I can understand his enthusiasm to see that what he applied for actually worked or not. You said the casino was still processing his request before he made another deposit, how about he try it again and see if they have finally concluded in approving the request. You cannot. They have not yet confirmed the self-exclusion, so you are not going to win the case or even just get the money back.

There must be proof that they accepted the self-exclusion that was requested by you, and you are not able to access their gambling site anymore. You fell into a trap, and you bit it. I really wish it was easier, but it feels like they make it complicated on purpose so we won’t actually use it and just keep playing. That’s how addiction happens, you keep going and keep losing, which is obviously favorable on their side.

We really need to have our own desire to self-exclude from gambling. So even if the casino does not approve our request to activate self-exclusion, we can actually do it ourselves. In my opinion I think he has a chance to win since the casino show a predatory behavior towards the gambler that already requesting self exclusion. It’s a different story if he didn’t ask to be self excluded when the casino gave the bonus to encourage him to play.

However, it’s very to win against the casino on legal battle since they can prolong the case until your out of money to continue legal charges or they can hire a good lawyer that can turn the table.

Nothing happens. I am on the side of casinos on this and always hated the request for self exclusion. "I am a big baby who can't stop gambling, please make it harder for me to play here" is not what an adult does.

If you have a problem then that is not casinos responsibility, you have to take up the responsibility and go seek help, find a therapist, even go to rehab and stay there for a few months if you have to, better than losing that money to casinos at least. Yet they still await casinos to help them for some weird reason.

Exactly the point man, it sometimes baffles me when I read online about some gambler requesting a self exclusion from a casino they have been playing on for years, then proceed to depositing money and gambling, then after they have lost the money, they turn around and blame the casino for not approving their self exclusion request on time, its very pathetic to be honest with you..

Technically, the casino has not yet responded to your request of self-exclusion whether they have accepted it or not. After that fact, you saw your account gaining VIP status which prompted you to deposit more funds in the process.

I guess the timeline of the events must be checked in order to reach to a conclusion about this. Perhaps you have received your VIP status before you've emailed them for self-exclusion?

Anyway, I view this situation leaning towards the gambling establishment here. Again, requesting for self-exclusion is not mandatory but a privilege which is purely discretionary on the part of the gambling establishment. The act of depositing because you cannot control your addiction can purely be associated to your free will, which is the reason on why you CANNOT sue them in this process.

That’s a rough situation, and honestly the casino handled this poorly  once a clear self exclusion request is made, responsible gambling rules say they should act fast, not stall or upsell you to VIP. Whether you can reclaim deposits really depends on their license and T&Cs, but many regulators side with players if the request was documented and ignored.

At the very least, this is a strong case for a formal complaint to the licensor or an ADR, because the duty of care clearly wasn’t met. Best to consult to a laywer with a good experience on this matter.
