excellent. Sent out the PM earlier and I've already got to people to file a FTC complaint lets keep it up.
I should note my received  order was burning and completely unsafe. I RMAed my product then after a while I received a unit without a power supply that had a couple non working boards and hashed nowhere near even the 10% variance after I supplied my own power sources. I made complaints to them that went ignored my guess is that most of you didn't even get this much form them. I can be a squeaky wheel, and a quite loud one at that.

I'm going to try to contact people on this list see if I can't get name and phone numbers so we can better coordinate. And make your you are all putting in FTC claims.

I think my favorite is that Jim Brown is "fictional person" to protect company employees. That is fine but you don't give the Fictional Person the title of Sales Manager which they then use as the signature of their e-mail. I'll be happy to provide that e-mail to the attorney's on the case

Zipkin's Lawyers quit his case becuse he said he wouldn't pay them. He's yet to get new lawyers and the judge gave him an extension until the the 10th of april.

yep, this saga continues. i wish i could say joshua zipkin came to his senses and ceased defrauding folks of hard earned money but... you know joshua zipkin and you know AMT miners. he's a complete scum bag. he lacks any understanding of how to conduct a legitimate business. this roller coaster ride will continue all through out next year. so long as i make zipkin pay for his legal defense i will continue to smile and fight this asshole until the end.

Regardless the dismissal of even looking at the sales records is pretty much a legal fuck you to Joshua Zipkin sole shareholder of Advanced Mining Technologies. This pretty much is headed for certification. I guess the next question is when is the next big date for this to happen.

The Judge Actually is saying that we are a CLASS and that the amount is well within the amount stated previously. It is beyond prudence to say it is a CLASS now. Read the article from the 12th of December on Google.

Craig Lenell vs Advanced Mining      - Google Search Terms.

We a putative class but not a certified class yet.

In a footnote in the order denying the dismissal the court says, "We will not parse the issue of class certification at this time because the question of whether a
class is ultimately certifiable is premature when evaluating a motion to dismiss."


But this is a step in the right direction.

The best part is that the judge doesn't dismiss their sales records so much as he says I see the records you've provided and your records specifically show they have a case.

It's as if they presented evidence on behalf of the plaintiff.

If anyone want's I'll be happy to split a room in Philly during the trial portion of this lawsuit, we can have cheese steaks and laugh over their demise. This is the frist time I expect to see zipkin back in US. It's also good we have him and "Jim Brown" as named defendants, because if it's proven they commingled business and personal funds we're going to take everything they own.

I'd be very surprised to see Josh show up in court. He's got the cash from not sending people miners. He'll just pay his lawyers to sit in court for him.

I'm hoping the court can compel him to attend.

I think what really speaks volumes is that after months of  lack of communication he posted and back dated news stories on the site to give the impression that he was communicating all along. This speaks to the willfulness of the acts. Plus he did it shoddily and didn't erase the exif data that showed that he fudged the dates. This will go a long way to proving fraud.

The photos above are from a Bitcoin conference. Why would someone that set out to have a scammer business and do nothing more than fleece people waste tons of money attending a confrence who's only attendees are other businesses that are never likely to buy his product? Attending a conference makes no sense.

Did Pirate@40 ever have a booth at a conference? No, he met the other members of his theft cartel alone in Las Vegas. 

I think his idea was he was going to set up farms. Of course what he didn't take into account was that he has no technical skill, a substandard product, and a reputation that could sink any business dealing with clients capable of using Google.

I think there was an obvious initial thought that he would sell to individuals, produce a good product, and work his way into larger corporate deals. When he realized that would take some actual work and that things might not be going with his fantasy plan he cut off communication with customers even though he knew at that point he couldn't deliver. At that point it became negligence for not letting his customer base know what was going on. That led to fraud as he continued to make specific claims of shipping dates that he had to know couldn't be honored.

As I understand it there are still customers who haven't received their miners. There  are instances like mine where they received incomplete products after great delay. I've not seen anything posted where the delivered miners are working with in the advertised specs.

I love that he said he didn't come to the Vegas conference because of lack of money but he has no problem showing up at conferences in other countries.

It's ok, he'll have to show up for the court proceedings. He's probably scared shitless. I know I would be if I were in this position.

So just so I'm positive what I'm seeing there, he tells Curt, full disclosure I'm Curt, that in no uncertain terms his power supply is on it's way.

It's now four months later and I've yet to receive my power supply. I guess I should just leave it alone since I know where they are at.

This is going to be hilarious as it picks up steam. AMT out did BFL with their banner clamming when the product would ship by rather than just estimated dates.

I'm still hopping to be deposed by the plaintiff's attorneys. I'd love to tell them about everything that was said by josh in our Skype chat. And that even after he claims to have mailed me a power supply it never showed.

Also it looks like the class action has another lawyer joining the team.

Looks like the Judge agrees that if the jury applies punitive damages (which it could) that it could easily surpass the $5mm dollar rule based on the defendant's submitted order log. The plaintiffs assert that the logs that were submitted we not complete.

I'll look more into what is needed to certify a class. If anyone wants to reach out to the lawyers hanging around the BFL thread maybe we can get their opinions on some things.
