I have done some searching around and see that this is a common complaint. To get straight to the point, it goes something like this - you made an ETH deposit to YoBit, but it was a contract execution. They will point out that you were warned and that's the end of that.

Fine, we get it, we made a mistake, but the ETH is clearly still in their account. It's not like the funds were lost, or it was sent to an incorrect address or whatever. YoBit still owns the ETH that we sent. It should be refunded - a fine is fair.

My question to everyone who has been a victim of this fraudulent behavior - how did you go about it? Did you have any success? What legal recourse do we have? Any insight on this issue will be useful to many of us.

This is a a common Yobit scam. Do a search for Yobit in the scam section & read through some of the 100's of complaints, you'll see.

I got no idea why anyone would even consider using these scammers anymore, let alone actually sending their coins to them. One born every minute I spoze.

What legal recourse do we have? Any insight on this issue will be useful to many of us.
The excuse of "you fucked up, your fault" is inherently dishonest when it comes to the blockchain since you will always be able to verify the fact that you were the one who sent the transaction via a signed message (save for some shitcoins).

Manual verification wouldn't even be necessary since all you would have to do is create some process that checks if a signed message (of their choice) corresponds to the sending address... and then return it to the same address. Sure, some people wouldn't have luck with interexchange transactions or third-party services but that's not the primary issue.

Unfortunately, you're looking at an exchange that literally orchestrates pump & dump schemes and I don't know if it would even be possible to hunt them down and take legal action.
Send support tickets... though you're not likely to have much luck there: some people have had their tickets in waiting hell for years.

In the first place, it's your mistake, this forum has a lot of report about Yobit's dubious activity, all the complaints are very open to everybody to read, if you still proceed after reading all these scam accusations then invest at your own risk and don't blame anyone including Yobit.

They are YOBIT mate. You have created the mistake, therefore, they will stand on why they should give some effort extracting the funds you have wrongly sent. They can't even solve some minor case by other complainants so I don't see they will spend time to solve your case.

I guess that even on a big exchange, manual extraction isn't really the priority or will take a quite long time before they will get back the wrongly sent funds to their users.

You have no choice but to asked Yobit nicely and repeatedly to get back your funds even you are already pissed-off.

Thanks for the feedback. That does seem to be the conclusion from all the threads I've searched and read, that there's no way out. It's YoBit, so the funds are lost. I will keep hoping someone will share a solution, but of course, I'm not expecting any.

I don't agree that it's only our fault and Yobit should be absolved of all blame, though.

You have made the searching have you done it yourself if you do, then it's no recourse they got your coin and it's up to them if they want to refund you, you can do legal remedies but his will cost you a lot and it's not worth it maybe if it is hundreds of dollars, but if it is only a thousand bucks worth forget it.

Not only Yobit, I can confirm that this is the case with Livecoin and Binance as well.

And no, as far as I am aware Binance did not refund the users when something like this happened.

And Livecoin owes me about $5000 worth of eth (tokens) which was wrongly sent to a contract address of a different token with the same name.

Yes, I'm much more careful with contract deposits now. I'd expect Binance to do the refund though, even if it takes some time.

Hmm... really?

It's surprising that YoBit is willing to still waste their time with support tickets. After all, they have over 2 years of unresolved support tickets. Why start now? Especially with such a low amount?

I was pretty skeptical too, especially after the feedback. I don't see the relevance of hiring a shill (or giving them any incentive) that is a Newbie. Moreover, the negative feedback is a pretty bad sign for someone who's supporting YoBit.

Your only chance of recourse is to either go through their support system, or potentially try to message one of their mods on the chat box; neither of which I'm confident in due to how unresponsive they are in both of these channels.

I've seen people say that if you translate your ticket to Russian and send it through, they'll reply faster. While it's unconfirmed, it's worth a shot since things can't really get worse than that.

They definitely have the funds and I wouldn't doubt that, with a bit of tweaking, they can come to automatically accept deposits from contracts as well. It's a matter of willingness, really.
