hilarious!

I almost spilled my coffee  Grin

So Burnside gets noted, but no mention of Bitfunder/Jon Montroll  Huh

I assume that case isn't settled yet, Bitfunder shutdown was similar to BTCT, they must be still dealing with authorities...

didn't burnside take care of all the users of BTC-TC and shut down in a reasonably fair manner? As I remember it was pretty seemless, for me anyway. A pain in the ass, but I didnt lose anything in the process.

Ukyo just burned everybody and shifted the blame to...?

If Ken isn't talking to his lawyer, I wonder if he's still in the country or just took the cash and split.

Bitcoind, and unofficially/cryptically, the SEC....but no evidence, unlike the case with Ethan. Speaking of which, someone told me Ethan is still trying to sell his exchange software, after all this time.

@damiano  Approaching 4000btc including the bonds he sold, i think......less the shares that Ken stole from him, of course!

these kind of white collar criminals have a game plan, and it is like this; avoid the fines and hide your money until the cops come to get you then cry "but I'm bankrupt! Sorry guis, no monies!" then take the 2 months in jail out of a 5 year sentence. Pretty good return for 2 months work. and jail is the only work he will ever have actually done regarding this waterlogged ball of syphilitic turd known as ACTM

I hope at least he becomes the girlfriend of a big black Mandingo during those 2 months in prison, because it will probably be the only compensation the investors will ever see.

& who can be sure Ken even had any ACTM IPO btc on bitfunder when that all happened, anyway? as I recall, when bitfunder tanked and money got lost it was the first any of us had heard about it. I seem to recall accusing the tool of gambling with company funds and he comes back with "when btc hits $10k use we shall be golden"
It was already too late to do anything but laugh by then

I found that Ken lost 453 Bitcoins on MtGox. I hope he or the liquidator or someone is going to claim those. Though the projected 20% that might be recovered when making a claim against MtGox through Kraken arent worth the effort. Im not sure. 453 Bitcoins at $483 are $218799. If we could get 20% of that value then this would be bitcoins worth $43759.80.

I guess thats not enough to make a reasonable refund though maybe it would be worth to claim it. Maybe there are some more funds somewhere. I mean Ken claimed all the time he would get funds from eASIC.

I wonder if i should set any hope in this. I guess better not...  Roll Eyes

Think about why those coins were on Gox at that time and then think about the odds of you getting any of them.

You mean he only claimed they were there? If so then it could serve as an evidence that he actually was scamming. Opening possibilities to bring him to jail.

The coins were there because your fearless leader needed to use gox to accept preorders via bitcoin because he couldn't do it on his own.

The preorders were necessary to fund the project, yet months later, after everyone with a brain knew you couldn't get cash out of gox, the coins were still sitting there. Shouldn't he have cashed them out if he was really making miners?

I asked the guys on kraken about what will happen with "the funds" if ken doesnt claim them. And... judging from his behaviour, not even attending his own court trial, im relatively sure he wont claim those coins too.

Thats the answer i got:

Out of interest... what if someone isnt claiming? Ken Slaughter, the one behind ActiveMining, claimed he had lost 453BTC on MtGox. He were not present at his court appointments so one can assume he wont claim those coins.

Will these coins be lost or can the shareholders claim them somehow? I know that legally they are owned by his company of course.

For the shareholders, who were practically scammed by him, it would be interesting to know how many coins he had on mtgox and what will happen if he stays inactive.

The shareholders might be able to submit a claim somehow, but they would need to contact the trustee and find out if it can be done, and if so, how. There's a contact phone number listed in the FAQ document posted on mtgox.com. If the funds aren't claimed, they would probably end up being distributed to claimants along with the remaining funds in the MtGox estate.

So does anyone know who the trustee is? If there really are funds then they should not be lost, even if they end to be a small amount.

Anyone knows what to do or can help?

Mt. Gox Bankruptcy claims filing system

Apparently, Kraken is honoring some of the bankruptcy victims' claims also.

Maybe the trustee will provide ActiveMining's Mt. Gox account information upon presentation of the Missouri Department of Securities order.

Unless Ken already filed his claim without shareholders knowing.....

You're making an assumption that Ken actually had bitcoins on Mtgox.  I don't believe he did.  He just used that as an excuse to gain time and not deliver refunds.  I'd ask the guy on Kraken if there is a way to just see if Ken's wallet had any coins in it.  Not likely.

Some posts ahead someone wrote that ken handled his preorder money through mtgox. So there most probably were coins on mtgox when it went done.

But even if not... we then would have proof that he scammed and we could sue him getting him caught with a clear lie.

I will see if i can find more info about that trustee. If someone knows contact details let me know.

Edit: Looks like i found some info. Though that is the trustee of the MtGox Bankruptcy. What we would need, most probably, is the trustee of the ActiveMining Bankruptcy.

Bankruptcy Trustee: Nobuaki Kobayashi, Attorney-at-Law

MTGOXCo., Ltd. Office of Bankruptcy Trustee
Suite 202, Kojimachi 3-chome Building
3-4-1 Kojimachi, Chiyoda-ku, Tokyo, Japan

Telephone: +81-3-4588-3922(open from 10a.m. to 5p.m. on weekdays) (Japan time)

Its from https://www.mtgox.com/img/pdf/201504_notice1_en.pdf

Anyone knows japanese? Tongue

Yes and it is worth passing this info to Shawn Haggerty over at MSD. This case is also moving to the federal level. I'm sure they can get warrants to open all ken's accounts for disgorgement, or at least to see the extent of his lies. I will send Shawn Haggerty a little email later this weekend when I have more time.

And in case Ken actually lurks these threads...."Your days are numbered asshole!"

Ok, i only found the lawyer of Ken Slaughter. The lawyer gave up after ken didnt show up at court and he wasnt able to contact him anymore.

Its Chip Sheppard +1 (417) 447-4400. I called them now and asked about things. My english seems to be so horrible that they gave me his email address.  Cheesy Its j.sheppard@cecb.com and i was asked to send him a request. Ill do so now. Maybe he knows the bankruptcy trustee of ken so that someone could claim the coins... if they exist.

Edit: Thats the guy: http://www.cecb.com/joseph-d-chip-sheppard-iii-named-to-the-ozark-technical-college-board-of-trustees/
