Sadly, I want nothing to do with no MPP. I want a total refund.

What do we want?

A total refund!

When do we want it?

Uhm, well, now would be great!

Right now all we've got going for us is a Total Recall

ok that was a bad pun.

403  Economy / Scam Accusations / Re: AMT users thread. on: June 15, 2014, 09:40:03 PM
I know you're goofing phin, but it's not defamation if it's true. http://www.nolo.com/legal-encyclopedia/defamation-law-made-simple-29718.html

So it's really just a statement. One I've not seen refuted by the way. So unless they are lying about the check they have no grounds to sue for defamation.

IMET on the other hand could sue if it was not their manufacturing process that cause the issue with the boards since AMT has openly blamed them. And this could obviously injure them financially.

404  Economy / Scam Accusations / Re: AMT users thread. on: June 15, 2014, 07:21:04 PM
That is a really good idea. IMET needs to explain everything in as many details as possible to this community.
-How many boards were actually ordered and when were they ordered!
-How much money did AMT really spend!?
-What production was actually accomplished and how many boards did AMT ship out and how many do they have now, and are those  boards even working!?
-Did AMT ship from IMET's facility!? OR IS AMT STILL LYING ABOUT EVERYTHING!
-Did AMT put any effort into it all or did they just hand over the project like.. here ya go, build us miners.

AMT customers need to know these things! And if IMET thinks they have a chance in hell at selling miners to this community without being upfront about this specific situation right now, we'll I wish them the best of luck. IMET NEEDS TO GIVE US THE FACTS! OR ITS ALL JUST BULLSHIT AND MAYBE IMET IS STILL WORKING WITH AMT!

IMET has yet to answer the above questions, they've just demonstrated 1 working miner. AMT already said that some of the boards worked but most of them didn't, and for all we know IMET could have been working on those boards for 2 months, and why now all of a sudden do they have a working miner?  Because some client went to see them? If you ask me. AMT is trying to sell through IMET because IMET is actually not stating facts about their situation with AMT. The old bait and switch, pretend like you hate them and they skimped out on their check, and oh by the way here are some of AMT's miners for sale.

COME on guys really!

I am petty sure that most of these questions have been answered in one way or another throughout this forum.  This is not a bait and switch.  My intentions were to address the accusations against IMET and to try to get paid by AMT for services that were rendered.

Guesses from members like frictionlesscoin don't count as answers. Only IMET or AMT can give those answer and neither of you have given them. We've asked AMT, and they have trickled around the subject like the usual.

IMET is under no obligation to share the details of the contract that was signed with AMT. In fact by doing so it could find itself in legal trouble depending on what the contract says specifically.

Though I did give them a call when I deduced they were the manufactures from the geotagged data in the back plane picture. It was at a time when we were all really wondering what the fuck was up, and if there were boards being actively produce of if it was a single prototype. I just asked a question or two, but they said they couldn't say for sure and would pass the info up to their boss, but that I might not get a call back for obvious reasons. So I tanked them and then the next thing I heard from them was in here.

AMT_Miners,

As you suggested before from your post, please advise how you can refund me with 2 my miners.

Please response to my email.

Thank you,
Tony

AMT_Miners,

Can you response to my email for refund option? I need this money as i indicated in my email my situation. hope you can understand.
Thanks,

Tony

Yes someone will get back to you soon. If you've already emailed several times and no one has responded that is most likely because we currently do not know the answer until our legal matters dealt with. Technically everyone is in class, even you. You can thank Mr. Lenell for that one.

That is not true, the judge still needs to approve the class action classification for the suit.

Also, only those who can claim damages (like almost every AMT customer) can be in the suit.  So if you get delivered something with satisfaction, then obviously you can't be part of the suit.

Not true, if you read the complaint again I am pretty sure it says things about miners not arriving or arriving late and or not not receiving refunds.

Intro section A. #3 #5 section F. heading: Defendants’ Failure to Deliver Purchased Bitcoin Miners and/or Rightfully Issue
Refunds.
#81 section: CLASS ALLEGATIONS #84-88

If you deliver non-working bitcoin miners.... if you deliver a paper weight.... is that to be considered delivery?

If you requested a refund and not given a refund.  The seller is obligated to provide a refund if they don't deliver as promised.

Doesn't matter if they delivered a fully functioning machine if it was delivered late. One of the grounds of the complaint is because the nature of bitcoin receiving a late miner means you were damaged. Obviously this is what would be argued, for and  against, in court among many other things.

If it was delivered and didn't work it was under a manufacturer warranty, there was no repair offer for months after the broken units shipped. So it would likely be looked at as a breach of contract. At least I would think

Where the hell is biomech? His wife is a lawyer.

Yeah and the refund thing seems pretty cut and dry. I don't know that it will go to trial. AMTs best bet during this time was take stock of everything they have in the way of assets. Present that to the lawyers for the 16th and offer to settle based on their currently held assets. If this goes to trial and they find there was a piercing of the corporate veil then they are pretty damn screwed. I'd be making that settlement even if it would be a meager one. Then it's on craigs legal team to decide to accept.

I just know that if I were named as a plaintiff in that suit, I'd do everything in my power to settle. Especially if I was looking to run a company again in the future.
406  Economy / Scam Accusations / Re: AMT users thread. on: June 14, 2014, 01:09:35 PM

The customer came in with a half built unit with 5 hash boards installed.  He received the unit earlier in the day (just about 4 weeks ago or so) and brought it to IMET.  We did not try to power the unit. Instead, we took it all apart and tested one hash board at a time.  2 of the 5 hash boards received worked.  I showed the customer how to test hash boards and gave him a rack of hash boards right from our stock that were never delivered to AMT.  He went through the whole rack and saw 100% yield.  I gave him 3 working hash boards, and we spent 3 weeks working the pieces of the design that were flawed.  We never laid a soldering iron on the PCBs.  They worked fine out of the gate.

In the 3 weeks that we were working on the system, there were no problems with the electronics.  That particular unit has much more than 4 days on it.  At this point, I suspect, it has closer to 10 days as we were running prior to making it available online.  I have a machine shop making parts for us now as we are duplicating to get the rest of what we have here running.  Unfortunately, it is not much.  My hope is that AMT will come through with payment.  If not, I'll see what I can whittle away from their bill using other means.

Could you explain in some more details of what this customer needed to do to fix the flaws in the design?

Are these software fixes?
Are these how the heat sinks are mounted on the board?

I am not sure how to handle this, and I am looking for suggestions.  All I ever wanted was for AMT to pay for services rendered.  I thought that doing this work would create that effect, but based on AMT feedback, this is not likely.  I have put my time and thousands more into the project to get to this point.  I know that the AMT customer I worked with is happy at this point (the unit you see is mining into his wallet), but just like everyone else, I want to be whole.  We are pushing 30 employees that need to get paid on a bi-weekly basis.  I am afraid that if I just release the design, then I will never be made whole.  I am looking for any and all suggestions.

I am definitely a bit confused here.  I had thought that there were no changes on the PCB,  so the only possible changes are software fixes or changes in how the heat sink was mounted.

Anyway,  based on our records, only 11 miners were shipped.   As I understand, IMET shipped around 300 boards, equivalent to 60 miners.  The whereabouts of those remaining miners is unknown at this point and is anybody's guess as to weather these are used for mining or not.  So I am not sure who would benefit from this new information.

I can confirm that there are no changes to the PCBs.  I also do not know what AMT shipped.  I do know that AMT has the bulk of the boards in their possession.  With the work that I have done, they could put together units that work and would last.  As mentioned, I would need to be made whole by AMT to share the info with AMT but I don't think that AMT is interested based on our last communication.

I think what I want to know is, since you are interested in the bitcoin business and since it appears miners are being made by you based on the bitmine design, will you be designing your own miners?

You have the technical know how, you'd just need to source chips and away you go assembling even if you went with some cheaper chips using a larger die.

I would be interested in possibly purchasing an IMET branded miner.

The thing is I ordered it 6 months ago from AMT, and I got this just today. I was supposed to get an AMT miner and not a miner from another company. P.S. They are listed as an Authorized Distributor on http://bitmine.ch/authorized-distributors/ , maybe they just decided to start shipping these instead.

Yes

Gintas, ordered an AMT time, AMT miners and Bitmine miners are pretty much the same accept for the exterior and some other things. Gintas can close that miner up to a 1200 if he gets a larger a supply for sure. Also Gintas ordered a 520ghs and was upgraded %100.  Gintas was patient, understanding, always polite and generally nice about he whole delay thing.

We could have lost another week and shipped the Antec cases over but we figured at this point it didnt matter much anyway because most people want a miner. These got held up in BG customs anyway for two weeks so it didnt matter also.

Furthermore, all backlogged European ordered miners have been delivered.

Ah, very good of you keeping your promise of the MPP. I'm sure he was delighted to receive a system that far more powerful than his order.

And good to hear about the clearing out of the backlog of european orders. I know you were trying to keep the american portion of the business as American made as possible, but glad that when push comes to shove you're doing what's right. I look forward to seeing more people popping ( I nearly put pooping, that would have been wrong) on to show us their delivered orders.

Thanks for the supportive post curt. Just a heads up we dont know if we'll be able to provide such an extensive upgrade on American orders due to the shier amount of them. But we will try and do our best to do so. There is only so much money we actually took in aside from what we invested in the company ourselves. All of it, plus a new line of credit will go to filling everyone's remaining orders.

We have moved manufacturing operations to china some time ago, and units should be done very shortly. We'll be shipping direct from there to clients to make things easier/faster. Some batches are currently done, they are just waiting on an AMT staff member to get over and to test each unit individually prior to shipping. DHL offers two days shipping, so we dont want to loose more time on shipping in and then reshipping.

Not a problem. I'm not afraid to call someone out on things they've messed up, but on the other hand there isn't any reason not to recognize the good work that same person does.

It's never been personal, just business. I'm glad to see things coming along there were times when I honestly wasn't sure what was going to happen. But progress is good and I'm happy to see you guys get back on track.

Great post Zeta!  You really sold us on MAT.  Thank God you posted a pic of the internals and a CGminer reading....oh, you didn't?

Useless.

But they have desks.....

The ravenous peanut gallery for whatever reason moved to a new shiny target? Say, Minertechnologies?
One can almost see the foaming drool dripping from their hideous maw and nearly topple over from the stench of their fetid breath as they circle their prey...

Ah, yes especially if they believe this is a new outfit for Josh.

Sent my miner back.

If I decided to go through with receiving the miner, would that be quicker than a refund? At this point, I just want to get something out of this situation. How long would either option take? Assuming it would actually happen, that is.

WHo's been giving you the option of a refund? Perhaps you were just having a fever dream.

How would you know they are doing a good job?   All the video shows is some box with some display that says that it is mining.  Who knows what's underneath the hood.

Sorry for getting in to this thread, but since we were mentioned by topic OP, I guess its okay. This particular mining box will be sent to dogie and its marked with guarantee sticker. Will make some more videos soon.

Good job guys.

You're welcome over anytime. Keep up the good work and we're excited to see what your capable of.

Talking to yourself is not a good sign.

Signs of madness could bring some creativity, who knows.

Or the men with butterfly nets and white coats.

It's getting there. Curt, you should chat with us in skype, we're bouncing ideas off each other group chat. Your expertise in specific area's is actually quite impressive, definitely in the top 10 most interesting AMT clients list. You may find some of the dialog regarding new directions interesting.  Send us your skype if you want.

That expertise was definitely not mine, but glad to see another curt shaffer going out there and getting it done. He could take some public speaking lessons though.

That said, I'm still going to count myself as one of the top most interesting amt clients. If for no other reason that I don't know of any other amt client who worked at the jerry springer show.

Good god thats a wall of text.
420  Bitcoin / Hardware / Re: New Official AMT Thread on: June 10, 2014, 09:49:09 AM
My name is Michael and i have an order with AMT for 2 1.2Th/s units.
These units were purchased in November 2013. My order number is 596. Over this period i have sent ungodly amounts of emails to AMT. The most recent 2 weeks ago i was told they would reply to me the next day. This is after promising me delivery multiple times until just giving up on communication altogether several months ago. I would appreciate a public update on this situation. Why are you recalling and reissuing items that are faulty when you have orders that have not been filled at all. Would you publicly state when my order is set to deliver or when a refund will be in my account. The lawyers are awfully interested.

Welcome to the misery pit. It looks as if, and this is complete speculation on my part( I don't want my thoughts taken as facts since I have a lack of evidence),that those who received hardware are those who forced the hand of AMT by filing with various regulatory agencies. It appears these units were sent out despiste know system flaws, with the hopes that they were sending out the stock that would actually perform while supplying the agencies with proof of shipment of goods, giving the appearance of a good faith effort to deliver hardware.

If you filed no complaint then no agency was tracking your issue, then you got no hardware. Again these are my thoughts not facts.

If that was the case it was a calculated move on the part of AMT as there were production issues that meant there was no way that delivery was going to be on time for the majority of orders. Some might not call it the morally right move to make, but it was the smart one. Think of it a rowboat with holes it, each hole is a regulatory complaint and miners they sent out were the corks to stop the leaks. It was a stop gap measure plain and simple. This was a way to keep them afloat so they at least had a chance to weather the storm. If not they would have sank before the storm even rolled in.

So here we are, a lawsuit has been filed and we are all part of it, except for those with no "skin in the game" as people keep saying. Tangentially speaking I could give two shits who you are and what you want to post or for what reasons, you won't find me trying to stop you, bury them with the dirt from the hole they dug for themselves, because it's not going to change the outcome at this point. Anyway, the lawsuit is filed and now it's a waiting game. Do they settle ? Do they go to trial? It's a trial by jury so you are only going to have people who really know nothing about Bitcoin. Are they going to understand the pressing nature of the hardware and the timeliness of its delivery? You know there is going to be a grandma who doesn't know what a computer is. You'll have a few people who have dells from 1998 who only have it for "the emails" and a maybe a smattering of tech savvy individuals on the jury. Do you really think they are going to understand the damages suffered in the case? I'm not too confident.

I'd prefer the settlement route. I'll have my new(er) miner from amt hashing away making way less than it should be, but something is honestly better than nothing. Maybe I get some cash from the settlement. Maybe it's enough to buy another miner from another company. AMT said my MPP period has started as of when the hardware shipped (the 4th or 7th of April) so if I haven't mined enough by october 4th to be profitable (which isn't likely barring a large increase in the price of bitcoin) then I'll contact them for their next most powerful miner that could reach profitability (provided they are still operating). Or if they so chose and this is completely their choice they send me enough hashing power now to ensure that I make a profit on my purchase and then they are done with me.

The fact is all of those things are out of my hands. It's why you don't really see me whining about it to much. I know when I've been got, and right now I've been got. It sucks as I'm a disabled vet going through some financial and medical woes at the moment (unrelated to the AMT thing that money came from a completely separate source specifically for mining) so I kind of have more pressing matters to worry about than just this. (It also explains why I have so much time to just sit and watch the forum)

Well I'm going to go ahead and look up my local fedex kinkos and see who is open 24 hours. I'm going to put this bad boy all back together, with the exception the heat sink that fell off. I wish two would have came off then I could have kept them and made a set of cuff links. The camera is coming with me. I'll have pictures of the miner as I packaged it and exactly how left it in the hands of the fedex people ( I'll actually include copies in the return box for AMTs benefit) Then off this goes and hopefully within a week or so I'll have another miner.
