Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.

It is illegal because you are stealing something and this is money, maybe bitcoin does not have any value to most people in the world but it is very valuable in the crypto world and doesn't cost cheap, whatever the amount is it is still stealing money.

I will guess to think that anything that has value to someone and that does not belong to you, in obtaining it without their consent is stealing.
There are laws in place to protect people from having their possessions taken from them without any authorization from them.

Stealing is taking another person's property without permission or and without intending to return it.  Since you said that what if you bought address with a bitcoin already on it, well conscience of yours would be the judge.  In the first place the owner did not know and it is clear to his mind that you are not doing anything wrong.  So it is likely you did not stole it but seems like that since you know that it really belongs on him.  But stealing is of course illegal.
Well yeah stealing is always illegal, in every ways and every countries and that’s the fact which everyone knows but in your case, which you have a bitcoin wallet with bitcoin in it, I don’t know should we ever call it stealing. I mean this is like one in a billion and it’s an incredible and unbelievable coincidence so it’s up to you now, only conscience can answer.

Stealing can be be illegal because if you are arrested by NBI it means its illegal also bitcoin is money so its illegal to steal bitcoin to others..
of course it is definitely illegal and you cannot steal from the people because you would surely get a lot of trouble with law

Stealing could be illegal but it doesn't mean that bitcoin would be illegal, bitcoin is mean money, we use bitcoin and we earn bitcoin in a different ways. In my view, only illegal ways of earning is illegal not bitcoin.

This is a grey area in the courts actually.
There was a files claim about someone who ruled that bitcoin is not valued the same as fiat so the case got thrown out of court against the person who said bitcoin was stolen from them. Lips sealed

OP does not steal bitcoin to someone else he just generate a new bitcoin wallet and he got the address with free bitcoin balance that is why he say that is miracle i do not see the form of stealing in that scenario. correct me if i am wrong.

OP just want to know "what if" you generated a new bitcoin address, OP also stated that he know that the "odd" is very low and he just wan to know...My view on this is it is not illegal, coz you didn't mean it, unless you "intentionally" do that... But if you are willing to return it to the rightful owner and its just that no one is claiming, then it is yours and that is not stealing...  Smiley

stealing bitcoins is not illegal but they cant steal your bitcoins without a private key so dont worry they wont get your bitcoins unless someone knows your private key they can have access in your account if they have a private key

He made this thread just to get opinion to others because he didn't expect to generate a new address with there's already Bitcoin into it which is probably owned by someone already. He ask question about stealing because he might intend to get those Bitcoin on newly generated address.
