Did you read your terms after it was generated for you? Take a closer look you would see the minimum odds you are talking about apply from today, which is the 31st of October, and since we can't tell what was there in the past, it is safer to assume that you included that clause after you banned that user. If that is true, it means that your terms don't apply to that user, and you might as well just settle him to avoid drama that might cost your than just $500.
