He claims he was not gambling during his working hours, if that is true, then i don't think firing him for gambling is fair, as long as gambling is legal in the country and the employee hasn't run into any public problem because of gambling, then it does not interfere with his work, so he shouldn't be fired.

I guess there is surely more to this, the man may have broken other rules that led to him losing his job and he is trying to use only this page to gain sympathy.

I can't keep such worker who is on his own acting against the company's policy, even though he later involved himself with gambling that is already a red-flag for him. So I think that was the major issues why they filed him, for going against the company's policy. However, was he permitted to loan money to same client? Was that among the company's operational policy?

reading the article, the judge looks like he has a prejudice against gamblers in general and not just gamblers who are gambling in crypto casinos. that being said, the gambling was not the only issue in this case, in the article, it was mentioned that the ex-employee was found to be engaged in inappropriate private money lending with the bank’s loan clients.

There are so many investigations that banks conduct with their audits.

The article says - that its employees were involved in improper personal borrowing of money.
The bank claimed he was a regular gambler, although the employee claimed he played outside of working hours and never took advantage of crypto not being converted to fiat.
Crypto gambling in South Korea is banned.

Perhaps it was the court's full support for the bank that fired the employee, although the appeal was rejected.

After going through the link in the post, South Korea is a country that has made gambling illegal, so by engaging in gambling is already an offense on him that the court won’t have taken lightly when the case was brought forward to them. He may not be playing during work hours but another investigation led into his case proved that he has used his position in lending some money inappropriately and they term him as an habitual gambler. This is not to say it is because it is a crypto gambling site, he has other offenses that was used against him and lost the case in the court.

If the company gave you and employment later and stated that you can be fire without any explanation and for the interest of the company and you still went ahead to sign that paper and work with the company, regardless of what reason they sack you from your job, I don't you have any obligations to sue the company because you clearly signed the later with the implications that will come later. If that's the case of him, he can't win the case in my opinion.

I'm sure what other people might think but I feel there are some professions that you do, you have to make sure you don't mix your pleasure and business together. You can't be a bank worker and be gambling, you can actually but ur you are caught in any circumstances, then you have jeopardize your job that instant especially HR that is always looking for opportunities to sack people so they can bring in new people that are eager to take the job with passion.

The last person you want working in a bank is somebody that addicted to gambling that they are caught playing games on shift. These people will often have access to large amounts of money and bank accounts that could be manipulated if they had the wrong intentions. Gamblers can sometimes go off track when on a losing streak, which is almost inevitable, and there have been well publicized occasions in the past where people have stolen money to fund their addiction. There seems little chance of this person ever being kept on in a role that has them around large sums of money. While they claim to not have done it at work, I doubt his work would have been able to detect it otherwise.

For a gambler you need to have one thing which is freedom and for that, you have to do all that you can to be self employed, that means you are a boss of your own, because you can combine gambling with performance of duty and as you know, banking sector is an intense sectors that they pay close attention to they employees personal lifestyle and gambling is one activities that is mostly prohibited in many establishment, I can't blame the company for firing the employees if he is found wanting for violating the rulesets of the Bank.

So, as an employee of the bank, you should be one of the first people who will be a role model of it and not the one who breaks the rule first. Second, banks has always been strict with any gambling related money and they also don't like gambling. So, again, that's breaking their rules.
That guy could've just played at home and don't let anyone from his work place saw him playing/gambling with crypto.

I feel that he was fired more because he gambled not exactly because he was gambling with crypto. Gamblers are people that employers of labor usually fear especially when they are occupying positions where they can easily be tempted based on their exposure to finances and money. If I am the owner of such a bank I would also consider firing such an employee because even though there will be other gamblers in the company, this particular employee has allowed it to interfere with their work time.

The court was right to have fired him. See my comments after I had reread the story. I will also take from the details in the article:

1. He was already guilty of engaging in inappropriate private money lending” with the bank’s loan clients according to the report. This is very bad.
2. Gambling is Crypto gambling games are illegal in South Korea and more so according to the courts, gambling is immoral and should be condemned in itself. I don't see how he was going to beat this one no matter how good his actions or intentions was.
3. And lastly, the court concluded that he suffered a significant financial loss through gambling, it could have had a negative impact on their overall work efficiency. If an employee in the financial industry gambles, there is a high possibility that they will commit additional crimes such as embezzlement to recover their losses. And they are absolutely right. In such a sensitive position, it is only a matter of time before the habit goes out of control and leads him to commit a criminal act.

The employee has turned out to be a habitual gambler. He could've been watched by other employees, and this habit might trigger the other employees to gamble. Importantly, this will surely reflect on the effective functioning of the workspace. Even if he had used fiat, he could've been arrested. Banks find crypto as their rival, and he using it for his needs outside the office is different. Using during the work time is unfair, and he has been involved in different activities that ruin the bank's credibility. Also, his gambling is on the negative side, which might make him take money from the bank for his gambling needs. Considering all this, the employee was fired and not just for using crypto on gambling.

Yes, he could have still possibly gotten fired. I think in this case it's not just about the pattern of payment the gambling site accepts; it could possibly be that the employee hates everything that has to do with gambling, as they consider it a high risk for the employee to get involved in, even if they play it during off-duty hours. As long as they are still in the business facility, I believe the employer still has some say in what they do there.

Gambling at work place can take away your focus and make you greatly underperform since you direct the attention you should give your work to gambling and over time, even without your knowledge gambling might have the better of you and your work keeps suffering it's effects.

For gambling, South Koreans can face long Jail time and pay huge fines, and these laws apply to South Koreans outside the country too, although I wonder how they can keep track of South Koreans outside the country.

This is not a recent case to the best of my knowledge. And he was indeed lucky to get away with a slap on the wrist as the legal luminaries would say. I also want to strongly believe that he is not the only person in the whole of South Korea working in the financial industry that is involved in this act. He is just the unfortunate one to get caught and used as a scapegoat. I have a small question though and that is what if he wasn't encountering consistent losses as cited by the court? Who he have been pardoned and reinstated back to his position as a staff of the organization or would he have received some compensation for being fired? What if the financial audit came report came back and found him to be clean. Would his gambling activities had been ignored?

The employee may have probably termed to gamble during a working hour instead of his free times.
Who know if he hasn't been on watchlist as a case of him repeatedly misconducting while at work.

That title is misleading. The bank employee wasn't fired simply because he/she was "playing crypto games". He/she was fired for a number of reasons. In the first place, he/she was a "habitual" gambler. Gambling itself is illegal in South Korea, save for some exceptions. Gambling with crypto, however, is completely illegal. That alone is enough reason for the employee to be called out. Not to mention that he/she's also involved in certain questionable practices involving the company.

It should be clarified yet this one is really that misleading because people will really be mainly thinking that crypto gambling or dealing is bad on which this will really be not that enough for someone to get fired. It is really just that a shallow reason on why he was really that being fired into his job on which same as you mentioned that this one talks about certain violations towards the company and other things which is really that against the government laws on which it's not really that shocking in regarding on the decisions had been made by the bank,also it's not ideal to file a case against if you do know that you are at fault. Lol

From this problem there is something a little confusing, namely how can HR or the bank know and claim that the employee is regular gambler if the employee says that he never plays during working hours.
Regarding the dismissal, it depends on the regulations or policies of the bank itself where the employee works, whether it prohibits all employees from gambling or not, and regarding the use of crypto, it is actually not problem and should be no involvement at all to problems that occur because crypto is just currency that is used.
