The only possible way this happens is if the US $ loses its status as the international reserve currency, the US enters a massive depression, followed by hyperinflation.

Hey! Wanna play, uh... five-ish sometimes-loaded questions? (just as speculation, not legal advice)

If MtGox were to become compliant, do you think they'd need both federal and state FinCEN/MSB compliance (assuming they don't latch onto a national bank/CU somehow)? Most people seem under the impression you can just register with FinCEN and it's done - woohoo, you're fully compliant, and this is the "compliance" most BTC MSBs seem to be talking about. But, these companies do business in all 50 states, and all these states have their own laws, licenses, and usually crazy-expensive fees.

Am I wrong, or is federal FinCEN registration as a MSB not enough?

Do you know of any US-serving exchanges which you believe probably are fully compliant?

Do you believe the USG (particularly, the courts) will accept Bitcoin being treated as a currency, and do you think that premise they're seizing Gox due to should be legally challenged? If you think it should be challenged, who should be challenging it? In an niche economy of startups, maybe we should all chip-in for a legal team to challenge the definition of BTC as a currency?

For almost all of us, we've treated Bitcoin as a commodity rather than a currency for tax purposes - especially relevant because complying with tax regulations as a miner would be an enormous, practically unfeasible pain in the ass. Still, AFAIK nobody's really bringing this up. The implications of letting FinCEN and other bureaucracies call Bitcoin a currency seem pretty unexplored, and there are people just saying "it won't affect me, I'm in the UK" when the US has a tendency for its precedents/definitions to be adopted elsewhere. Do you think the Bitcoin community has under-reacted to the likely changes in definition of Bitcoin will bring, or is it appropriate just to wait until we're explicitly told by a government we're doing something wrong (IF we're doing something wrong)?

The market obviously thinks MtGox should die. It totally boggles my mind, but the price is spiking a little bit, going over $120 -- this might be related to some very recent and major progressions in merchant adoption, or that SR is functioning properly again, but the price did hold pretty steady while the Gox news broke and worsened. I guess we'll see $1000 coins when all the non-compliant exchanges open to US customers (just about all of them) are shut down with funds seized. MtGox probably will die within the next couple years between the bank seizures, Dwolla severing, and valid-seeming $75m lawsuit. If it's CoinLab which kills them, they might at least compensate shafted customers with CL-USD/CL-BTC. Idunno, though. I apparently over-reacted, because I completely sold out a few days ago and won't be going back in until the price tanks or someone challenges Bitcoin legally being a currency in court and wins.

For a scammer tag, the accused person needs to have promised to do something and then failed to deliver on the promise. TradeFortress never promised to pay anyone any bitcoins here. If you trust him to do something that he didn't promise, that's your problem.

An IOU is a promise to pay. TradeFortress has issued IOUs which are essentially promises. He did this using the Ripple system. All of his transactions are part of the ledger. But he hasn't let anyone redeem his promises into actual Bitcoins.

This is no different than someone coming to the forum and saying "I owe you XXX BTC and I promise to pay you in the future." Except that he did it using a cryptographically secure accounting system (called Ripple).

To make matters worse, he took advantage of people by using the forum to promise bitcoins to people in order to get them to extend trust to him in the Ripple system. Then he used that trust to loot their Bitstamp BTC IOUs, replacing them with his worthless "TradeFortress BTC IOUs" (promises to pay Bitcoins).

All of this information is right there in the Ripple ledger. His Ripple address is rH3bZsvVUhzugvcYuJVoSYCEMHkfK6wHNv and you can see his transaction history here:

This shows that he has promised users 1,454.65 worth of Bitcoins. But when you try to redeem these promises, he does not pay the Bitcoins he promised.

If the SCAMMER tag applies to someone who makes a promise and then does not deliver, then TradeFortress is the poster child.
Maybe the problem is how few of us actually understand Ripple.

When I look at the linked page, it seems Ripple is telling me TF owes ~$900 and ~.04BTC. How do we see how much money TF took from others (not trust, but the redeemable BSTP BTC notes)?

Sending the creation of bodily functions (poop and blood in particular) is generally illegal due to the fairly high risk of transmitting disease. To send biohazards like that, you need a medical shipping license and follow a special ruleset. Neither of those sites sell real poop, though "poopsenders" is trying to avoid admitting it isn't real, untreated poop. US, though -- dunno elsewhere.

ETA: Actually - poopsenders might be selling animal poop. I have no idea if that's regulated or not.

Glad to know there is an expert here who can keep us informed about the law as it relates to posting excrement.

I went off on a tangent after reading about a rather peculiar tactic the Israeli gov't used. According to an article from a year or two ago, they targeted a couple Palestinian sewage treatment plants. Someone wondered if human poop could be used as fertilizer, and then.....

Yes and no. The US does have the power to close MtGox, because the US is extremely powerful. But it does not have the sovereignty to do so (MtGox is Japan-based), nor does it have the inclination to do so. Let's be clear: the US isn't going after MtGox because it is a bitcoin exchange. The US is going after a subcompany of MtGox (i.e. the US branch of MtGox) because it failed to disclose that it was a MSB.

If MtGox were to fight this, I think they would have a good case to say that, before the FinCEN pronounciation on what is or is not a MSB regarding bitcoin, there was no way it could reasonably be expected of MtGox to know how to correctly register their bank account. But often logic does not apply when it comes to the actual US justice system, so who knows what'll happen.
With the LLC, the USG may also be going after Gox itself (rather, Mark) given the violation carries up to five years' prison time. Idunno what all requirements are needed for extradition, but I can't imagine why Japan would deny it.

Yep, except there's recourse if Gox fails to repay, because you did not turn over ownership of anything to Gox, only control (and very limited control, at that). If Gox holds $10 of yours, it's still yours.

- So the analogy doesn't fly. Gox isn't giving you IOUs (except with GoxUSD and GoxBTC codes which are no longer available) - they aren't giving you anything -- they're just showing you what of yours they are in partial control of.

It's frequently worse. 15-35% in admin/advertising for the really bad ones (the big cancer and Alzheimer ones are 20-30%, IIRC). 7% is relatively cheap.

I've never really liked the Caviar models. 2 of 3 (1 RMAd.... then the RMA failed) have failed within 5 years with the other occasionally sounding the death click alarm, and they don't have anything particularly exciting going on, so I'm not really sure why it's supposed to be "caviar." I guess it's supposed to be like the "Deluxe" pasteurized processed cheese product they sell in supermarkets.
