if you have the old T&C. we could read it and see if they have the right to change and force new rules on you.

my guess is you will lose your coin if you don’t comply to new T&C

as the old one will have a line that allows them to alter t&c.

therefore you will need to comply to get the coin.

i also think  🤔 the question belongs in service discussion not here.

I mean, I don't think you have any other choice. The new T&C requires KYC/AML documents to be submitted, right? If so, unfortunately you're probably going to need to submit the required documents to gain back access to your funds.

Anyway, another perfect reason on why you shouldn't unnecessarily leave funds on custodial platforms.

Shouldn’t they give you the option to not accept the new T&C, close your account and give your coins back? I don’t think they have any legal grounds to make you accept it or lose your money. Try contacting them with this alternative if you don’t mind getting your account terminated (you will need the KYC anyways to continue with it).

While I understand your grouse against local bitcoin, unfortunately, there is nothing that can be done about it. They can change their Terms and Conditions as they wish and they even don't have to notify you but they would because I know anytime there is going to be a major update such as this, they send a notification to all their customers.

So, you have one option either to forget about the money and the KYC or fill the KYC and have access to your funds, there is no alternative to that...

I certainly agree.

However when it comes to the issue of KYC (if that is what OP is worried about) then I think the chances that LBC will budge will be relatively slim, due to the fact that they'll constantly refer back to the significance of KYC/AML procedures. There is no point going the legal route either because a) the amounts involved are so small and b) you will have to obviously identify yourself.

And I'm sure that there are clauses in the old T&Cs that state they can request KYC docs any time, which makes the situation more sticky. The best you can do is negotiate at this point.

You are correct and your line of thinking makes sense.
But probably in the old T&C, which he agreed, gave the exchange the power to changes terms at any time and to hold his coins...

Anyway, another perfect reason on why you shouldn't unnecessarily leave funds on custodial platforms.

Certainly.
When you leave money in custodial services you may not only lose it if the custodial services disappear, but also have your account frozen for many reasons.
Authorities may decide to investigate the custodial service and frozen funds. Authorities or exchange may decide your account is "suspicious" until you do KYC. Or the terms may change, just like in the OP's case.

Ideally nobody should hold any funds in custodial services, only when you need to buy/sell, and immediately remove them after you complete your transaction.

Might something is missing here. What exactly did they tell you? Is this just all about that KYC thing or there are other issues?

Anyhow, if you want to get back your funds, accept their condition and undergo KYC. No choice but to comply with it.

If you don't want, then you have to say goodbye to your funds. I doubt an alternative to that will be allowed by Localbitcoin.

as the old one will have a line that allows them to alter t&c.

I'm sure that they have this kind of line in there old T&C which most of bitcoin services usually include to protect there company in case shit happened. By the way localbitcoins approached by force implementation of new T&C to all user, I guarantee that they are holding that kind of cards in there sleeve. Most of new user didn't read Terms before clicking the register button including me.

I believe the only key to solve this issue is to follow the new T&C or else OP should accept what he is claiming for loss. I hope OP have the copy of old Terms and condition.

localbitcoin cannot force a user to accept a change
localbitcoin may deny the user the use of localbitcion

I mean, I don't think you have any other choice. The new T&C requires KYC/AML documents to be submitted, right? If so, unfortunately you're probably going to need to submit the required documents to gain back access to your funds.

Anyway, another perfect reason on why you shouldn't unnecessarily leave funds on custodial platforms.

I don't know the new t & c
It is irrelevant
they're new. do not apply to users prior to acceptance
If not. NO acceptance would be necessary ...
It's more. I already sent my documents in the past.
A website cannot force a user to sign new conditions if the user does not want to.
localbitcoin can close the use of the web but not steal the money from not accepting the changes.

Yes. It is a perfect reason not to enter a single cent in pages of this type

should...
but localbitcoin doesn't allow me
I have rejected the conditions
and I can't withdraw my bitcoin

It is not legal for the "accept" option to be forced. It is not legal to steal bitcoin if someone does not necessarily accept.

If there is the option to accept or reject. It is because the user must be able to accept and reject. otherwise it is fraud

localbitcoin may prohibit using localbitcoin if I do not accept. But it can't steal my bitcoin if I don't accept.

The question is. Does justice allow you to report bitcoin? Or is it a product without legal backing where they can steal from us with impunity?

You may want to update the original post and give this extra info so people won't tell you again and again about T&C and KYC.

Virtual or not, it has to count as some sort of good/property. I think that's best to find/ask a lawyer.
Edit: I googled for ask a lawyer spain and I've seen some free services which may be what you need.

as the old one will have a line that allows them to alter t&c.

It is very simple...
If it is not necessary to accept. no need to accept ...
If there is the option to accept ... The user must be able to accept ...

And if I do not accept. localbitcoin can even close my account. Don't steal my bitcoin

I'm identified ...
I just don't want to accept a change of conditions.
I want to exercise my right to withdraw my bitcoin
and that localbitcoin do what it wants with the account
But I want my bitcoin

You may want to update the original post and give this extra info so people won't tell you again and again about T&C and KYC.

How do you demand a virtual product like bitcoin?
Can I report it in a Spanish court?
Or being a virtual product there is no judicial support?

Virtual or not, it has to count as some sort of good/property. I think that's best to find/ask a lawyer.
Edit: I googled for ask a lawyer spain and I've seen some free services which may be what you need.

to do.

What I see here is your account is being blocked or locked and you can't able to withdraw your bitcoin out from localbitcoins.

I don't see that they steal your bitcoins they just locked your account I think if you want to withdraw better accept their new terms and verify the KYC process this time and they will unlock your account back.
Unlike before you can able to use their service without any KYC verification but right now they are forcing customers and users to accept the new terms including the KYC verification.

The thing is it doesn't have to count as anything but random digits on some website.
So if @paddy_exchange doesn't want to lose bitcoin he has to accept T&C and withdraw or contact support in order to withdraw funds without accepting new T&C

I don't talk about KYC. I talk about T&C
localbitcoin can't steal your money if you don't accept a change of T&C. That is illegal.
have you understood now?

That is the theory.
the problem is that localbitcoin support doesn't solve it
Support does not allow me to access my bitcoin
if you don't accept the t & c = close the account
ok, close the acount
But let localbitcoin allow me to withdraw my bitcoin
And localbitcoin is not doing it

I don't see you are in any serious issue of getting your bitcoin because their KYC limit is only for the trading amount and incoming transactions so you can accept their terms and withdrawl all bitcoins from your wallet,I am also faced this we can't navigate to any page of their platform without accepting their terms when they updated it but you are right here they should have close my account and give any funds back in their wallet if any user doesn't want to accept terms that is how coinbase works.

I think Localbitcoin announced the change of their terms so much ahead of the time before they implemented it.

It was never their fault in case you missed it.

Accepting their terms is your only choice if you really want to get back your funds.

That's precisely the problem
localbitoin does not allow me to withdraw my bitcoin
If localbitcoin wants to close the account, ok.
but my bitcoin are mine ...
And localbitcoin cannot legally take away my bitcoin because I don't want to accept its changes.
It's crazy

legally no. If he does he will be stealing
a change that says: accept or reject
I have to be able to refuse ...
Let's see if you understand:

- Sir, we are going to change the conditions, now you will pay 7 times more, you can accept or reject the change but if you reject it, you cannot continue with us.
- Ok, I refuse.
- No no, if you refuse we keep your funds ...

Localbitcoin is very dangerous for your bitcoin....

So two weeks after, did you finally agreed to their new T&C?

With the current ban wave from what I see from tickets number they are getting around 4000 a day, they even have an alert about it on their website, if you don't want to agree with them your only way would be account deletion which would take another two weeks, then waiting for the bitcoin to be returned ....
Better to simply agree to those damn terms, get your bitcoin and be done with them

One of the saddest part is about those using LBC as their main wallet and ignore the risks expected. Am telling this because i know how much traders started their careers with LBC since old days 2014 and before, as i have met many of them in my local marketplace, and they fully trust the platform despite all the warning flags here and there .
What is actually happening with LBC can occur with all the other alternatives, so if you may lose the chance to use the p2p exchanges then please avoid to use them for holding big amounts. I would share the news in my local groups because unlikely most of the users in recent banned countries don't yet know about Tos change .

KYC is actually mandatory on localbitcoins according to my point of view. I have seen a number of sellers selling localbitcoin accounts and this is not at all tolerable. How could anyone sell false identity to make their own profits? People have used localbitcoins for a lot of illegal activities like buying with fake credit cards, etc.

This would have forced localbitcoins to start implying KYC verification to each and every registrant and this is actually not so bad as they would never leak your documentations but they would be stored in secure servers and would be used only when needed. This might also eliminate the fake accounts over there leaving clean and positive trades between real identities.

I am also facing this but thanks God as I was able to withdraw my all coins now already deleting my account as they are saying they have no time frame for next update about these 22 countries in market many options available for this all we have to use them.
But you withdrew before they decided to make everyone do the KYC or lose their coins, right? Or did they let you not accept the T&C, withdrawal and close the account?
My account already clear all 3 levels and I was doing trade suddenly few days back I check they delete all ads from my country list then I send them email about this issue and I have very quick reply that they are closing until next announcement if you in hurry then withdraw your funds and close your account so I done this.

Regulations changed from year and now so we can't really blame the exchanges since we know there is always risks associated with using centralized platforms. But if someone holds huge amount of their crypto assets on exchange they should change their habit even if there is no restrictions for your countries.Anything may happen at any time.

Yes the localbitcoins has been done lot of changes in their tram and conditions over the years. Now it comes very difficult to use the localbitcoins without kyc and they have different levels in kyc if you passed all those then nothing problem to use localbitcoins otherwise it will very difficult to use.

Hey OP, can you specify which new terms and conditions are been implied by localbitcoins to you? I do not really think that localbitcoins might imply any inappropriate terms and conditions to the user account so why are you not ready to accept those terms and conditions?

You should always try to follow the rules and regulations of each respected exchange so that you never face any problem of rules violation over there and for it, you should go through each terms and conditions before starting with the exchange. Localbitcoins does not seem shady to me and hence they might release your funds if you have no shady activity over the account.

No. Do not accept the T&C
I received the bitcoin
Too many days without my money.
But I already have it.
I have moved between 50 BTC and 100 BTC in localbitcoin
1% is between 0.5 BTC and 1 BTC in commissions for localbitcoin
Never more. They lose

In the end yes.
I could withdraw my bitcoin without accepting the T&C
It was illegal to force me
closed localbitcoin. never more.
I have generated between 0.5btc and 1btc in fees. Never more

You can't know that.
They may have a security flaw.
They can have a dishonest worker
They can simply sell them
When we send our documents online. We can't know your future. There are thousands of people selling documents ...
It is not fortuitous.

I do not know. It was not important. And they were not in my language.
But I must be able to say no.
And that is what I defend.
can say no.
I said no and localbitcoin have blocked my bitcoin all these days.
no shady activity to say no ...
I already received my bitcoin
But it is not acceptable. Block a person's bitcoin for no reason.
This time they have blocked my bitcoin for half a month for no reason. What can localbitcoin do tomorrow?

Glad to hear that you have received your deposits from localbitcoins. I could understand your angryness.
I can guess that the problem is actually persistent for hundreds (maybe thousands) of users who may not be aware of their accounts being frozen. I tried to share the info everywhere i could reach .
This is why i want to know if you did received alerts from localbitcoins by email. Does there a possibility for licalbitcoin banned users to not get the information about their frozen accounts or the TOS chaNge ?

Localbitcoins.com is in trouble as they are facing some good drop in trading volume nearly 50% which is hurting them so now they are doing suspending accounts without notice.
