~ I have a small question though and that is what if he wasn't encountering consistent losses as cited by the court? Who he have been pardoned and reinstated back to his position as a staff of the organization or would he have received some compensation for being fired? What if the financial audit came report came back and found him to be clean. Would his gambling activities had been ignored? I think that since the judge in the trial seems to have a certain degree of prejudice against gambling itself, he would have just looked for another reason to ensure that the man standing trial gets some sort of punishment for just gambling itself. This is not strange because it has been a regular thing that we have often witnessed where some people stigmatize others who they know gamble and tag them as irresponsible.

No company wants to see their employee involve in gambling especially if he is a habitual gambler because that means he often to playing gambling. He will just risk more and more money because he can be excessively when playing gambling. Even if he claim that he never played during work hours, that still difficult for someone because he can lose control during his gambling activity.
Even if he used fiat money to playing gambling, he still get in the trouble on his company. If he like to playing gambling, he must make sure that no one knows about his habit and must responsible to himself because gambling can makes him forget with anything. In the end, he can lose all of his money.

I don't think if crypto wasn't involved he wouldn't have been fired, every work environment or company has its own employee standards. It could be that in his workplace they are prohibited from gambling even though they still have good performance while working. So the conclusion is not because of crypto, but because he was the one who was doing the gambling activity.

In South Korea, A bank employee was found to be playing online games that use crypto as its in game currency. The bank claimed that the employee is a habitual gambler and fired him from his job. The ex-employee naturally raised his concern to HR as he thinks it is unfair dismissal but the HR rejected his appeal which led him to file a lawsuit. In the end, even the court sided with the bank. Even though the ex-employee claims that he never played during work hours and that his habits did not interfere with his work quality, the court rules it to be undignified to be gambling with crypto. If crypto wasn't involved, do you think this employee would have gotten fired? I think it was absolutely unfair to fire this guy. I know how strong the discipline is in South Korea, and they are all workaholics there, just like the Japanese, but that doesn't give them the right to fire a person for playing in a crypto casino. I want to point out that it is incredibly difficult to find a good job in South Korea, and being fired there is a lot of stress, especially with a disciplinary violation mark in the work book. But what did this guy violate? He is innocent and I think he was fired for far-fetched reasons. It's a shame that this happened to him.

What's exactly the mistake for filling a lawsuit? even you lose, it doesn't mean you're get punishment for that.
I am sure the employee actually knows the reason he was fired. And if he filed the lawsuit, it made the bank's CEO more angry because it was clear he made a mistake but made a self defense with the hope of winning the lawsuit. For me it is a mistake. This defense wasn't the best but he should have provided an explanation and asked for another chance to prove he wasn't gambling again at work.

Getting the employee fired has some advantages, a friend of mine told me that some employees in different banks are now using the funds of customers to gamble, i didn't believe it at first but coming across this thread has proven that it's actually true. Playing crypto games during work hours is a distraction that can cost a lot, a bank is always busy and in most cases all hands must be on deck for easy administrative functions. If it was on-the-job gambling then the bank authorities had the full rights to fire him but for this the given employee had to caught directly at "bust" rather than being suspected in nonappropriated activity during his duty. Claiming that their employee is "a habitual gambler" and firing him solely on that ground is the baseless allegation in my view.

I believe that is rather a rumor, because of several reasons, in my opinion. Most of the labor force within a back has to do with facing the costumers of the bank and do not have much to do with administrative roles within the bank itself, so the ability of the bulk of the bank to manage, move and steal money from costumers is actually limited, only someone within administrative levels and with a high position in the back could have the opportunity and ability to withdraw funds from the bank, without getting noticed by their superiors and bosses. Even if an employee in a bank has gambling as a hobby it should not immediately raise a red flag about the institution itself, because gambling and any kind of activity we can do outside our work places, are part of our private life, and that is to be respected.

If the company gave you and employment later and stated that you can be fire without any explanation and for the interest of the company and you still went ahead to sign that paper and work with the company, regardless of what reason they sack you from your job, I don't you have any obligations to sue the company because you clearly signed the later with the implications that will come later.
There is no such thing in any civilized country. You people have become slaves to those ToS like it's some form of writing of God and once you accept it your soul becomes the property of whoever wrote that. In any country that is not a complete shithole a company can write whatever they want in that, they can even write that if you are late 1 minute you will be penalized by 6 months of wage, but that doesn't mean they could actually enforce that, the laws of a country are the first to be taken into account, not a contract between two persons if that clause is deemed illegal the company can't do a thing, even if you agreed with it. ~ I can't keep such worker who is on his own acting against the company's policy, even though he later involved himself with gambling that is already a red-flag for him. So I think that was the major issues why they filed him, for going against the company's policy. However, was he permitted to loan money to same client? Was that among the company's operational policy? He poached clients from the bank, probably for his own interest, or maybe offered them a better deal through a broker, normally he should have considered himself lucky and agreed to quit his job, not waste extra time in court.

It should be clarified yet this one is really that misleading because people will really be mainly thinking that crypto gambling or dealing is bad on which this will really be not that enough for someone to get fired. It was also reported that he engaged in private lending practice thereby defrauding the bank. From the article, crypto gambling is banned in South Korea. Maybe he was using other illegal means to engage in crypto gambling. Although the bank knew that his gambling activities didn't affect his performance the general view is that it is immoral for bankers to gamble. If they get addicted, they can easily engage in different sharp practices in the bank to fuel their addiction. If crypto wasn't involved, do you think this employee would have gotten fired?
No, he would and should have gotten fired. Crypto was not at fault here. If he were my employee, I would be quite angry with him and definitely he would be fired. But that is from my own personal and subjective perspective. Would you want to pay money to such a lazy/useless worker, if he was playing Fifa instead of working, in place of gambling with crypto?

Yes, 100% without having any doubt that employee should have been fired. Would you want to pay money to such a lazy/useless worker, if he was playing Fifa instead of working, in place of gambling with crypto?
I won't and even we're on the same page liking the same sports that I like to bet with. Working time is working time and it is intended to be for working and not for some recreation. I am not paying him to gamble but to for the job that he was hired for.

If i should be in the position of the bank manger, i would have do more than what happened there, because if we look into the banking job responsibility and service roles, we are going to discover that it takes more time, attentiveness and someone being calm and reserve to be a banker, not only that, one must be sound intellectually before he could be a gambler who is ready to make profits form his career, despite the all seriousness, some are still found making losses just because of some silly mistakes, not to talk of when a banker is now gambling while at work, it deserves what is more than sack.

In South Korea, A bank employee was found to be playing online games that use crypto as its in game currency. The bank claimed that the employee is a habitual gambler and fired him from his job. The ex-employee naturally raised his concern to HR as he thinks it is unfair dismissal but the HR rejected his appeal which led him to file a lawsuit. In the end, even the court sided with the bank. Even though the ex-employee claims that he never played during work hours and that his habits did not interfere with his work quality, the court rules it to be undignified to be gambling with crypto. If crypto wasn't involved, do you think this employee would have gotten fired? Is the case related to the crypto regulations set there? or is it just HRD's personal view regarding gambling activities carried out by its employees? If it is related to the misuse of employee work time used for gambling, it makes sense for HRD to give a warning or even dismiss. but if they can't prove it, maybe it's not fair to the employee. or there is another possibility that there is indeed a company procedure that does not allow its employees to gamble. because there are indeed several cases of bank employees or companies who misuse company/customer money for gambling. the company may be more careful with the risks that the company may experience about its employees' gambling activities.

I'm not a South Korean and can't definitely answer this question with 100% certainty but from a quick google search, it seems that gambling is not legal in South Korea, so, crypto gambling is definitely against the law. Secondly, banks care about their own reputation. Sorry but if you are a bank employee and you gamble, if someone posts your image online, the bank might receive negative comments and many people may blame the bank for having a gambling addict employee. While that person might not be addict and/or his gambling doesn't affect his performance at work, the reality is that there are these standards in life.

Getting the employee fired has some advantages, a friend of mine told me that some employees in different banks are now using the funds of customers to gamble, i didn't believe it at first but coming across this thread has proven that it's actually true. Playing crypto games during work hours is a distraction that can cost a lot, a bank is always busy and in most cases all hands must be on deck for easy administrative functions. A banker gambling at work is a complete red flag to the company and firing the person seems harsh but that's what is needed to be done.
It's true, but from his plea he mentioned that his gambling activities didn't affect the quality of his work. Probably, the bank are not comfortable with employees that bet, as it's very dangerous in a financial setting. Customers money would be at risk. His trouble wasn't just about gaming with crypto, but the negative aspect of gambling which the HR deem as not condusive to the bank.

raised his concern to HR as he thinks it is unfair dismissal I have relatives in banking and finance and so I will raise what I know of their business and employment rules. The bank standing relies on integrity and respect, as such to be over drawn on even a personal account would be considered disciplinary offences and perhaps eventual dismissal. The short story is because its a bank the rules are very strict, even gambling outside of work I can guess the employers may not approve at all. To do so during work hours and within the work place is easily within dismissal by his work contract, I have little doubt the bank will never reverse their actions in that respect. It is very hard but its the terms of the job, the bank requires the employees to act like saints basically. Other jobs Ive heard of requiring similar hard terms would be police force, you cannot be seen to be in debt in any way and so on. You must be on best behavior even outside of work etc. Its hard but part of the job in many parts of the world and South Korea Im not that surprised, Ive read they have a very tough business ethic there often. If crypto wasn't involved, do you think this employee would have gotten fired? In his contract, Im guessing but a good guess they require no gambling. So crypto isnt the main problem, extremely hard terms of employment some sectors of industry it is like this.
