It is a combination of both. I was already in the legendary activity range so I was given 1000 merit points. Would not be fair to be waiting for a random number and someone who got a lucky low number got legendary but then a week or two later I did not get it because I finally got my magic random number but did not have enough merit points. So all I have to do is wait until my unknown magic activity number hits and I will become legendary. Everyone who was already in the range of random numbers to hit legendary was given enough merit to become legendary.

Like Hhampuz mentioned above with an actual activity of 812 and bad luck it could take 6 more months before you become legendary.
But for some reason it looks like Im not eligible to get the free spot (no response from Hhampuz now) so maybe your time will come

Hey mate, you should definitely write to theymos. I read it somewhere around Meta that some dude had been ranked up to Legandary, and when the merit system got activated, he was lowered to a Hero member again. He wrote to theymos, and theymos fixed it for him. He said he was oscillating between Legandary and Hero, so it may be your case exactly since you've been given 1000 merits anyway.

I have never been legendary yet. Originally when the merit system started they gave me 500 points. Maybe this guy complaining made them realize everyone in the magic number random range should be given 1000 as some people in the range already attained legendary. Later I noticed (prob a week after merit started) my merit points changed to 1,000. So I think I am ok. Once I hit my random number I should be promoted to legendary now that they changed my merit to 1,000 instead of the original 500.
