and he's bitching about it because he didn't illegally become a millionaire at the expense of someone else that perpetrated a crime? Wow...............take your free $7000 and run, I mean seriously?

This is how it usually works with BTC, buying low and selling high.

It was lower then usual for some traders indeed, but it's not his fault so crazy low offers where placed.

If the police are involved, then a case number should be provided...

1.  I do not trust the police.
2.  Nobody forced anyone to use MtGox!  The issue here is the one between MtGox and the hacker...

Maybe you should go: "Oh I was really stupid. I used a fucking weak password, and I put all my money in one place, I must be a genius!"

Actually, many accounts could be hacked not just the ones with so week passwords it would seem.

Anyway, the problem is also what with people that bought normally say @14 or @12 - they are also being rolled back it seems?

Assuming simple "reminding by email" and so on would not give expected result, and that it would seem many people also have same problem.

This is NOT just about mtgox specifically. With growing BTC popularity we can expect more and more incidents.

It goes beyond a simple hack.  The fact he's blaming Kevin for the "hack" itself proves that in itself for me.  Note that only third parties have been blamed in all this.  Not once has MT taken any responsibility for this supposed "hack" - why is that?

To defend MagicalTux here. He is french, and the miscommunications are incredible. I used to work with many French,  and they all come off like.. well like MtGox.  Its a combo of language and culture, that make the French seems incredibly obnoxious to Americans when communicating in English.

I might start a thread about it in the hope someone somewhere really cares!

It's really more the case of market with paintings, where the market owner and staff totally messed up the price tags (or: leaved the doors unlocked overnight and allowed it), and now don't want to give out the money and paintings from already completed trades.

I would care to remember that prices at this market can't be trusted, even if they just drop by -20% or -50%, I can't be sure isn't it another messup and another "rewind" is imminent. Perhaps you would not care and keep trading there as nothing happened.

What is wrong with you people and bad examples.

You bought some painting at low prices. It turned out someone got drunk and messed up price tags. Well ok, but this is their problems not yours imo.
Especially if we are talking of reversing already done deals.

That said, Im just saying what imo would be most just and nice free liberal market...
In mtgox place I would probable do the same if I wouldn't have liquidity to eat up all mess I caused...

No, just the phones had really low sticker prices on them, and the selling system is fully automated.

As I customer I don't give a fuck who's fault is it that some phones where allowed to be moved into other part of the shop, or between shops or something - especially that the same System/Person is responsible for allowing the initial steal and later trading of it.

But here the obviously fraudulent operation of taking over accounts was connected to unknown operations - buy and sell orders, some of them legit, some not, we will never know for sure.

I guess I would also rollback in place of mtgox, but what is the right thing to do is to eat the bullet and repay everyone. But that is nor possible probably since mtgox would need to have around 400,000 USD or so liquidity.

Or perhaps settle with the buyer, and slowly repay him over next 10 years using 5% monthly profit or something, and be known as the most trusted exchange ever that will always eat the bullet and never let down any customers about transactions Smiley  (yea but its unrealistic..)

You may be surprised about the prices, but actually this place is known for incredible price swings and unbelievable occasions.

Sure this looks sort of suspicious, but do we have independent "people's currency" to:
- make verdicts based on total speculation (at time of writing this post: coincidental close login times of hackers and the person that was able to made the cheap buy
- leak logs to hackers and Internet
- hand over logs to CIA/FBI

I may like mtgox (more until inexcusable horrible security was revealed), but above is really bad imo.
