I ordered from this company and they have a pay with bitcoin feature. I paid the amount of BTC and a few days later after speaking with the customer service rep they are saying they haven't received the money with I can see on the blockchain it has over 500 confirmations. (I'm positive I sent to the right address)

The customer service rep was being pretty shady saying he had no one else he could refer me but himself saying he didn't have a supervisor, and he couldn't communicate with the "financial department".

What do you suppose I do? What can I legally do if they continue to refuse shipping out my order?
I will continue to work this out with the company before taking any big action.

Tricky situation and this is definitely one part of Bitcoin unscrupulous companies or scammers can easily take advantage of. Is the site legit firstly? Have you used it before or found anyone else who has? As for the legal situation I'm not sure but theft is still theft but I've not encountered anybody who has successfully got their bitcoins back from this sort of situation yet.

The issue of consumer protections is the next big innovation space in Bitcoin on the horizon.

Its being discussed at length at Bitcoin conferences, and solutions are being provided which will match existing consumer protections in purchases.

Do you have any screen shots of the payment address they gave you and the amount they want you to send? Email those screen shots to them, may be it can help them identify your order.

Is it worth it to hire a lawyer, even to merely set a precedent?

If the answer is no, then you've just been had by an unscrupulous merchant. Lesson learned, move on.

If the answer is yes, then the charges you could lay against them could be anything from fraud to misappropriation of property.
Of course an actual lawyer will have to advise you on the recommended route.

In the meantime, file a BBB complaint with all the evidence you have. As well as a FTC complaint.
This will encourage the proper officials to step in and arbitrate on your behalf.

Best.

Hey guys thanks for the replies, after attempting to talk this out with them the sales rep is not helpful AT ALL. He keeps telling me to send an email which i have to get no response in 5 days.

I'm more angry at the principle that they have taken my money not that I've lost $200.
***I have filed a BBB and FTC complaint, thank you for informing me of these orgnaizations.

Can I take this to small claims court? If so how would I?
Help is much appreciated.

They're already F-rated with the Better Business Bureau. If they were A-rated, they'd care about your complaint. Unfortunately it will cost you more to file in small claims than $200, and to ensure you collect damages and filing fees, you will need some sort of legal assistance if you're not a lawyer or paralegal. The Federal Trade Commission, as it is government, will not give a crap unless there are a massive amount of customers getting harmed and the company has a big bank account to seize.

Saying that you don't trust someone because of their behavior is completely valid.
