Duelbits refuse to recover funds sent by deposit on wrong network BEP20 - ERC20

You are not thinking this through and since I know you, I know you can think through the whole process.

He sends USDT to an address that has the same PK for BEP20 and ERC20. Now let's assume, let's just assume that the T&C were valid, stating that funds sent on the wrong network are LOST. Now OP sees that funds have been moved in three weeks from now from that address. Do you think that the casino is now the rightful/legal owner of the funds, does not have to return them and can buy hookers and cocaine? Of course not. They either never ever touch it (still questionable because they can't ague the funds are "lost"), or if they touch it, how did that money change ownership? It changed possession, but it didn't change ownership.

If someone mistakenly sends money to my bank account, I am the possessor, but not the owner, and the law clearly regulates how these two differ.

I am aware that I made a mistake, but I am still surprised that they do not want to credit the deposit, despite the fact that

1. They have done so before in the case of this type of mistake
2. It is a BEP20 network that they support on USDT, and the deposit address for USDC ERC20 is the same.
3. This deposit would not even cover 1/3 of today's losses on this site.

You know, dude, even if others want to help you with the problem with the transaction you made, there's nothing they can do or even I can do because you yourself admitted your mistake;
in short, they're already close to you because you admitted you were guilty.

Though $300 is a big amount, there's nothing you can do except take it as a lesson, so the next time you transact more than that amount, you won't make this mistake again
because you'll remember incidents like this.

I understand the whole process, and I fully agree with you about how things should be... But this world is fucked up, what's legal or illegal differs from country to country, on top of that, even those rules & regulations are not the same for all. And now we have a crypto gambling world, the wild west where casinos are bending rules on a global level...

As I understand, we both think it's wrong what Duelbits is doing, but we disagree whether it's a scam or just unfair. In both cases, when someone decides to play in this casino, they accept the house rules... they put themselves in a position to be scammed or treated unfairly.

Bottom line... Is it fair? No! Is it ethical? No! Is it legal? Well, that depends on their licence and their ToS, so maybe they are "legally" protected. And at the end of the day, we players always take risks when trying some crypto casino... the licence & regulations don't mean much in general, it should be important how much some casino actually cares about us players.

MTNF your continues reminding them on the case contributed to it. Those cases are different, yours was mistake of the network of the address.

Exactly that. Had the same with stake but the fee was really super low, not worth mentioning. They did that in like some hours time only, so it is not a big deal when even the biggest site on the internet can spend time and resources to get this done in a timely manner.
What would be interesting though is if duelbits doesn't fix it, what happens with the coins. Will it remain in the wallet forever or will they move it some time in the future, just like what betfury did with my money they didn't credit.

@iv4n, @memehunter this is exactly what I mean. Imagine they had moved his funds and used it, would you still want to tell me that T&C could ever legally justify that? This is why I have no idea what you guys are talking about. If I park my bike in a garden and that person has T&C for their garden stating that any parked bike in that garden automatically changes ownership, the T&C are invalid. I mean how can you even think differently here? You need an agreement to transfer ownership and the delivery of the item, only with those two things can transfer of ownership become valid. Anything else doesn't count.

Since they now resolved it, I am cool with it, but your opinion is still bogus and is probably the result of a lack of law, globally, not only in Germany or any country. What you claim to be true, does not exist.

True, it is really quite common. Even when a platform is in support of the USDT on the BNB smart chain (BEP20), which automatically do not imply it is in support of USD Coins on the very same network. A lot of platforms separate tokens using both assets and network, and their systems of deposit just monitor particular combinations such like USDC on Ethereum (ERC-20).

They can still control the wallets and could be able to recover funds, technically, yet recovery normally demands manual operation and some platforms only choose not to take care of it. Hence while it seems unfair, it isn't usual.

The best option you have is to continue contacting support using the transaction hash. Some sites later recover such deposits, mostly when the amount is a significant one like $300.

From my understanding, what actually made op to be more careless was because he had this same issue before and it was resolved quickly without any delay. That really made him to be reluctant, he don't bother to recheck the network he's send coin to before confirming the transaction. Now he will be very much careful as he had gone through this delay. Everyone will always learn in one way or the other, only someone who don't learn easily will eventually learn the hard way. If to be that Duelbit casino is not a reputable casino and they are not here or op itself is not here, that money would probably be gone by now. This should serve as a very good lesson to op and maybe others who might have come across this discussion.

I see. You have reached the support and did an amazing job. I wonder if you will be sharing your conversation with the casino or give us the brief summary of the argument presented. First of all I acknowledge that you have helped a fellow forum member as he would have expected and this is what matter the most.
Now, I don't want to spoil this nor I want to belittle your amazing efforts by further pursuing our argument here but I will say this that IMO, you have not understood my position, So let me rephrase it a bit, 'can you make the casino in question to remove that term (which you think is 100% wrong)?
And as far as my advice was concerned, it was on practical grounds, move on and learn from mistakes, which I must admit was somehow weak and @iv4n has a better way, which was to keep asking politely.

Mistakes often happens. No one can deny the fact that he can wrongly copy the wrong address or chose the wrong network or forget a decimal when to set the amount to send. To err is always human, no doubt. Not only you and me should admit this, but also duelbit and other online services. To be honest and credible, the service has to be ready to deal with such cases.
The lesson besides to be careful checking every transaction's details is that sometimes it is not possible to recover the amount sent by mistake because the service might ask for a fee as the refund will be done manually and the lost amount is small for fee deduct.

Congratulations to OP and the thank extends to user mv1986. I would like to ask how he managed to help recover the funds. How duelbit refused to pay then suddenly accepts. This is just out of curiosity.

The admins of the casino probably needed some to explain that the problem is SIMPLE. Merely run a node of that network where OP sent the money, import the wallet seed phrase/private key in that node, then send OP his money back.

The admins perhaps already knew the solution, but they merely didn't have the time to help OP?

Enforcement is another story, I had my own case for half a million with a crypto startup here in the forum, was right in the case, enforcement was impossible.

Once and for all: ToS don't matter legally when they collide with law. Period. Why do they still all use illegal ToS? Because there are some braindead people out there who think ToS are the legal truth. By any chance, @iv4n, do you know anyone who thinks like that? FYI, 95% of the countries in the world have a law either directly or indirectly addressing "unjust enrichment". Go educate yourself about it. If someone can't deny the mechanical possibility to return assets that wrongfully got into their hands, they MUST return it. Can they charge a fee? Yes. Can they charge ANY fee? Nope. Can you sue them and win? Yes. Can you certainly enforce your legal rights? No. Can you have a member of this forum to help out instead of teaching BS lessons like "learn from your mistake" by accepting fate? Yes.

@iv4n, if you ever are in the same situation, please ask for help. We all make mistakes, me included. I won't tell you to accept the loss because it is dumb. If it turns out you have to accept it because we can't solve it, so be it. But telling anyone to not even really try is 0 IQ. Off-topic, but since you brought it up: I'd be up for poker in about 1.5 - 2 hours. I got brutally sick last time and was more or less knocked out for quite a while. If you or @memehunter or anyone else wants to, we could go for a little round. Prize money, you can decide ($10 or $20?).

Oh and since you brought up logic, please explain to me when you call all ins with a hand you know you are at a 17:78 disadvantage.
