tl;dr: Good news for the FTC - The Judge has allowed the original complaint to be amended. Bad news for Butterfly Labs. http://ia802308.us.archive.org/32/items/gov.uscourts.mowd.117531/gov.uscourts.mowd.117531.308.0.pdfIT IS ORDERED FTCs Motion and Suggestions in Support to Amend Complaint (Doc. #274) is GRANTED. Plaintiff is directed to file its amended complaint within three days. It is further ORDERED FTCs Motion to Strike Affirmative Defenses (Doc. #254) is DENIED AS MOOT. Signed on 5/13/15 by District Judge Brian C. Wimes. (Baldwin, Joella)

Count III is just awesome to see up there. Plaintiff alleges Defendants’ practices of failing to provide paid-for machines or services as promised and refusing to promptly refund payments caused substantial injury to consumers. ... consumers did not have a free and informed choice to avoid harm because they could not foresee that Defendants would fail to deliver or provide the services and refuse refunds.

@ Sonny
Considering most of these issues were caused by Inaba (Josh) I recommend as that you send Inaba the defense bill. As he seems to be largely the cause of your court battles (in my opinion).
Just a suggestion, you don't have to follow through with this suggestion. In fact, you can always foot the bill for Inaba (Josh) sake as I know you are a kind soul and it is an issue between you and Inaba. Thanks for being a great friend and being there for him. I really respect you for holding up [more than your share] of the "mistakes".

Now hopefully they newly alleged counts will be strong enough for an injunction.

Funny thing with the timing and getting the counts in. With these now in the record for the court's consideration, I wonder how the FTC will make use of them in the case.

Hopefully by driving to court on the day of the trial in a steamroller. I have an overwhelming premonition that many BFL datastores are going to vanish mysteriously before then ... kinda like how the forum vanished. I bet BFL is quietly squirming to hide. Exhibit A http://www.postjobfree.com/resume/acpor6/built-search-including-san-francisco-caBtw can someone screencap that? Edit: titillating preview... and now I wonder if he and Bruce Bourne will become flat mates.
