From what you wrote DraftKing didn't hold the man hand and force him into addiction or did they? Calls, text, emails and whatnot or all advertising strategies used by majority of casinos... When I see news like this, it pisses me off coz I know for sure that these folks in question always find it very difficult to accept that they are at fault.. So you see them trying to shift the blame to another which in this case will always be the casinos, when they themselves are the one that should be blamed... DraftKing just like any betting company will always try to advise their company, so that whosoever find interest in gambling will go ahead to gamble with them...

Players that are part of a casinos VIP program get more perks and attention than normal players, and many times, this attention can fuel addiction that's for sure. You get these exclusive bonuses, personalized services and a lot more, simply because the casino sees you as a high-stakes customer and they want to keep you in their platform.

It is important to seek self exclusion if you find it a bit too much and you see that your addiction is getting the better of you. The casino would be culpable if they do not take your request for exclusion seriously, but if you never made that request, there is no way they would know there was a problem.

That's totally absurd because even though these companies advertise their products they still make it clear that consumers should take them with caution this include cigarettes, on the pack it is clearly written " smokers are liable to die Young" this is to warn people that excessive intake is dangerous. Casinos advertise and try to promote their site but they still remind people to gamble responsibly. Blaming the casino for his own actions is a sign of irresponsibility because he made the decision and he doesn't want to face the consequences.
Contrarily, warnings, like smokers are liable to die young, indirectly effects smokers to inhale more nicotine, most smokers threat what's shown in the label as a complete lie, because they know of an aged smoker whose lifespan lasted upto 95 years. In as much addictive industries come up with warnings, it's like a fuel added to a burning fire, desire is like fire, and those warnings the fuel, what smokers care about is the cigarette, and problem gamblers the casino, not what they have written around it, their brain is wired to lay hands on what fulfills their desires.

I can see both sides of casino VIP programs.  On the other hand, constant bonuses, personal account managers, and exclusive offers can easily encourage some players to gamble more than they originally intended But if a player never says they're struggling and keeps gambling as usual, it's not always easy for the casino to tell the difference between a gambling addiction and someone who's simply a very active player.
That's why it's so important to recognize the warning signs early-constantly trying to win back losses, increasing your bets all the time, or gambling with money you can't afford to lose.

A man in the US sues DraftKings (a sportsbook) after claiming that the sportsbook led him to gamble away millions of dollars. According to the article, the attorney the guy hired claims that the sportsbook VIP hosts bombarded the guy with calls, emails and other forms of communication, which contributed to his growing addiction, which ultimately led him to gamble the money he saved for his wedding and took out loans to feed his gambling addiction.

The article also said that the guy's father of the guy tried to convince him to request self-exclusion in their state, but the guy declined it. The addiction got so bad that the guy wrote a suicide note. After that, he was admitted to a hospital and was diagnosed with severe gambling disorder, anxiety and depression. The article also said that, after the treatment, the guy suffered a relapse and joined DraftKings again, but in the end, he requested self-exclusion in their state.

Currently, the guy is still in recovery, has a job now, and is married and has a child with his wife.

What's your view on this?

Personally, I think the guy should be held accountable for his actions, but in the article, the sportsbook sounded like they were extremely aggressive in their promotion to this guy, I mean, getting bombarded by calls, emails, and other forms of communication is a bit excessive.

I will never understand the mentality where you start a gambling addiction when you're already wealthy. Most people would would lucky to earn $2 million across their whole career and would spend most of that just on regular stuff needed to survive. This guy already had it available upfront, could have stuck it in some low risk investment fund and lived quite comfortably for the rest of his life without ever working another day. Instead, driven by pure greed, this guy decided to throw it all away in the aim of becoming.. even richer? I don't really have much sympathy and doubt the judge will entertain it either, because he had it all and threw it away due to sheer stupidity or just that quest for "more"

I see another loser trying to blame everyone except himself and try to find excuse for busting all the money. Even if casino managed aggressively try to drag you to gambling by calls and email, there is always ignore and block user features. Why not call police and tell you are harassed by casino member? If this guy would not have lost his money, he would stay low and silent. I dont think he would try to sue DraftKings for dragging him to gambling if he multiplied his wedding funds Cheesy

It has always been the same cycle- you lose and blame others for your mistake. In fact, it's the easier way around. Instead of blaming yourself, you tend to pass the guilt and shame to others just to justify your own mistakes.

This kind of cycle has to stop. The moment that you feel like you are slowly being devoured by your gambling addiction, that should be the sign for you to re-think your life decisions and assess whether you want this kind of lifestyle or not.

There's this self realization that hits me. Immediately once I face a quick lose that I didn't expect, normally i set a limited amount for myself if I want to gamble and I expect the money not to be exhausted for a period of time or I expect to  win a good amount from that money but if I lose that money quicker than I expect to without winning, self realization hits immediately and I will either retrain myself from gambling for some period of time when I feel I'm over that lose or when I have better control of my habit. I always take responsibility for my actions when playing and that's what even prevent me from being compulsive. The guy is at fault too, he was not force to make deposit.

That's what missing from a lot of gambling addicts- it's about accepting the fact that you are wrong. It's also about taking the necessary steps to avoid these problems from happening again because these kinds of stories are always shared around the globe.

A gambler should take responsibility for themselves if they become addicted, because it was their decision to gamble in the first place, so if they become addicted – especially for such a ridiculous reason – I think that's a risk they should accept. After all, casinos will send various offers to their users. If a user can't resist those offers, it means they're at fault for failing to manage their own limits and gambling habits, since users still have the ability to ignore those promotions. If they fail to do so and became addicted, then it's their own fault.

Gambling addiction is completely the fault of the gambler, it is not reasonable to blame anyone else for it. If we do not follow the right rules while gambling and continue to gamble out of greed or emotion, the gambler loses self-control and faces big financial losses. It is very important to do our own research before gambling. Gambling based on the words of others is not right, as this can increase the risk of losing money many times over. Gambling is only good for entertainment, gambling with the necessary money in the hope of gaining more money based on the words of others is nothing but madness. If we rely on our own research and control our greed and gamble within our means, then we can protect ourselves from big losses and protect ourselves from gambling addiction.

I don't know about the US but if this were in my country the case is dead on arrival and will be dismissed for lack of merits. Casinos does not force anyone to gamble and they make it abundantly clear that their users must gamble responsibly and that includes gambling with what they afford to lose. I know it will difficult but it is important that gamblers work with those rules because that is actually how to succeed in gambling.

I will not blame the gambling site for such a move, as they are only doing their part as an organisation to reach out to their customers. It would have been serious if he had requested self-exclusion and the organisation turned him down without acting effectively, knowing that he is addicted. As it is now, he was just addicted and could not control himself; that's the case, as the law cannot hold the organisation for any reason.

I don't know how data protection works in the US, but in Europe you must opt-in to receive commercial communications (it is not enough to simply do nothing, or not to reject them, but you have to actively mark the corresponding option consenting to the use of your data for profiling and the sending of this type of communication).

If something like this had happened, that is, if he had not given his consent to process his data in this way, and yet he had been bombarded in that way, he would understand that there would be legal cause to be able to sue and, probably, win, although the last word on playing or not always lies with the player. But if not, then it simply seems like another example of a person who is not able to take responsibility for their decisions when the result is not as expected (he lost).

What's your view on this?

Personally, I think the guy should be held accountable for his actions, but in the article, the sportsbook sounded like they were extremely aggressive in their promotion to this guy, I mean, getting bombarded by calls, emails, and other forms of communication is a bit excessive.
Well, normally I am on the side of casinos in these cases, because a casino is a business and they are not forcing you to gamble, if you get addicted and lose it all ,the nit is your fault.

However, in this case I disagree, because dude got prompted to gamble all the time and got called and texted and basically edged to continue to gamble. In that case that's is wrong, McDonalds doesn't call me up and tell me to order, apple doesn't call me up to say upgrade my phone, DraftKings ended up ruining this guys life, not because they allowed him to gamble, but because they called him up constantly and egged him to continue, if they did not do that, then I would side with the casino, but because they were pressuring him to continue, I agree that it was a mistake on behalf of the casino.

He can cut the call, unsubscribe from their mailing list, and totally ignore their promotions, casinos and sportsbooks are like that when they have an offer and you are subscribe and you entertain their calls, they interpret it as you are interested in hat they are offering, so he should be responsible for his actions, because there are ways to cut casinos from communicating with you.

What's your view on this?
Honestly I still don't see any strong reason to blame the casino entirely in this case. Because if he had won a lot, this case probably wouldn't have happened. Ultimately whether to bet or not is up to the individual.  Maybe he can question the company's excessive advertising but it doesn't seem right to blame others entirely for one's own decision.

Currently, the guy is still in recovery, has a job now, and is married and has a child with his wife.
According to the article, he joined during the lockdown around 2020 and reached VIP status by 2021. Despite gambling away $2 million, he is now married and has a child. That is not bad for someone who threw away millions and fails to take any responsibility for his actions. The US judicial system is funny sometimes; they might actually award him compensation for his own foolishness, since others have won similar lawsuits in the past. Grin

Except he can prove that those calls, email or those other forms of communication included promises that he will will if he play or that they were going to refund him if he didn't win. There must be a form of consideration that made him to go for the bet out of his own volition but if those promises or coercion are not there or proved in court then he may not succeed in court. Those forms of communication will be seen as advertisement which is meant to convince customer for patronage or to bet. Advertisement is allowed like as we see gambling ads, they are not with coercion but for your own decision.

Currently, the guy is still in recovery, has a job now, and is married and has a child with his wife.

If he has already gotten back to his normal life with the family then he should move ahead of his losses and decide to let go of what is not giving him comfort and joy.

We should all be, you don't lose everything and blame the casino because you failed yourself for doing the right thing.

Quote

I also received a lot of promotions on casino where I'm not even active, for every email there is an option to unsubscribe failing to hit unsubscribe means you welcome the promotions, if something annoy you just ask to stop sending promotions but you welcome it and when you suffer the consequences, you don't sue.

Strange as it may seem, suing a sports betting bookie just because the person was addicted after being bombarded with some sort of aggressive promotion, I think the decision is in the man why did he become severely addicted just because of his promotion?

I'm not sure his lawsuit will win because the man himself is wrong, because we know that gambling is full of risks, and the casino will certainly continue to do aggressive marketing so that many players are interested and play on his platform.

Responsible for gambling.

Once again, I bring up the issue of shifting responsibility. No one forced him to bet—at least, that’s not what the article says. He is an adult who, in a way, chose to do what he did. If he had won millions instead of losing, everything would be fine, right? It’s easier to blame others than to own up to one’s own mistakes.

The man may not have read the ToS available, because all the rules and conditions of use of the gambling website are already in place,
so when the man sues DraftKings, then it is ridiculous because the one who plays is himself and he is the one who made all those mistakes.
I don't know what he thinks to use his wedding money to gamble, when everything is lost and there is nothing to blame, the place where he gambles is demanded.
