Hello,

I am going to live in Spain soon.

I would like to know what are the law and regulations regarding Bitcoin and how is it taxed ?

Should I cash out my Bitcoin in Spain ?

It is taxed. If you sell your bitcoins and send the money to the bank you will have to pay tax for the earnings.

Difficult to say because as far as I know there is nothing final on Bitcoin treatment by the government. If you treat bitcoins in the same way as profit rendered by deposits, this should apply:

Profit of less than 6000 euros, 21% on your income tax.
Profit between 6000 and 24000 euros, 25% on your income tax.
Profit over 24000, 27% on your income tax.

Yes, capital gains taxes are the same in all Spain. This includes Canary Islands and Balearic Islands.

Be aware that it is not yet final that Spain will tax profits in bitcoins as capital gains taxes.

In the Canary Islands are other taxes law, Special Zone and R.E.F, Ultraperiferic Region of Union Europe.

There have only been two responses to binding consultations (consulta vinculante) by the Department of Taxation (Dirección General de Tributos) in Spain. This info may help you.

I would say that if you are not a resident in Spain for tax purposes, and you sell the bitcoins to euros in your country of origin, you would not pay taxes on the conversion in Spain (You should pay them in your country or origin or whatever country you are liable for taxes). However, you should still pay VAT (IVA) in Spain for the new house if it is new, or the Tax for Transmission of Assets (Impuesto de Transmisión Patrimonial) if the house is not newly-built.
