Alpha hasn't run yet. Bitpay got back to me on this situation.... They sent a complaint to Alpha. Alpha replied with their typical bullshit saying they haven't broken their terms, and I am not entitled to a refund.

I explained how it has absolutely zero reference to not being refunded in full after 6 months of payment but before product delivery.

I then explained how they have in fact broken their terms and conditions by requesting payment greater than 8-10 weeks ago and still being far off from delivery.

I informed them I have already started a case with their local UK tribunal courts and this would be their last opportunity to resolve the matter outside of the courts.


I did the exact same thing and the child changed my 30% order status to full deposit refund but never sent it, and said the 70% was non refundable, and upon inquiry to why and what, complete disregard and lack of communication or cooperation.

In effect he forcibly cancelled and promised goodwill refund and stole the rest.

If you remember my last update regarding my BitPay refund request with dialogue involving Mubasher, our mediary and myself, the young adult forcibly changed the status of my order to refunded without actually sending a refund, and breaking communication for 2 days.

He replied upset that he felt "BitPay was feeding me lies" and "seemed to value the customer over the merchant" whereas the only contact that has occurred between BitPay and myself had occurred within the ticket itself and was completely neutral in every regard to the dialogue.

Also within his reply he did not address the status change of my order, my account status, or my two refunds.

He disregarded the issue and then disappeared again, and didn't respond to my immediate reply.


Bout to lawyer up because I'm getting nowhere with this negligent child.

That is the answer to all questions. Why is that person involved with this company? and how does that relate to offering customers 30% of profits only which there will be none.

It was definitely a calculated risk without a thought of loss involving consumer protections and rights present even though the company has violated them. The law is on the consumers side in this case, and the customers shouldn't loose their money when it's all done.


Also remember that this startup received I think less than $8,000 from family members and have proven their negligence repeatedly. I didn't know any of that until I came to this thread. If I had read this thread before July 14th when they asked for final payment even though they knew about failed chips earlier in the month, I wouldn't have given them anything. There is not one photograph of any of the pieces of hardware, while 6 other companies have had chips and products being used by customers for 3+ months.


Really, it was a calculated risk on your part?  You just NOW realized that there is no evidence of any sort of hardware or prototype?  You didn't think to look for that BEFORE sending them thousands of dollars?  What surprises me so much about this whole thing isn't the direction this thing took, that was obvious many many months ago.  What still to this day shocks me is the complete lack of any sort of due diligence performed by so many of their customers. 

As for getting your money back, that ship has sailed I think.  Some months ago, when people were here calling them a scam, there was still a chance to get your money back.  It is more difficult to hide assets when you are still actively taking in money.  Now that there is no more money coming in for them, and probably no operating costs either, I am fairly sure they have long since hidden whatever money may have been left.  They ARE accountants after all.  No, you will get your judgement and your court orders and find that the company has no cash or assets to pay them. 

Correct. It was a calculated risk on every customers part at the time of pre-order. All of us realized they had missed their promise of a prototype several months back, but in terms of their partnership with Dexcel being published and everything functioning correctly for months there wasn't much worrying going on. I am not as unfortunate as others and didn't send them thousands of dollars. Half the customers got saved by using credit cards and not having money to pay for it. I did due diligence it just wasn't at the right time or the right depth that would've included reddit topics and this thread which had people calling Dexcel, planning to travel to Dexcel in India, and other locals visiting the businesses and other communication accounts such as their phone being disabled. You are damn right that my own research wasn't as thorough as what was occurring elsewhere, otherwise I would've found out that it was teenagers with a loan from their parents operating out of a shack. I was too busy enjoying life to do any of that of which the others did. Only when the tune changed from "we are on track for a July shipment" to CC ability withdrawn, to absolutely no communication for 2 weeks is when I became heavily involved with every single thing that was occurring every day. That's when I and others discovered every negative red flag action that related to the company and it is sickening.

The child director is not an accountant, nor are the other two employees of the company, nor the 4th that just jumped ship. The only accountants are the dad and his son that distanced themselves from Alpha. I have already secured my Paypal payment through my CC company. I'm just trying to get my poor judgement BitPay payment back, and if it's a loss or comes back in pieces through legal means later on then I'm ok with that.

So if i understand this correctly..you paid with bitcoin...contacted bitpay....this guy mubasher says he paid the amount back you paid in btc to usd back thru Paypal..
likely knowing that it would 'hang' in limbo there because they (alpha) is having problems with paypal...thus no $$$ will actually get sent (likely so they can file quick
for bankruptcy protection)....got to admit it is brilliant...if these guys could make money as good as they keep/hide money they'd be the toast of the asci mnfg universe! Smiley

I paid 30% with paypal, 70% with Bitpay.

He said the 70% was non refundable and that by his goodwill the 30% was refundable in full in my BitPay support ticket.

I have requested my BitPay payment to be refunded over 15 times since July 28th. And like I mentioned as soon as he forcibly changed my order status of my Paypal payment to refunded I messaged and said that I did not ask for a Paypal refund, nor did I cancel my order. He never sent a Paypal refund. And he stopped communication immediately afterwards for the rest of that day for the next 7 hours. Then the next day being today nothing changed. Also upon request the mediary has stated that he has not responded to any of the communication requests with BitPay since I opened my ticket.

Several important updates I'd like to add -


Their forum stats page is not censored and there have been 51 topics and 514 posts created since the archival of the entire forum on July 29.

Only 13 of those topics still exist or 25% , and only 247 posts still exist or 48% of the communications during that short period. 52% or more of customer communications were deleted.

Mubasher edited Fiaz's Farewell post saying that he is no longer there and that he doesn't know what he's going to do with the forum.

Fiaz's last words were that they weren't planning on getting rid of the forum and he was hopeful that someone would take his place.




We've had gridseeds, kncs, gaws, zeus's, zoomhashs for the past 3 months that are now outdated, and to this date we have not a single photograph of any piece of hardware for these vipers.

Every action taken by the company in retrospect is a red flag over and over.



I'd also like to add that the last BitPay message from Mubasher that my mediary and I received stated that my Paypal payment is instantly refundable and can occur in 2 minutes, and even though I did not ask for a Paypal refund in my BitPay support thread. Neither refund for either payment has been sent as of 30 some hours ago, and as I mentioned earlier he forcibly changed the status of my paypal order to a full deposit refund without me consenting and leaving the BitPay still on processing. No communication since.


On the forum and the personal reply to the journalist at coindesk.com said that their paypal funds were being held, and that they were in delicate communictions with Paypal.

I replied to the last poster being the 7th reply, and responded to him saying that I had posted 3 topics in polite language on the subject of refunds with all 3 being locked and deleted within minutes. I also said that it mattered not whether the individual was polite or rude or had a legitimate question or complaint, all that mattered was if the post didn't paint Alpha in a perfect light.

So that is 3 topics with 4 posts or 100% of my communication efforts on their website.

So did anybody got their goodwill refund yet?  I also paid in full and they haven't refunded me anything at all yet even after they stated that they will refund some deposit as goodwill.

I have a 16 page on going dialogue with BitPay and Mubasher, and it got to the point of Mubasher changing my Paypal order to refunded in full on Alphas site, without the refund actually being sent, and then him ignoring our mediary's refund requests for the BitPay payment, and my clarification requests on what is occurring with my order/account and payments/refunds.

So he forcibly changed my order without my consent and stopped communication over 24 hours ago and hasn't sent any refunds.

i smell alot of fake accounts on the alpha forum. and they all use typical english words and are overly positive about new developments.

You mean the accounts that crete topics about liking Fiaz and wishing he wasn't leaving, even though there hasn't been anything positive displayed in relation to his character?


I created another topic earlier today and it was immediately locked, and was deleted, then the Fiaz PM came with the same response of you can't talk about payments in the ask us anything section and please send questions to their payments email.


I replied to Fiaz and told him I am in direct communication with Mubasher via BitPay support merchant resolutions with a BitPay mediary and he refused to refund my mid July payment and is holding it hostage, while all the people that haven't given them money are not required to pay until their is proof of product, company change details and a shipping date. I asked for the same benefit that those other customers have which is control over their money and a choice with their decisions.

Yea, I'm not sure how their consumer protection is and what they offer because I didn't think I'd ever need to worry about that. They are an up and coming popular Bitcoin payment method and they should have some type of insurance or consumer protection.

Hopefully they side with customers in this case.

No, that is not the case at all like I posted on the previous pages. I received a typed out response from Alphas office via my BitPay support ticket with BitPay mediary yesterday evening and he said that my 70% payment is non refundable. And he also said that the 30% is non refundable since it has been past 5 months.

I told him that I along with everyone else that has been requesting refunds absolutely did not consciously agree and enter into a 0% refund contract, because the terms do not state that and absolutely no human would enter into a 0% refund contract based on a promise.

I paid them on July 14th, and on July 28th I requested a full deposit refund as is outlined in their terms. I also opened a dispute with them with BitPay. I have emailed them every 24 hours without any response, and I have been in communication with BitPay every 24 hours. They have not responded to BitPays requests at all.

I finally received an email today from Alpha that said

"Hello there,

We are very sorry but as per our cancellation policy it has been longer than 5 months since you placed your order therefore you are no longer eligible for a refund. Our terms specifically mention end of Q3 as the latest we can ship, if we announce we will try to ship sooner it is done purely in goodwill and not something we are contractually obliged to do."

And I told them

"
Hello. I am not cancelling my order and it has been less than 20 days
since I made my payment. As per the terms I agreed to when making my
payment it states "Within 0-1 month after receipt of payment: Full
deposit will be refunded." It has been less than 1 month and and I am
requesting a refund of that deposit that I just sent less than 20 days
ago. In an earlier email I communicated to you that I private messaged
Fiaz Malik and he stated that if I were to send the payments email a
request for my refund that it would be processed. The response you
gave to me in email to that request said that we want you to read a
forum post before you finalize your BitPay payment refund request. And
every 24 hours since that email I have reinstated that you need to
refund my BitPay payment immediately without further delay.

I'm not sure if you are thick headed or what but you need to refund my
payment as per the terms I agreed to."

I also wrote a full length complaint via BitPay as well detailing every single deceitful criminal act and behavior that this company has committed in the last month.

I'm pretty sure we are past the point of good grace with this company. They are going to go bankrupt, and take everyones money with them, and then we will have to deal with the legal crap for the next year.

This has been the largest waste of money and time that I've dealt with in a decade. This shit is disgusting.


Good news is that my initial payment has been reversed by my CC company, a dispute opened, and a complaint against them for criminal conduct and fraudulent activity.

I will provide further updates on how BitPay chooses to respond and act in dealing with Alpha Tech as a merchant, and the protection and rights of the consumers that use BitPay's service as a method of payment.

I really wish I did, but I don't. I do remember along the way though that they told us that we could get a refund at any time before shipment date, and my friend here seemed to save the Terms at the correct moment when it did indeed say that exact statement for their terms. As we all know it has been constantly changed and modified for the past 9 months, and it seems as if they did some bad copy pasting or older file pasting in certain sections, because the pdf my friend created and the screenshot he took is when he lawyered up initiated full refund requests and everything else.
