I believe it should be up to the seller to decide who to sell it to regardless if it's an auction or not. It does not seem like seller has specified but you're probably right about it not being an auction. It is still up to the seller's discretion who to sell it to and for how much though.
I am sorry, but I disagree. Price was stated and it was $5. I was the first who posted "sold" and domain should be sold to me. If the buyer dont pay in at least 24 hours than is usual that the seller cancel the sale. This would be perfectly normal on many other forums. I hope it will be on this one, too
