This situation should be looked into by an admin so I don't think he should give up on it. Obviously if this guy was personally spreading malware then he shouldn't get his account back but if it was hacked and used to spread it then not entirely his fault. With that being said, given the rate that accounts are being restored here you're probably going to be waiting a long time if ever to get your account back as even people who have just been locked out of their account through no fault of their own aren't getting them back even with sufficient proof.

Hello friend; I am completely sympathetic to you.  But I do not think that the Administrators will be able to unlock your account.  Because virus and other malware links have been posted from your account.
I may agree with you that your account was hacked.  But the question is how will you convince the forum admins  And if they unban your account may be other members who got banned for the same reason will be applying to unban them too.  They will also be claiming to be innocent.  
I think if you can provide some proof of hacking; may be Admins consider your case sympathetically.  Still chances are low because every sinner(though it may not be you) always claims to be innocent; it is universal truth.

I think the earlier you begin to make peace with the obvious fact that you most probably do not have even have an iota of chance of getting it back "just as the below quoted post from a Mod supposed" the better, and considering that users whose accounts never got banned, but only hacked then locked, and posses the appropriate requirements to unlock them are barely getting their accounts back makes it almost impossible to get it back.

You should probably just wait and hope that theymos implements the automatic recovery tool which he said should be ready by the end of the year, because your account just realistically isn't going to be recovered otherwise unless cyrus mysteriously starts to restore them or more staff are given access to do so.

You can expect it sooner. Since now a team is working for recovering accounts. I think lots of appeal have been sent within this days and it may cause a little delay. Thank you for being patient.

We've streamlined our processes, and Cyrus has put together a team for handling these cases, so account recoveries should now be handled at a reasonable pace again.
