The only time I suggest taking a bonus is when you are just testing a new casino. Count the money you deposit as a loss as soon as you deposit and use the bonus to explore the games the casino has to offer. I see what you mean. The fault was purely that of the casino. I think there was a miscommunication between whoever sent the email to the OP that he had a deposit bonus and the person who was responsible for awarding the bonus on the account of the OP. To your first question, like I already wrote, cashback is like giving money from the right hand and collecting back from the left. Even if it is a bonus, it is too stringent and unfair. It is even a bigger trigger for those who are addicted to fuel their addiction and continue for a long time trying to get their cash back from a hopeful win.

And even worse, not only because cash back is not a very good deal (yes, better than nothing, but still), but because it seems that the promised deposit bonus was the fundamental reason for joining that casino and not another.

In civil law, you can litigate and seek for some kind of compensation if you are harmed by an unfair clause; but if the error was so big that you would have not agreed or made the decision if you had known it, then the agreement should be considered null and void.

Who has the luxury of time to read ToS, whether online or offline? I doubt a great number of people do read that, whether on casinos or banks. There's a good reason the ToS part is always written in tiny prints or it's too lengthy than necessary and that's to technically frustrate people from reading that part. That's what I think and it won't be far from it. I once had to close a bank account within two days of opening it because of its ToS which the bank pointed out to me when I got into a tight corner with them. There was no way I could've seen that because it was almost like hidden. These guys know their deceit.

That is very true. Some casinos would spice their site updates on personal to their customers or the audience and technically believes that the bettors attention would be more focused on the texts sent by the casinos and ignorant of bettors to do their research or probably verifying through the ToS of the casinos becomes a disappointment to the bettor because the story could be a compromise.

You are right, reading the TOS first would hurt, but also, even without reading the TOS, it's worth noting that casino, any casino, would rarely allow you to earn money through them. They can do that on rare occasions to attract more users to their platform, but normally all those promos won't make them lose money, they would go bankrupt otherwise.

We can say it if the terms is not written somewhere on the site, but if the terms is written then we cant judge like that.
I remember that Fortunejack did something similar in the past (not sure now) where our wager (when taking bonus) will be counted once we lose our initial deposit.
At that time the terms is clearly written in their terms of the bonus, so once players take the bonus, the players cant complain about it because we all as players agree with terms when we take the bonus regardless we read the terms or not before taking the bonus.
