Refunded? What a rip off. So we invest BTC with good timestamp and they will refund us, but not the dude who invested with ethereum after us?

He said that if the transaction does not go in ethereum lagged network, you are screwed, refunded and out of the ICO. I hoped they would check the timestamp of ALL addresses, but the guy that already got the tokens by chance has privilege over the ones who invested BEFORE him but got stuck. Not nice at all.
