you dont have access to the original website\database or dont have the ability to move the domain to a new host?

if its the latter, why not just "rebrand" and give it a new name? then just put a redirect on the original site to point to the new domain?

I think we've had this discussion before with theymos across multiple threads.

Terrytibbs got the scammer tag because he sold something that ended up being stolen or something and he claims he wasn't aware and did not take responsibility. Assuming he wasn't aware, does he deserve a scammer tag? And if he is really a scammer, why does paying back later allow the removal of the tag?

I got the scammer tag when a douchebag gave my highres artwork source files to the community and instructed them to abuse it simply because he didn't want to communicate with me about a payment not coming on time and I told him I wouldn't pay him. Does that mean I am a scammer? Does it mean I'm not a scammer just because theymos removed the tag when I sent him payment later?

Bitscalper ran an anonymous and opaque website with lax security that was abused numerous times at a loss of his clients and was never paid back to this day. Whether or not he's a scammer is not really the question-- whether he's competent to be trusted in any business is the real question, and I think although a real scammer tag might come in handy, we need a tag for "incompetent" as well. I am sure I would have earned it by now, but just the same.
