Yes, I do believe  a class action lawsuit is possible.  I have incurred a loss due to KNC's "Deceptive Acts and Practices".  More specifically these practices:

1.) Advertised Batch 1 Neptunes to be shipped "Q1/Q2" of 2014.
2.) Stated on ordering page of Neptunes, Batch 1 that a full refund could be obtained at any time before the product is shipped.

On the first item:
KNC specifically knew that there product would not ship in Quarter 1, but purposefully led people to believe that it would ship sometime near the end of  Q1 or beginning of Q2. They did this in hopes of tricking more people into placing Neptune orders. They then shipped in Q3.

On the second items:
I asked for a refund in Q3, before my order shipped and my cancellation was refused.  KNC stated to me that my Neptune orders could not be cancelled because the product already started shipping to **OTHER** customers.  This is not the wording that was used on the ordering page.  They then referred me to the fine print in the cancellation policy.  So, they stated one thing on their order page, where it was obvious, but then stated the opposite in their fine print. 

These are Deceptive Acts and Practices by a company who's primary method of generating funds is defrauding people on an international level. So, yes I do believe that a class action lawsuit is in order and I am interested in assisting with correcting the injustices inflicted by KNC.

Those are not in hand.  Also, I certainly would not expect KNC to honor any shipping dates or have any honor at all.  They told me my units would ship Q1/Q2 and then shipped then in Q3.

He's just trying to tell you that your opening bid is so high that it's a waste of time having this thread.

I know it sucks, I'm a neptune owner as well but the fact is we got robbed and it's NEVER going to sell at that price.

In stock neptunes can be bought from a USA vendor for £4299, sorry Sad

I understand.  BUT, £4299 = $7,127 which is $600 more than my starting bid.

No coincidence (my order number is 1110x, so happened to be the very first.... And I guess I have one of the very first Titans as well, so stay tuned... just acting very fast when something new is released, and living in the same time zone as Sweden).

By the way: Sam didn't listen: the Neptune has only one Power-plug (so I will need to solder one additional on top of it, if I want to OC).

Yes. But Track & Trace on UPS page said in first instance: sent from Sweden Thursday-13:00 expected arrival Monday late afternoon. But when I woke up Friday it said: Friday late afternoon : big surprise came at 11:00

That makes no sense.  Why would KNC says "We expect to ship to Batch 1 pre-order customers this week and to Batch 2 pre-order customers before the end of the month." in their latest posting?

I'm no genius.  Just a database guy who created some products.  I also started a free email company back in the day and know a little bit about how the internet works.

Neptune Batch 1 was my 1st foray into Bitcoin.  CTS Scammer was my 2nd.  I don't know squat about "block chains", which is why I am offering a 50% recovery commission for help.

Why don't you two post pictures with today's paper so we can get after the real scumbags, if they aren't you?  This is the third time I've asked.  Your ignoring that request is very suspicious.

I have to say that I tend to agree that it is COMPLETELY unbelievable that an experienced member of this forum, with knowledge of all the scams in this industry, would send off that much money without the most basic verification of this company.  They claim they sent the money on the basis of two answering machine recordings, and a few other meaningless "data points".  They said they spent 2 days validating this company.  It took me literally 2 minutes to realize this was a scam.  (I take credit for calling it a scam first, BTW).

Their early posts are exactly what you would expect from the scammers.  Attacking people that called it a scam, calling them noobs.  Saying they did due dilligence and concluded this company was legit because there were so many "data points" showing it was legit.  Saying they spent lots of BTC on their products.

They finally admit it is a scam after the website is taken down, i.e. when pushing the scam no longer could benefit the scammers.

I hate to say it guys, but until we see Phoenix and Maui smiling with today's New York Times, you be fools to assume they are not criminals doing what criminals do.  Lie their asses off.

BTW, the fact that Maui is appaently one of those guys that supposedly buys a pre-order then tries to sell it on Ebay for a big markup (when there were supposedly tons of pre-orders remaining at the list price) puts him in the scammer category in any event, IMAO, and I'm not interesting in helping him recover his BTC.

So Phoenix, if that Avatar pic is you, why not post another to prove it is in fact you?   (From a criminal, expect a rant calling me a noob, or this post to be ignored like the last two.  From an innocent person, expect a pic).

jwhitlaw you must work for the scammers since you keep casting this BS around to get this investigation sidetracked away from the scammers.  So I'll ask you to prove that you are not working with the scammers by posting a picture on yourself and giving us some of your personal data so we know it's really you. 

So, if you ignore this request the only thing it will prove is that you're not a dumbass.

I just finished filing a complaint with the FBI.  Interpol does not deal directly with the public.  They deal with law enforcement agencies only.

I provided the FBI with all the data that this forum has uncovered so far.

Perhaps we should concentrate on caching the scammers, so we don't have to fill the thread with posts that are just slowing us down by accusing the victoms of being the perpetrators and other idiotic comments.

My brother and I made a bad judgement call by not waiting to call CMS on Monday to get 100% confirmation.  We were also warned by many others that thought it was a scam. Some of you pointed and laughed. Maybe we needed some if that humble pie. However, I ask that you now please either help or get out of the way.

Between working on tracking the scammers and following this thread, it has become a full time job.  If you don't have something helpfull to offer, please please keep it to yourself.

I sincerely appreciate all of the help we have received so far, even from those who warned us.

If it was me. My first port of call would be to talk with The Observer (who followed the trail) and Sushi. I would not be waiting for others to do it for me while I went to the beach to chill out.

Yes, I made mistakes.  I already pointed that out.  Do you want me to make a list for you?  They are self evident. No one feels worse about that than I do, except maybe my brother who sent the scammers way more BTC than I. However, I am going to take my lemons and make some new exotic form of lemonade.  I personally get very excited when I make mistakes, because I know that it always creates an new opportunity for me.  It always has.

Really, I'm not thinking someone who fell for a scam that obvious should be looking at starting a bitcoin security firm.

Read the posts.  I notified the hosting provider's legal department.  BTW, someone who got scammed is the perfect person to start a security firm.

My hat goes off to Augusto Croppo, who first pointed out this his find with the IP address 185.8.106.66 that is associate with butterflyiab.com.  The thread was moving very fast and I missed his post. Thank you Augusto, for your work and I only wish I saw your post earlier. I thought I read every post, but obviously did not.  If you still think I and my brother are involved in the scam, I will give you my BTC transaction with CTS Miner, for you to verify.  

So here is the next question.  Who here is the best expert at tracking down bitcoin transactions and finding out who is currently holding our BTC?  I can either pay you a commission on every BTC recovered or an hourly wage.  Which ever you prefer?

In fact, I am thinking about putting together a team of people and form a bitcoin security firm that performs the following services:

1.) Investigates after the fact frauds involving bitcoin.
2.) Attempts to recover bitcoin that was obtained fraudulently and stop scammers from receiving product.
3.) Alert policing authorities and removal of the scammers support base. (ie. website, etc.)
4.) Investigates companies that offer their products for sale in bitcoin.
5.) Write a "Best Practices" white paper on how to not get scammed.
6.) Offer a searchable database of:
   a.) Known bitcoin scams and their associated IPs and domains and other relevant details.
   b.) "Un-verified" companies, involving bitcoin, that are asking for payment via bitcoin, wire transfer, western union and other forms of payment that are not reversable.
   c.) Known comanies that have achieved particular levels of trust in the bitcoin community:
      • Company is verified as legit via a pre-set of criteria that we will come up with.
      • Company has shipped a product and product works.
   d.) Allow the public to submit new companies for review and other relevant data to be verified.
   e.) Mobile and tablet app version of the databse.
7.) New scam alerts available via email, notification services & sms.
