There is zero use trying to convict him cause you cannot prove he received Bitcoins from you. You can prove a transaction exists and that you have the private key for the origin. You cannot prove he controls the destination address.
So may be stop this discussion? All I'm asking (besides the return of my funds) is communication, which I am clearly not getting. I just see he is sending money out and no Bitcoins hitting my wallet.
How can I not prove that he received Bitcoins from me? If you log on into his website, he has the status of a deposit change when he actually receives the coins.

I wouldn't sell any of my personal assets to cover any bitcoin losses. This is a business, it has failed. When businesses fail they shut down and usually nobody gets anything. I will continue to make payments from my bitcoin production and buy coins whenever I can. If people continue at act they way they are acting I will just walk away.
I would like to add in the above post by Hashking. As he states that it was a business, it should be filed for taxes. And as with sole proprietorships, I expect that he will be filling for a business loss on taxes and using that money for part of the "insurance". I do believe that his threatening to walk away speaks greatly about what he has done, though.

Knowing how NAV works, I would expect that values in the market will return to normal in a month or two, once the fiasco has ended.

As of a few days ago, HashKing wrote that he would be closing down his services, not offering the interest on his 8-week lock-in deposits which were locked into a set rate and deposit schedule, and that he would be paying back people's coins over the next three years or more. The issue here is that his accounts: A. Are insured, and he is providing no insurance B. The 1% accounts were supposed to have no funds with Pirate, yet he lost the majority of investors funds there, as well as using investor's funds to buy mining equipment so they were illiquid. C. He stated that "Deposits could be returned at anytime." - Could being the past tense of can, which they clearly cannot. Looks like he's hoping to misdirect the attention and shift the blame to others, the PPT OPs aren't to blame here, he is. He had absolutely no problem taking money from payb.tc, goat, and others, but now he has a problem with giving them back?

1) payb.tc - this is an extremely serious matter at this point. The first of many deadlines, dates, and "just wait" periods have expired. I want to know the total BTC owed to your accounts. I do not want to know any individual information, and debating me on your exact number of accounts is childish and arbitrary. 373, 367, 400 or 350 is about the same, and judging from the people looking to sell their accounts there were a handful of large holdings. I feel we should know how much in total to better gauge the scale of what Pirate would have to be holding in order to make the orderly return of funds as promised. This is very important information at this stage and can help manage the expectations of your clients. Just a total BTC owed to BitcoinMax from Pirate is the number that I think many in this thread, pro or against, would like to know and the total number doesn't violate any client's privacy.
2) If you are owed ~ 50k BTC from Pirateat40 then it can be theorized that BurtW has a similar sized operation with the pass-through bonds. I recently heard today of other large individual investors that did business directly with Pirate. This is adding up to a large amount, and knowing exact figures would put more into perspective what was already paid out in interest and what is currently owed back as principle.
3) Best guess Pirate Debt right now is ~ $2.4M USD - this is only a guess of course, I know numbers like 500k BTC / ~ $5M USD have been tossed around and that's certainly possible but I think Pirate likes to exaggerate a bit. I further wouldn't be surprised if he owes ~ $800k USD and is claiming $5M - but the point here is that Pirate has the largest BTC debt ever owed - and by a very large margin.

Now it's not just me, but your customers that want to know. This information is extremely relevant to this matter at this exact time, no matter which side you are on. I actually don't want to know.
