Liberal Law Professor Jonathan Turley: Obama's Executive Amnesty Threat 'Tears at Very Fabric of The Constitution"


As President Obama prepares to issue an executive order effectively legalizing five million illegal immigrants this week, many on the left and the right are issuing their criticisms toward him for violating the process and going at it alone.

On Friday George Washington University Law School professor Jonathan Turley, who describes himself as a liberal, made an appearance on The Kelly File to discuss the issue. He warned that not only is the country at a tipping point, something he warned about in congressional testimony earlier this year, but also expressed his hope that President Obama doesn't get away with it.

"What I'm hearing certainly causes great concern that he will again violate the separation of powers," Turley said. "No president can take on the power of all three branches and that's what he seems to be doing. He certainly seems to be taking on legislative authority. He isn't be particularly coy about this, you know he says 'this is what I wanted to get out of legislation and I'm going to do it on my own' and that does become a government of one."

Turley also cautioned the President against ignoring the results of the 2014 midterm elections by going around Congress on this issue despite frustration of partisan disagreements.

"It's a very sad moment but it's becoming a particularly dangerous moment if the president is going to go forward, particularly after this election to defy the will of Congress yet again. I can understand the frustration, these are two political parties that cannot get along but as you said, we have a Democratic process and a Congress that's coming in with the full voice of the American people behind them, that's what an election is, you may disagree with the outcome, but you have to respect the outcome," Turley continued. "What the President is suggesting is tearing at the very fabric of the constitution. We have a separation of powers that gives us balance and that doesn't protect the branches. It's not there to protect the executive branch or the legislative branch, it's there to protect liberty. It's there to keep any branch from assuming so much control that they become a threat to liberty."

"I always tell my friends on the Democratic side, we will rue the day when we helped create this uber presidency," he said. "What the Democrats are creating is something very very dangerous. They're creating a president who can go at it alone and to go at it alone is something that is a very danger that the framers sought to avoid in our constitution."

Don't blame Congress for the many ways that they don't do their duty and resist Obama. After all, there are a lot of 50 caliber rifles in the country that are in the hands of Obama's cronies. These rifles shoot accurately for a mile, and can be made at times to hit their target at 2 miles. Congress people have families.

Insurrection: Liberal constitutional scholar will represent GOP in lawsuit against Obama


When the Republican-led House voted to sue President Barack Obama in July over what the GOP considered his excessive application of executive authority, particularly in repeatedly delaying the implementation of the Affordable Care Act, it made a big splash. Nearly four months later, however, not much has happened. Some on the left assured themselves that delay was a result of confusion on the part of those who might represent Republicans in court over whether there was a basis to bring this lawsuit.

On Tuesday, however, that narrative changed. House Republicans hired constitutional lawyer and left-leaning scholar Jonathan Turley to represent them in their effort to force the president – a former constitutional scholar himself – to abide by the constraints placed on his power in the nation’s founding document.

“As many on this blog are aware, I have previously testified, written, and litigated in opposition to the rise of executive power and the countervailing decline in congressional power in our tripartite system,” Turley wrote on his blog. “I have also spent years encouraging Congress, under both Democratic and Republican presidents, to more actively defend its authority, including seeking judicial review in separation of powers conflicts.”

“For that reason, it may come as little surprise this morning that I have agreed to represent the United States House of Representatives in its challenge of unilateral, unconstitutional actions taken by the Obama Administration with respect to implementation of the Affordable Care Act (ACA),” he continued. “It is an honor to represent the institution in this historic lawsuit and to work with the talented staff of the House General Counsel’s Office.”

Turley is no conservative. He was a favorite of the liberal media during George W. Bush’s presidency, as he could be consistently counted on to deliver stinging indictments of the president’s conduct. Turley’s decision to prosecute the case against Barack Obama, a president for whom he twice voted, carries with it no less moral authority than did John Adams’s decision to stand in defense of those British soldiers responsible for the Boston Massacre. Turley’s action demonstrates that noble principle can still triumph over tribal political concerns.

This development should have the effect of reaffirming the right’s waning confidence in America’s constitutional tradition. There are still men of good faith and intellectual honesty who are capable of putting aside their partisan political preferences in service to the preservation of the republic.

Saying that you don't trust someone because of their behavior is completely valid.

In an environment where good guys are hard to find, I always felt that Turley was among the most likely to be one of them.
