8881  Bitcoin / Hardware / Re: BFL upgrade now offered on 5ghz orders.(screenshot) on: May 26, 2013, 08:30:26 AM
I'm just glad it's gone. Firmware's should be free.

If it was firmware. This sounds to me more like a 3 chip Jala since they took the offer down. Perhaps they ran out of chips binned for 2GH instead of 2.5GH.
It was firmware, stated on BFL forum and BFL Shoutbox.

Here's a hint BFL: ship the Jalapenos, and then offer upgraded firmware for a nominal payment.  Asking for more money up front with hundreds of customers waiting is just plain rude.

BFL was supposed to ship 200 units on Friday and Saturday.  How many did they actually ship?

BFL: "With that in mind, we should be getting about 200 5 GH/s boards on Friday, and we'll be shipping those out on Friday and Saturday."

Now, how do you expect the swarm of locust to do shipping when they're busy playing sockpuppets on this forum.

Besides, it's a four day weekend, with a big race coming up. Surely, you can't expect BFL to be as busy as Roman manning his Twitter account, do you?

You know why it's been quiet lately?

It's SockPuppet Hour at some Kansas City pub.

"Josh, you coming to bed?"

"How many times do I have tell you, cocksucker, that I'm not J...? Oops! Sorry, dear."

"No problem, dear. At least you got the cocksucker part right--for once. Tell Luke Jr. I said hey. And don't forget to walk the poodle."

Quick aside: Can you imagine Josh walking that rainbow colored poodle in his neighborhood.  Grin Grin Grin I bet the neighbors talk.
8885  Bitcoin / Hardware / Re: BFL Forced "On Hold For Refund" for all my Single SC orders on: May 26, 2013, 06:41:49 AM
I am afraid you are incorrect. Contracts of sale cannot be unilaterally cancelled unless the contract explicitly allows for doing so.

Just imagine that we agree today that I would deliver you 10 bushels of wheat in 3 months for a given price. If 2 months later the price goes up, I cannot unilaterally cancel the contract and give you a refund.

As for damages, one can calculate the earning capabilities of the item that was ordered, and one can seek compensation for a reasonable period (few years) of use. It would be several thousand dollars at the very least.

What you've described is in fact a very specific type of sales contract usually called a "forward contract" - If the buyer could produce such a contact then there would be a legitimate case for damages incurred. However, never was any such contract offered by BFL... so I doubt the OP has such.

I respectfully disagree with what you say.  What is special about a "forward contract" is that the delivery may be well in the future, and in most cases so is the payment.

In the case of BFL, they accepted payment now, and promise to deliver. Failure to deliver on time (or within reasonable time) is a breach of contract.

For example, if I sell you my car, and you pay me the price, then I cannot unilaterally change my mind, and simply give you back your money. I will also have to pay you all damages that you incurred from my failure to honour the contract.

See http://en.wikipedia.org/wiki/Contract#Remedies_for_breach_of_contract and http://en.wikipedia.org/wiki/Breach_of_contract

No .. you sign a sales contract which specifies the price and the contract which details the terms of the sale.. usually the contract is binding upon two conditions 1) the money being paid 2) the car being taken.  Both of which are considered binding separately and indivisibly . i.e. if you take the car you are required to pay the money or if you take the money you are going to take the car.

So .. if condition 1 is not met then condition 2 cannot be met either.. i.e. if you don't actually have the car in hand you can't be expected to hand over the money. To be even less blunt .. you can't demand possession of something just because you have the money in hand to pay for it.

Logic is funny mother fucker .. it works both ways .. somehow.. bastard

Josh's Tourette's syndrome is kicking into high gear.

Actually, legally all people who've pre-ordered should have had all their moneys returned after X days, as proven by a many members on this forum.
8887  Bitcoin / Hardware / Re: Butterfly Labs Forced "On Hold For Refund" for all my Single SC orders on: May 26, 2013, 04:57:59 AM
What type of person raised, and provided for, by a step-dad who earned an honest living and sends him to college upon leaving the nest, to only quit college to travel the world, eventually ending up at his real dad's Laissez Faire City pad, joining forces with him in amassing loot from the unexpected, then later in life returns to the nest, vowing that he's changed his ways, but shows all the signs that he hasn't?

Worse yet, what type of people would work for such a man given, or previously knowing his track record?

What type of people would order product, then refuse to cancel their pre-orders once the facts are presented?

What type of person defends their lack of action by stating that they've known the risk, and others shouldn't be telling others that investing in BFL is unwise.

I'm glad I'm not one of them people.
8888  Bitcoin / Hardware / Re: Butterfly Labs Forced "On Hold For Refund" for all my Single SC orders on: May 26, 2013, 01:31:47 AM
If I'm reading the past several posts correct, there seems to be two user accounts operated by Josh Zerlan, the COO of Butterfly Labs in Kansas City, who has nothing else better to do than troll the forum he's on record in stating he loathes.

Meanwhile, thousands of people have pre-orders pending, the same people that Josh Zerlan refers to as cocksuckers.

Josh Zerlan drank the Kool Aid at BF Labs, Inc., continuing to do so to wash down the cum of Sonny Vleisides, son of a scammer by the name of James Ray Houston, et al., both of which scammed millions of dollars from poor little old ladies with their lottery scheme, while they lived high on the hog in the blue butterfly land of Costa Rica, in a place call Laissez Faire City.

I believe it's time play to hardball!

"Basically within a month, we will be ready to assemble and ship upto 250 boards a day, given that we have the Avalon chips. Now that is a big variable, we have no idea when we
will get the chips. However we will start taking orders for the assembly service, so that in case you receive your chips, you can send them over to us and we will start
assembling your boards."

Also notice that "you send us your chips" is the main theme (bold text) on their whole website:

http://terrahash.com/

It is a scam, and that is my final judgement on TerraHash topic.

A. No.

Enough said? For you maybe not, but I'm tired of retards coming here claiming they own company, chips, boards and whatnot but all they have are bullshits and cheap website.

How the fuck do they not even get the copyright date correct, yet want us to believe in them that they will deliver what they promise?

I predict that they'll update the copyright vitals before they even think about creating and populating a contact page.
8891  Bitcoin / Hardware / Re: Butterfly Labs Forced "On Hold For Refund" for all my Single SC orders on: May 26, 2013, 12:15:46 AM

The ones who shout the loudest have avalon asics and they really, really, really want BFL to fail - to the point they can taste it. More asics = less coins for them. I fear the need for you 'old timers' to want to educate us noobs is less altruism and more greed.
Wait, you mean we have nothing to gain by having BFL ship and meet their performance specs?

Here I am sitting on a ton of BitCoins and my whoredom to Avalon is so great that I wouldn't ever dream/want to make money from a cheaper (yet unreliable?) alternative called BFL?

Raise your hand if you wouldn't buy from a cheaper alternative? I buy hardware to mine Bitcoins, not to "date" the vendors rep.

-----------------

The only truth is I am waiting to see if "the Avalon Clones" being made are worthwhile. They may be alot cheaper than even the BFL Hardware. Their reliability is still an unanswerable question. In which case, if BFL fails it will be my first strategic choice.

Your assumptions are distorted and inane.

Your fascination with the word distorted is noted. You have used it at least once in last few posts. You also mentioned NLP a little while back. I am sure there is a link here somewhere... help me figure it out.

Look at this dude's post history. Had to post today in Newbie to satisfy the ability to get outta jail to shill like a big boy in our sandbox.

I'm sad to say, but if this is truly the game that BFL is playing oppose to spending their efforts on product development, then all them investors are in a rude awakening.

Do they collect sales tax?

Why the fuck didn't I think of this earlier! Either the pre-orders are considered sales or people of considered investors. It can't be both ways.

On the sales front, if BFL on record in stating that pre-orders are considered sales, somehow nixing the investor aspect?

If sales, then sales tax MUST have been paid to the state of Kansas and Missouri, for they were located in the latter last year.

Now that April 15, has come and gone, I'm wondering if they filed, stating them millions of dollars of gross sales. The IRS does pay a 10% bounty for turning in non-payers.

Sorry for not being able to update in the last couple days. Before giving any justifications, I just wanna reiterate something: In order to be a scam, we have to be taking money from people. What kind of an elaborate scam would this be, if we don't even take any money.

Company Registration:
We were registered under a different name in Delaware, but our lawyer said that since we are going to have a heavy presence in the state of California (our offices, and production facility), it would be wiser to just register in California. And the California Secretary of State's office takes a little while to process the registration papers. We have already sent in our papers and hope to get registered in a day or two.

Office Location:
Those of who are in the Silicon Valley will agree with me when I say that it's really really hard to find a small manufacturing/industrial space for leasing. We are looking for about 1000-1500 square feet of industrial space where we could install our SMT assembly line. But most of the industrial spaces start at 10,000 to 20,000 square feet. The address mentioned on our website (1261 birchwood), is marked as an "R&D" place. We signed the lease, but found it to be unfit for our purpose. We need a cleaner and controlled environment for our machines. But we have been very busy looking at different places for a week now, and we have found a nice place on Montague in Santa Clara, and will finalize it by the end of this week.

Domain:
Well, the privacy setting was turned on by default. I will soon turn it off and enter our own address/phone number etc. We have nothing to hide.

So please give me a couple of days, I will post evidence about: the company registration, financial documents, the progress we have made for designing the case for the DXs, pictures of our new office, etc. Once we move in to our new place, all of you would be more than welcome to come visit us.

It's been more than a couple days. Any updates?

Not sure the address would be unfit for you, seeing that PLX used it.

BFL aside, for me, nothing about this seems to be sincere from xian.  I'd agree with you on the apology issue otherwise.  Instead, it seems like a venom filled immature tantrum thinly veiled as a PSA and an apology.

Give me a fucking break. Are you insinuating Josh has been mature or sincere over these last 11 months ?

Go back to your fucking BFL shoutbox and reality distortion field.

Seriously. Just fuck right off you sycophantic shill.

Yet another tool to add to my ignore list.

I just love seeing these brand new accounts coming to BFL's defense after missing 7+ months of deadlines. Quite entertianing. Thanks Josh.

Sorry sunshine, but D3 can't lock threads anymore.  His ability to moderate threads he has no business in has been removed.  So go ahead, ask away, see how well that works for you.

I like your highlighting, you've managed to highlight every lie CreativeX has written in the past 10 threads, good job.  But, seeing as you two are comparable liars, that's not a surprise.  Neither of you can provide anything to backup what you say, so you just keep spouting the same nonsense over and over.  And you wonder why I call you an idiot.

Frizz:  Tell me what all those posts have in common that other critical threads of BFL, on the BFL forums don't have,  would make them candidates for deletion?  My guess is you can't figure it out, being too stupid to understand your ass from a hole in the ground... but hey I thought I'd ask.  You've also managed to find the 3 posts that have been deleted, out of 8700... congratulations Scooby Doo, you are a real detective!

BFL censorship statistics:  .00034% of the posts are censored!  OMG, it's a conspiracy!
