If my downloaded brain is indistinguishable from my old human brain, then how would a test be able to tell the difference? And I have access to the internet in here, so it's not like I'm frozen in time. But I don't really understand how this works.

Only which are uploaded with the reliable original brainscanner.
Those brainscanned with the older beta or with the cheep Chinese copy don't have all human brain capabilities.
Make a new upload and overwrite yourself then you will be indistinguishable from the original. 
You can even choose premium features with 50% more virtual mind storage space and 50% higher speed and you will be like a hyperactive genius.

In the near future every American will have an implanted geolocator in his brain and his brain will be scanned periodically on suspected activities.

also by 2045 (assuming moore's law holds true) we will have enough computing power to simulate all the human minds on the planet..
of course moore's law probably won't hold true, but maybe quantum computers will still make this a possibility..

Not only may we be in a simulation (Matrix?), we would probably be simulated ourselves..

This is a really good question. Famous philosophers since longer time addressed this question.
Stanislaw Lem's fictive heroes are philosophizing about this question in some of his novels.
Would be the backup of your mind be yourself or just another identity ?
Could you make a copy of yourself to make all the work for you ?

This is a philosophical topic. I would say it depends on the point of view and the implementation.
Your mind is in continuous change. You may think you are the same as you was 1 year ago but every atom of you was changed by your metabolism and your ideas, your brain content also changed.
So why are you the same person ? You may think that you are the same person because this change was continuous over the time and your mind and your body has been changed step by step.
It could be done the same with your uploaded brain. Your mind will be scanned and uploaded but not activated until your dead.
If you are feeling that your time is closer you put yourself in a machine which scans your brain and when specific brain regions are deactivated in the natural death process this function will be taken by your uploaded mind region and connected with your remaining active brain. So you will feel a continuous step by step continuation of your existence.
If others would see the same it is a different question.
You could even preserve your body by Cryonics with cryopreservation technique:

Later when the technique is advanced then your mind could be reimplanted to your resurrected body.
The cryopreservation may be can preserve your body but not your neural connections and your mind so it could be helpful if your have a backup of your mind in an uncensored future Namecoin blockchain.(storing your mind on a central server could be cheaper but could be also altered)
Of course living in a blockchain could be more expensive than only to staying there and waiting to be reimplanted in your future cured body.
After a virtual living the reimplanting in your former body or another biological body could be done also step by step so that you have the feeling that your life was continuous and not interrupted by a coma.
