No, he's not. He's still at large, with his cat, and he is still billing gox for webhosting services.
Garza is in the US, which basically means he only has a very slim chance to escape.

Amazing how they get away with such big scams and never get anything serious done. they should be locked up or to be fined 10x the amount they shammed and refund everyone  very doubtful but as old saying goes with shit like this. You win some you lose some you take the risk you take the risk.

That for a start. Scamming millions of dollars from people and operating a ponzi is also crime.
I have no clue how he is still at large. The evidence is present, Homero can't escape.
