The ether collapsed after the official statement of the Chinese.
NYC is a completely different currency.
 It's for people.

Not really, China has taken that stand but in the US it's allowed unless there is a specific violation of securities law as some ETH ICO's have found out.

Coinsprofit (original NYC pool operator) has said the new code (2017) is having too many pool mining problems and on a fork that is very bad for NYC.

No reason for a fork that creates no benefit. If we create fork, it should be to lower block reward.
