Contracts don't have to be in writing to be enforceable with the exception of a conveyance of land. The only thing that matters is the actions of the parties and their reasonable expectations.

For anyone that thinks bitcoins aren't  currency they are out of it. Anything is currency as long as it has value.
What do the call it ? A good and valuable consideration that would support a simple contract. Even a promise is in this category.
A bitcoin has intrinsic value. It gives  the right to a non-reversible secure transaction. Many people think that is valuable.

This is the reason why i said there needs to be a "legal" sub-forum. There are many issues to iron out amongst bitcoin users.
I would say people are very ignorant about money and it's laws.

Such as the difference between paying a debt and discharging one.

Kevin has thought an awful lot about what the hacker might do and what his motives are and techniques he would use to cheat the system. On top of that he considered them all as a tool himself?!?!?! If that's not a red flag I don't know what is.

Secondly he admits knowing about a security flaw but he doesn't tell Mtgox staff but he tries to lead us to believe they have such a close and cosy relationship there is no way he would do this.

I call BS.

Somone cheated, Kevin, so do the right thing and man up. Honor before glory.

I only registered to MTGOX on Tuesday and my password was iamdana1qaz0p;/ so I think I'm safe.

Maybe a tax section. In the US, tax is on income from whatever source derived. It even applies to citizens working overseas. That's why you have to expatriate to avoid income taxes.

There should be a whole section dedicated to the legal  implications of bitcoin. Otherwise they are always going to be discounted for risk. If you can't enforce a transaction in court then there is no point.

Hmmm... I actually have the source code to what used to be a commercial poker site and it's client.   Would be interesting to set it up, but I am sure the servers at least would need to be located outside of the US.

That is much easier than you might imagine.

However I understand that most of the unlawful stuff is done in some place like Germany or the US, but all access to the site is via proxies in remote parts of the world which use a VPN to talk to the main server.

For an example that won't get you sent to jail just for asking: Google (or better yet Duck Duck GO) the term FOSI and follow the link to the site. FOSI has been offering downloads of unlawfully copied software since at least 1990 (when I first found them). They have never been down for more than an hour despite all the DMCA fuss!

Setting up an unlawful site is not hard, but your DO need someone competent that you can trust to set things up - it is the dumb mistakes that kill you!

I think you mean illegal. There is no such thing as an "unlawful" copyright violation because copyright is a creation of statute not of natural right. Copyright doesn't even exist at common law. In fact copyright didn't even really exist till the player piano was invented.
