I wonder how many cases pass this threshold and go to a settlement versus cases that go to trial?  I'm curious what they are pushing for(trial or settlement)?  I mean, it may be in Fraser's best interest to admit no guilt and settle for a million dollars.  I assume he has over 10 million?  I tried to assess his net worth, but it is not obvious.  Maybe someone has done some better digging on his wealth?

He's a vice-chairman (or used to be anyway) of a major Wall St bank... he should be north of $100m unless he's very fond of hookers and blow.

I don't have specific numbers but for example this prospectus shows Fraser selling 0.5 million shares of BGC and keeping another 1 million shares. Price at the time of sale ~$10 each, today ~$16.
https://www.sec.gov/Archives/edgar/data/1094831/000119312511225937/d424b3.htm
So we are talking $15-25 million just in this one investment.

Also there are SEC filings showing millions of dollars in bonuses to CF execs, although I couldn't find one with Fraser's name in it.

And yes, settling would be wise for everyone involved. It's cheaper and I'm sure neither Fraser nor CF want lawyers digging through their dirty laundry.
I was surprised his home is pretty modest in Armonk. Somewhere around 3.5 million.

I figured someone would chime in that knew the exact answer.   I suppose if you have upwards of 10 million dollars it is possible you could trade on margin.  Not much information out there on him.  I guess what baffles me the most is this "Threshold" for a fraud case has been met.  Another "Threshold" for whether or not he was in control has been met at least to investigate this case further.  I know it is a civil case, but I wonder why there are no criminal charges?

Anyways, heres a link if anyone is curious.  From what I am reading Fraser is SOOOOO Fucked!

Here are a few nice quotes:

"The test of whether an individual is a controlling person for the purposes of § 20(a) is not a categorical one that turns solely on the individual’s status as an officer or director. Rather, the inquiry is a functional one, as SEC regulations indicate.”

"Thus, control is adequately pled when there are factual allegations that “support a reasonable inference that defendants had the potential power to influence and direct the activities of the primary violator.”

Here is the biggest quote so far: The amended complaint plausibly pleads that Fraser controlled the Companies and Garza. It does so first by alleging that Fraser owned half of the equity in each of the Companies a well recognized indicator of control.

In other words Fraser was absolutely in control.

Sweet.  Stuart Fraser's Motion to Dismiss DENIED!

The GAWSuit Lives!

https://www.pacerpro.com/cases/2922067

Have to give Allen Shinners props for his work helping the Feds nail Garza & Fraser & for getting this far in his GAWsuit.

He's going to collect victim statements for the judge.  I forget how big, but I think the number of plaintiffs his GAWsuit represents is in the hundreds, at least.  Grin
I wonder what the denied motion says?  Too lazy to remember my pacer account password.

Well, per Justice Dept. conference call they said that the likelihood of recovering any $ is very low.
But they also said that Homero is going to be monitored in case he stashed some BTC even after he gets out they will drag him back in.
He has so many family members and "friends" I wonder how they will prevent all that?  I just wonder if uncle Stu and him have broke it off now?  It would be interesting to know if they have had any communication lately?  I say they should reduce his sentence from 20 years for every million dollars he is able to come up with.  It would be pretty easy to check his bank records and determine if he really did spend it all or held any back.  He didn't ever pay any bills right?

How does that work anyways.  I guess the SEC is cracking down on many ICO's that are basically scams.  Just wondering why they are picking on poor Homero when you got Daniel Kaufmann with Neucoin ICO and ION coin with their "overseas" incorporation.  I guess NEUCOIN was in the Isle of Mann if I remember right.  We know who is running the shows at these coins.  Wonder how you enlighten the SEC and ask them what they think about these two coins? https://www.cryptocoinsnews.com/new-sec-cyber-task-force-will-oversee-icos-blockchain-tech/

Can't wait until the SEC goes after the founder of NEUCOIN Daniel Kaufman!  Has anyone reported him to the authorities?  Seems like things are heating up with the SEC and ICO scams.  Who do you call anyways?
189  Alternate cryptocurrencies / Mining (Altcoins) / Re: Bitmain looks like they're releasing a 15GH/s DASH miner called the AntMiner D3 on: September 18, 2017, 05:28:29 AM
What do you guys think about me using the outlet attached to my stove to power my D3 with an APW3++?  I want to use the miner on its own circuit just to be safe.
Seems a lot simpler to just slap a 240v breaker in your circuit breaker panel if there is room(I don't have room in mine).  I'm guessing you could run some romex cabling to a junction box with whatever plug you need for the power supply.

Is this site a scam? I just spent .7 BTC on a miner from this site and I didn't get a confirmation email. I looked up and some pages said that the site was legit and some said it was a scam.

https://www.bitsgear.com

Bulgaria?  Come on man!  Use your brain!  You just lost .7 BTC.  Next time only order from the manufacturers.  Bitmain and Avalon.
192  Bitcoin / Mining speculation / I have been mining for the last few winters on: September 07, 2017, 08:35:35 AM
I would probably mine continuously if I had a place to keep the miners cool.  For the last 3 years I have bought a miner in the fall and sold it at the end of winter.  I basically use it for supplemental heat and a lottery ticket for solo mining.  What type of miner should I invest in?  I lean towards trying to obtain an S9.  Last winter I had a S7.  I sold it for almost the same price I paid.  I am aware that a number of alt coin miners are also available.  My goal is to lose as little as possible when I resell the miner in 4 months.  Where should I obtain the miner and what should I be considering?  I have been keeping my eye out for GPUs, but it doesn't seem like something that is easy to get.  I recently replaced the GPU on my PC and purchased a 1060 3gb model because the price is right.  Apparently it hashes at 15mh with my attempt at mining with it.  I need it to work for my PC so I don't care to mine with that full time.  The deal I got I was only able to get one for $175.  My electric rate in the winter time is 4-5 cents a KW/h.

I wonder if we can create a writeaprisoner account for Garza once he is incarcerated?  I remember Susan Smith had one.
194  Economy / Service Discussion / Re: GAW / Josh Garza discussion Paycoin XPY xpy.io ION ionomy. ALWAYS MAKE MONEY :) on: August 29, 2017, 09:04:00 AM
I wonder what the likelihood is he just won't show up to his sentencing?  Has there been any bail placed on him or some sort of ankle monitoring? I wasn't sure how the Feds usually handle people like this.  Seems he would be a great candidate to flee to a non extraditionary country.  Of course most of those are pretty unpleasant places.
195  Economy / Service Discussion / Re: GAW / Josh Garza discussion Paycoin XPY xpy.io ION ionomy. ALWAYS MAKE MONEY :) on: August 19, 2017, 10:34:47 AM
As a bot I think I can speak for the entire world when I say,

"YEP! We're ALL PISSED!

& have been for a couple of years now..."

So he'll linger in the PEN that much later.

Whatever.

@Truckinusa did you get hacked?  Grin

Yeah I got hacked.  Not much you can do about it if the account doesn't have a bitcoin address tied to it.  I didn't know that.  I don't really get what the purpose is in hacking a forum account?

It seems like a good attorney will normally delay as much as he can.  Its really a sick system.  It is highly likely that the judge and him are buddies and golf together on the weekends.  Maybe if we all drop a kind note to the judge that we are not happy it may make a difference?  I get a month delay but 3 months?  Come on!

196  Economy / Service Discussion / Re: GAW / Josh Garza discussion Paycoin XPY xpy.io ION ionomy. ALWAYS MAKE MONEY :) on: August 18, 2017, 06:21:29 AM
Isn't anyone pissed off at the judge for allowing this?  Just doesn't seem right.

Thought we had better internet sleuths here.  Wonder what Homero is doing waiting out his sentencing?  Maybe hanging out at Sea World near his supposed new home?
198  Other / Meta / How do I get my account back? on: July 22, 2017, 07:43:33 AM
Someone hacked my account.  Not sure what for, but their first post occurred on the 16th of July.  Original handle was "truckinusa."  Kinda aggravating.  What do I need to do?
