RIVERS STATE CRISIS: STATE OF EMERGENCY:

The President in his address to the Nation today declared State of Emergency in Rivers State. I was Shocked on hearing this cos I’m currently in Rivers State and there’s not been any disruptions of the General Peace and Governance, No Wars or Violent crisis ongoing!.
So why then should there be State of emergency and the President Suspending the Governor and the House of Assembly Members who are also all elected to serve.

When I first heard this news I added an update to @Cossyblacks thread https://bitcointalk.org/index.php?topic=5533855.0  but I opened this thread to discuss the ABUSE of our Laws and Constitution.

I got talking with my friend who is a practicing lawyer and he had this to say based on the Law and Constitution;-

1. President has powers to declare state of emergency. S. 305(1)

2.State of emergency doesn't extend to taking over administration of the state, by S. 305 of the constitution.

3.The crisis in Rivers State has not led to the situation provided in S. 305(3) of the constitution

4.Suspending Governors and Lawmakers in a state and appointing a sole administrator is unconstitutional.

In the case of - A.G. Plateau State v. Goni (2007) 16 NWLR (Pt. 1055) 1 Court said:
1. A state of emergency does not justify the removal of elected officials.
2. The court stated further that the President lacks the power to remove a governor or dissolve a state assembly.

So How come now we are hearing this from the President, from where is he getting his Authority?
Where are all the National Law makers, SAN, and Chief Judges and the likes who are supposed to uphold our Constitution?.
Why are they silent?
Are they trying to get Rivers State under their thumb by any means Necessary?.
What is this MESS they’re about to create in Rivers State and Nigeria?.

I said the same thing too, how can he declare a state of emergency when there is no crisis in the state. I haven't heard from any part of rivers State that there is war and I wonder what the president is thinking, the country is a joke and werey as proven that he is not competent enough to be a leader and the annoying part is that there's nothing we (citizens) can do about the situation, this is purely a conspiracy between the president and wike just to take our existing governor and his deputy out of the office to enable wike and his cohorts do what to want to do in Rivers State. Even till now I'm still in shock of why there is a state of emergency in Rivers State for no reason.

I was shocked when I first heard about the declaration of state of emergency in Rivers State, before I knew it then follows the suspension of the state governor and the members of the house for a period of 6 months, now this morning, I was hearing another sad news about arresting Funeral the state governor, for allegedly going against the president directives, what is happening.

Am not against the final directive from the President, but he wouldn't have join hands with Wike just to ensure that they both pull down this man called Fubura, remember he was his secretary when he was governor, then Wike nominate Fubura to office and now everything turns around that his servant couldn't listen or obey his directives being a godfather, this is all about money, the money allocation Wike is demanding from Fubura is too much to cope with, there is where the problem began.

Now consider the side of the President, he wouldn't have been this bias because the world is already aware of what is happening and there's no media conviction they can use to fake us on the reality on this matter, I will also blame Fubura because the moment the president suspended him, he wouldn't have made a decision of going close to the government house or any other government property till the whole thing is calm, I hope this does not start the eruption of war in Rivers State between their factions, remember they all belong to PDP while Wike supports APC and not his party.

Guys be getting ready because this will affect everyone of us in the country, militants are causing explosions already on the pipelines, we are seeing the videos already, which signifies the beginning of war, as this will cause a little or major distortion on the petroleum supply from the region, we may experience fuel scarcity or hike in price, plan yourself ahead and get prepared for the worse, while in expectations for better days.

Mr President has violated the constitution in declaring state of emergency Rivers state where there is no war or tension, its a political hegemony between two father and Sim, and one would aspect the President to play  a neutral roles in dealing with the issue. but Mr President took side with the minister to frustrate   the Governor.  in amidst of the crises the Governor has been peaceful and respectful to the rules of law. He even signed a peace accord with the president for peace to reign yet the minister wike keep making troubles and the President failed to address wike, rather he blame Sim for the political crisis in the state.

There is no war that warrant the declaration of state of emergency, Porth court  and all part of the state are in peace, the world should know wike and Mr president are the problem not sim. He did not violated any law, because he is the Commander in Chief of Armed Forces of the Federal Republic of Nigeria, but I can agree with you that the state of affairs has not gotten to that stage of declaring suspension, though the peaceful protest eventually turned into violence and things like this can escalate to cause a serious concern to the state as innocent citizens maybe affected at most.

This is what hunger for power and personal interest d cause in a country. Em d unfortunate that the beef between the former governor of River State the person of Wike and the present governor of River State "Fubara", is being sided one place by Tinubu. Even the whole wike's visit to Alabama, na still for the same reason of provoking fubara and the ijaws to anger so if they resort to violence, the president can use that as his reason for this state of emergency.

We de for a lawless country where once personal interest comes in, the law can be twisted to suit that interest and the judiciary are as useless as they've always been and that's why they can't stand against this orchestrated Corp that has been mated not just against fubara but against the whole rivers State and Nija delta region. What he did is violation whether he’s GCFR or not, there’s no where in the Constitution that gives him such rights and power and even though he has the authority to declare state of emergency, what’s happening in Rivers State does not fall under the provisions stated in the constitution S (305) that he quoted.
Some people might say there’s vandalism of pipelines but that doesn’t fall under the jurisdiction or protection of the State Governor cos it’s a Federal Property and the Federal is paying a security Agency for that.

There’s absolutely NO REASON for a State of Emergency, this jus goes to Prove how our democracy has shattered, everybody who is supposed to disapprove or fight this has been bought over, the PDP that are trying to fight it well I don’t think they have the manpower or will to win it.(THEY are not United enough)

This case we are seeing will not be that fair because in this story about the two women the king wasn't into favoritism or siding one person but he only wanted to no whom is actually the real mother which is why he use the dividing method and the most resisting became acknowledged by the king to be the  original owner of the child, so for this rivers issue instead of the king to act like one he is even making it impossible to be resolved, so this is to say he is not into the real owner but instead he wants the third party to claim the home of another so he cannot be trusted for a good judgment.

A State without nonstop crisis shouldn't be declared as a State of Emergency. What is the meaning of that, is he Bola Ahmed Tinubu should interfere in River State politics. This is one thing that I dislike with the Yoruba. They don't have respect and let other States run their political affairs the way it suits them. I could remember when Buhari was in power, he didn't support Ameachi's actions publicly.
