What do you exactly mean by ``something that hasn't happened''? Our funds have been held by Ukyo for at least a month and it is not clear that we are getting anything back. Even if we get everything, there will be no compensation for lost opportunities. This much has happened.

All you actually know is we can't access our funds and we'd been told of technical problems. Since then, we've been told that external help is involved. Everything else is conjecture. I understand the conjecture totally, but it isn't fact so shouldn't be reported as such.

It isn't necessarily about more information and Danny will talk to individuals too. It's about having someone who understands how the legal system works; who can give proper advice; who will judge the situation correctly and without bias.

Can we see the addresses holding our funds so we know they haven't moved?

Publishing those addresses and signing to demonstrate control would be a huge help in battling the 'fractional reserve' and 'lost our BTC to LabScam' rumors.

Sorry - didn't mean to upset anyone. The fact is that we ordered more products from them and I just wanted to find out if we had been included in the "first customers" notification that BFL Josh "said" went out.  Just as an indication of whether we made it in the bullet run or not..

Just to update everyone on where we stand with the Monarch at the moment.

Current chip production has an expected delivery date in early/first half of December. We expect to have chips at that time and hope to have our first units shipped out the door by the end of December. We did not reach our goal of November delivery. Unlike our first generation ASIC devices, we already have the vendors in place and ready to go, along with the substrate design and manufacturing slotted in and geared up. Right now, we are not anticipating any issues but unexpected things do pop up. If they do, I will let people know as soon as I have definitive information regarding that, otherwise we are on target for a December release. If anything changes, I will let everyone know, via this thread, as soon as I have the information.

Let me reiterate that if you are uncomfortable with pre-ordering for cutting edge, custom designed technology and all the risks that it implies, please do not place a pre-order and wait until the products are shipping and available. If you do choose to pre-order, please understand that unforseen problems and delays can and do happen and we will do our best to alert everyone to them when we encounter them and have had time to assess what the impact will be on the timeline.

Our production capacity is geared up and ready to go. With the extreme simplicity of the Monarch compared to our 65nm product line, we do not anticipate any difficulties in getting units built and out the door in a rapid fashion. Compared to our current generation, assuming no parts shortages, we should be able to product more than 1000 Monarchs per day. For reference, the Monarch should use ~12 screws and two discrete parts (board and HSF), compared to even our most simple device, the Jalapeno, which has over 20 discrete parts, assembly is trivial and should pose no issues.

Crumbs, iCE and Pankkake. I think it's time to wind down this thread, you guys won and we have lost our investment.

The following factors lead me to believe that ActiveMining is probably over:

- Our competitors sold more hardware in one day than we have ever "sold*".
- *Well we have never shipped anything with our own chip anyway.
- We are now waiting on a physics defying program that makes mining machines faster as the global hashrate increases. This makes no sense and English is Ken's first language so he has no excuse for that Intellihash rubbish.
- We are mining 2 TH/s into December.
- I know believe the extra 1TH/s came from cex.io or a undisclosed Klondike/Avalon miner.
- Ken was very confident he would be able to ship 100TH/s+ by the end of November, it's now December and our hashrate is stale.
- Ken is being more quiet than ever, his focus is on refuting trolls, the real investors are no longer are a concern.

I am not sure what I am going to do, I have a project with a friend that could be profitable in fiat, if so I might be able to resume buying Bitcoins before they hit $10,000 a coin.

This experience has been soul crushing and the reality of my loss has not hit me yet. All I know is that I am in for the worst Christmas of my life.

I only have myself to blame, I am disappointed in myself for making the decisions I made and investing most of my holding into a single company was my undoing. I hope that the hurt and pain from this prevents me from making similar mistakes in the future.

The loyalty here is both insane and totally unjustified.

I've written off this investment as a loss.  If Ken proves otherwise great, but I'm not going to blindly cheer when all we have seen is promises, vague timelines, and no proof whatsoever of claims.

No different than Labcoin in my opinion and could possibly turn out bad legally for Ken.  Silence to shareholders is not very smart.  Putting out fluff press releases with no real substance or proof is still silence in my opinion.

Thank you for your timely admissions of defeat and incompetence.  It's difficult to man up and confess to being completely and totally wrong.

I do not want a machine that will not bring back its initial investment, built fast to get out the door before 12/31 and will more than likely be defective. With their ambiguous dates and false sense of security via their elusive MPP they have duped all batch 1 customers. I have requested a refund several time (last one on 11/26) and they took a week to carbon copy the BS they tell everyone: "no refund, sell your machine…"

So you would rather they refund your original BabyJet purchase price of $5,600 so they can turn around and sell it for $10,000+ to someone else?  I am not sure what you are trying to accomplish here.  FTC rule did not specify they need to give refund in Bitcoins, so if you push them hard enough, they will simply refund your $5,600 per BabyJet.  They are correct in saying it is better if you just sell it yourself and pocket the "profit".


I paid in BTC and will be refunded in BTC (40 BTC). This has been discussed in this thread before, we're not just talking about a bad investment of $5,600 in a company that looked legit. I'm talking about an incredibly bad financial move based on ambiguous communication and a false sense of security (MPP) from a company. They calculated the 20-30 october date to take customers away from BFL, Cointerra… and wrapped the product with the MPP to sound legit and safe. They lured all of us in with a bait and switch. This is a fraudulent practice because they knew they never intended to ship on October 20-30. I could not have predicted how irreverent HF would act towards its batch 1 customers. Each violation is $16K; I don't care for selling the machine at $10k or keeping it as it will never bring back 40BTC (that will be worst way more soon).

Your Bitcoins were exchanged for USD by a third party (BitPay) the second you used them to pay for your BabyJet.

HashFast never touched, much less held, your Bitcoins.  They only received their equivalent in USD at the time you placed your order.

Your Coinlab precedent does not apply and you suck at internet lawyering.

We accept signed messages as proof of share ownership exclusively.

You're free to use any email address of your choosing, as long as it's linked to a Google account (currently the only OpenID provider icedrill.io supports). It does not need to be a gmail email address, or even the one you used @ bitfunder.

All other securities moving to direct shares accept a signed address as proof of ownership.

No other security moving to direct shares requires adhesion to Google's (illegal) ToS.

If a shareholder neglected to change their Bitfunder address in the 30+ days they had to do so that's their problem, NOT YOURS OR MINE.

It's not your place to force unwilling shareholders to jump through asinine hoops like MANDATORY GOOGLE.

A MANDATORY GOOGLE provision was never in the IceDrill contract and you have no right to suddenly require it.

Forcing people to do something they never agreed to, on pain of losing the money the trusted you with, is called EXTORTION.

All of the overblown talk about 'black holes' and 'reinventing the security wheel' is a sorry excuse to avoid using 2FA instead of OpenID.

Samantha Owusu that is writing their TOS and can't spell cancellation correctly has not been taking into consideration FTC rules that prevail above the amateur HF TOS.

Hashfast violations of FTC rules
(keep in mind that monetary civil penalties are up to $16,000 per violation)

1. Misleading shipping dates on the product page.
The baby jet batch 1 showed delivery date of 20-30 october on your product page on hahshfast.com and was relied by other media that promoted HF items. It does not matter if HF terms of sale state otherwise, the fact is that HF page was misleading and FTC rules stipulate that "Whether you make a shipment representation or rely on the 30-day rule, your advertising should be unambiguous about when you will ship". This is a 2 months discrepancy and for normal product this is already unacceptable but for the BTC market, where mining hardware is an arm race, this is suicidal. $16K
 
2. Terms of sale and a purchase order is a sales contract between a customer and a merchant. Changing terms of sale should have been notify directly to me and as for a contract each party has to consent to the new terms of the contract or it becomes null and void. $16K

3. Before the product is shipped, according to the FTC rule the customer has all the right to cancel the order no matter if HF wrote on their TOS that they do not accept refund or cancellation as the US LAW prevail before HF TOS and rule. So as stated by FTC "You must cancel an order and provide a prompt refund when:
the customer exercises any option to cancel before you ship the merchandise.
" It is the company duty to take this into consideration this risk while manufacturing a product. $16K

4. Changing item specs from 350W to 400W. $16K

 "If, after taking the customer’s order, you learn that you cannot ship within the time you stated or within 30 days, you must seek the customer’s consent to the delayed shipment."

The FTC investigates fraud and eliminate unfair business practices. As I filed a complain with them regarding HF company, they will be investigating further points, my list above is non exhaustive.

This is why you should comply with the FTC regulations:
Merchants who violate the Rule can be sued by the FTC for injunctive relief, monetary civil penalties of up to $16,000 per violation (any time during the five years preceding the filing of the complaint), and consumer redress (any time during the three years preceding the filing of the complaint). When the mails are involved, the Postal Service also has authority to take action for problems such as non-delivery. State law enforcement agencies can take action for violating state consumer protection laws.

I'm working with my uncle based in SF (former Senior VP of Charles Schwab) to send their lawyers this week to the Nextspace office where HF is now located (to look good on their video). A class action and full media attention will certainly motivate these lawyers. MP if you are also interested by this class action.

Any project of this size should have security audits done by professionals who can be fired/sued for negligence.

Security professionals do not take on that liability. There is no such thing as 100% security and contracts are drawn up to reflect that. That said, it is proper due diligence for a decent sized company to hire external security people to assess a company's code, network, policies and procedures.

Security firms can most certainly be (and often are) sued for malpractice/negligence/incompetence.

Because of this liability, they pay a lot of money to insurance companies for coverage.

The lack of 2FA and offline (actually cold) cold wallets are their two most glaring fuck-ups.

Hmm when looking for photos I ran into some old CPU before they started using integrated heat spreaders.



Looks kinda similar so I guess it is just the partially package die without substrate and package lid.  So 4 of those sitting on substrate and covered with metal lid would be the final "chip".

So based on this, we'll be able to use the pencil trick to unlock our Golden Nonces?  Awesome!   Cool
