I think regardless of what they refund you in - Bitcoin or USD it is OK as long as the value of the refund is the same as what you originally paid (minus a processing fee if they charge one).
And that's the problem. They choose the option where the value is less, regardless of the exchange rate.

Theres a clear different between pre-orders up thru april that took BTC and said BTC was forwarded BA, and further orders when we switched to Bitpay and Shopify and BTC was then cashed out to USD and sent to BA. Pretty simple.

The arrangement between you and your supplier is irrelevant to the contract between you and your customers. If someone ordered $5,000 worth of merchandise and paid you, you have to refund them the same amount in whatever currency you choose to refund in. Anything else means your "refund" is not really a refund at all.

+1, I agree because it should not matter to the customer.

im a big supporter of the dz co op but what the hell did bob sagg really see when he went to china around december. I am guessing he saw something that was supposed to be ready in march? what was really going on? I always had a bad feeling that it was all going to end up with black arrow having fuck all.

The simplest answer is usually the correct one. I don't believe for one second that BA isn't mining while they "test" the units. They've had working hash boards for a few weeks now and seem to have breakthroughs at convenient times that delay shipments so they can apply said breakthrough.
Why speculate, they have already published screen shots with the BTC address some mining has been going to, it's not like it's a big secret conspiracy. But most shipping asic vendors can tell you that it's quicker to make a million dollars selling miners, than it is to mine a million worth of BTC, as most hardware takes months just to cover it's construction cost with mining. Getting boxes out the door quickly is the best revenue, just look at how much net hash antminers have, and work out how much BTC bitmain made from selling those!




You've missed the point entirely.
Mining with versus selling,.. Yes selling is more money faster.
However,..
Selling, THEN mining with that HW until the last possible second and THEN shipping same (now useless hardware) = best of both worlds. I get my profits AND your profits and the "risk of repercussion" is minimal.

and I thought honesty was the best policy.

All my block eruptors are off-line and all my GPUs are going off-line tonight.

Thanks to Black Arrow I've lost thousands in this venture and I'm no longer in the mining business.

If you have been using block eruptors and GPUs then you haven't actually been in the mining business for a while.

No not that long, I started in October last year. It was profitable enough that I decided to go all-in and get some real hashing power in November.

It's now June and I'm up Shit Creek without a paddle.

Maybe should have sold those block erupters and gpus in recent months and got some Antminers.

Personally I've made some bad decisions. Ordered the Viper from Alpha Tech and now BA is slow in delivering my X3. Life is all about choices and I've made some bad ones earlier.

We are happy to let you know that we've just solved the SPI issues.

In the picture below we run only at 1.1Ghz instead of 1.2Ghz because we've hardcoded the voltage at 0.81V and 2 ASICs needed a little bit more.

Our plan is to tape out the new backplane in 1-2 days, start shipping of X3 on 23rd (after we get the PCBs back and we assemble them). We should be able to deliver all X3s by the end of the month.

Glad to hear production can move forward. Has the switch to 1.1Ghz helped to increase power efficiency?

Is BA going to compensate us with more Th?
It's almost end of June and difficulty is really crazy now.
How the heck am I going to ROI on the X3s?
