i have found a wallet with 40 BTC.
The last transaction was 2011.
Can i take the money?
Or is it not legal?

How did you found it ? Using the block explorer, or on a hard drive ? If it is on a hard drive, yes you can take it, lukcy you ! If it is on a block explorer, you can not, since you do not own the private keys.

It was a private key, i found it in a forum.
Not in the darknet, in the clear Internet.

You found the keys to a car. Can you take the car? Is it legal?

Don't be an idiot.  The money is yours.  It is not illegal to transfer bitcoin if you have the key to do it.  Having the key means it is your bitcoin.  Take it and transfer it to another address before another key holder does that.

Not really, what i would do is to donate 39 BTC to people who needs it. Like donating to projects everyone use, but no one donates to, like UNOMP, BCOIN, and many others. I would keep 1 BTC as a reward for fair distributing the funds.
But the question is, how did you found a private key in a forum, with 40BTC in the wallet ? normally as it is existing since 2011, it should have been aleready emptied.

You can take it but be fast before somebody else take it because you founded that wallet in forum maybe it is already empty but maybe you will need to confirm payment via email so maybe you will not be able to take it.

It seems to me that kind of money on a lost wallet is something out of science fiction. Perhaps it is a new type of fraud. In any case, bitcoin is not recognized currency and a criminal liability you will not get. Try to translate into another purse and to remove.

They say take the money and run. Bitcoin is identity agnostic: who (what) owns they key owns the bitcoins associated. I would not make such a big deal, you've been lucky enought to find those keys. Maybe share some with a charity... http://bitcoinforcharity.com/bitcoin-charity-list/

I guess the OP has found the address which have 40 BTC and have the last transaction from 2011 and which tells us that the address was not used again since 2k11 and the owner must be from early adopters and lost hi faith in Bitcoins in very early stage and he lost his password/key/wallet etc.
And this user has found the address and wants to transfer the bitcoins to his address without they private key.
OR if he found an address with priv key then he is going to rich :p

Private key you sure or wallet.dat? if you are just get the privatekey and install it right now like in electrum you can get the bitcoin anytime you can send it,, if not if you use a wallet.dat and install like in electrum when you are sending bitcoin asking for authentications.

Somehow I don't beleive this story. You have found private key just like that, out of nowhere. And the wallet has 40 Bitcoins. If this has realy happened you would probably keep those coins not asking for advice here on forum. Or you would know that is not right to take other people's money.

Well, If you found the private key, then what are you waiting for.
If you found that on the internet so it means anyone can find it So cash it out before someone does.
You have the private key you are the new owner of the address.
Send the bitcoins to multiple addresses no one knows who are you Wink or use some mixing site.

More like...

Someone has signed the title to their car, had it stamped by a notary, then parked it in a public parking lot with the title and keys lying on top.

If you've published your private keys in a public space, you've given up everything that would constitute "ownership" when it comes to Bitcoin. It's irrelevant whether you've done this intentionally or accidentally. Archaic property rights laws simply can't apply to Bitcoin "ownership".

My signature is the only "rule" when it comes to Bitcoin "ownership".

That said, I don't believe the OP. I think he is simply trying to incite discussion.

If you aren't the sole controller of your private keys, you don't have any bitcoins.

Check the wallet address(es) and see if you can find something in the internet, if anyone has posted it and try to contact the owner.
Also check if someone has posted if he has lost the wallet or the private key of the address that this wallet has, I'm sure he will reward you.
If I were you I would give back to the owner (if he can prove it), just imagine if you lost 40BTC, what a bad feeling.

If you have private keys of wallet, congratulations, bitcoin is yours. You have the right to take these bitcoins, you are really lucky.
This address isn't used since 2011, I think owner from the first wave of bitcoin users and he isn't in bitcoin world anymore. But it's really strange that private keys was published on internet and nobody taked these bitcoins until now.
