The title feels misleading, in my opinion. The news says the employee was fired for gambling - not just for playing crypto games. Playing games might be against company rules, but it’s not usually grounds for termination. This employee got caught, was terminated, and now he’s fighting for his “rights”? What a moron… it’s like he doesn’t realize that gambling on the job isn’t just unethical, it’s a serious offense. The company had to handle it accordingly.

Yes, the title should be slightly revised, such as changing it to "a bank employee was fired for being involved in gambling" and not for playing crypto games, the only thing that makes me agree with the company's decision is because there is a possibility for the employee to eventually gamble using company money secretly which of course will definitely harm the bank.

On the other hand, I don't think there will be a reasonable reason for the employee to be used as a defense in order to defend his rights, OP said that the person gambled outside of work hours and maybe that's what made him try to make a defense, but I think as I said above that one of the reasons why I agree with the bank's decision is that there is a possibility for the employee to eventually embezzle company money to gamble.

Apart from the fact the gambling was ban in that region, but even if it was not ban, it was not good morale on the part of employee to gamble within the office hours. The bank is paying to the employee to work in the bank and not to gamble or involve in other activities not related to job. However, if he was lucky he could have been given a warning but unfortunately a more aggressive decision was taken and he was expelled from the job.

I agree with you, especially a bank that certainly has rules in running operations, without it employees will not be disciplined in doing anything, it will be a problem if a worker plays unstructured gambling like at work, it will interfere with his focus.

This is not about the problem of games involving crypto but because of the rules of the company and it seems that they are very concerned about his behavior which makes a strong reason why he was fired.

Usually, institutions related to banking or government agencies will do the same thing as what happened in this thread. no matter if it's crypto or fiat currency, they don't hesitate to fire, especially if their employees play crypto games, especially those that have something to do with gambling. I don't know about many other countries, but in my country, this situation will clearly have fatal consequences for the worker. I tried to look at the information you shared, in it it was clearly stated, besides illegal crypto gambling in the country. In addition, the same news reported that the bank had started an investigation into the employee. So, it seems clear to strengthen the argument and even evidence that supports that the bank did not carelessly and deliberately fire him without concrete evidence. Talking about warning, i know this will serve a very serious one to other gambler who are playing with their own jobs as well in this regard, when they know that they have nothing to fall back at if gone, imagine if they could be gambling only because they are making some earnings from the salary they were being paid, but now if the job is gone, could they also do as before gambling, how are they going to get the money for gambling when the source is all gone, we may just have to appreciate things we have before they left us.

Before the employer can take the case to court and other legal bodies and they turn him down, I believe the company is right for firing him as he could have broken the company policy for playing gambling on the company premises.
 
I don't think it has anything to do with crypto unless there is also another thing the company has against crypto. It's a common practice for companies to ban gambling activities to be carried out in their place of work even if the worker is on their break time.

Conclusion is that he got fired for multitude of reasons and I do understand the decision of both the bank and the court. I am curious though if he was ever penalized if crypto gambling is banned and he was found participating in such activities? If not then he’s just lucky that all he got is a termination of contract.

I don’t know if the person got fired just because he is using cryptocurrency to gamble, or maybe he was caught gambling at work, but I don’t think it’s because of the bank that’s involved that’s why the employee got fired. In most societies, people see gamblers as bad people, they see them as an irresponsible set of people, and all this is caused by addicted gamblers. We all know that addicted gamblers are ready to do anything just for them to make money and gamble with, and when a person like this is kept in an accounting section, they might end up tampering with their money.
 
Maybe the bank is just taking preventative measures, they don’t know if the person is addicted or not, and they don’t want the person to end up stealing from them and gambling with it, that’s why they just have to let him go.

I didn't read the article you included but the reason for his dismissal was definitely not because he gambled and used crypto, another reason for example the bank thought that employees who gambled had a bad impact on the company's image.

It's quite strange if he gambled using crypto how would the company know about his activities? is it possible that someone reported him, and his dismissal must have been based on company rules so there wasn't much the employee could do other than accept and look for work elsewhere which he might have difficulty getting because his case was exposed to the media.

But on the contrary in the article link above, the individual who was sacked claimed he wasn't gambling during working hours, of which sometimes it's hard to believe if he was lying or really saying the truth, because been a company he has work for many years, they woundn't have just sacked him if there wasn't any concrete reason for it. However, this should be a lesson to all of us on this forum, to sometimes keep what we do a little bit private, because you never can tell who is indeed happy for your progress or not. Because for this individual to have been sacked, it means there were people around him who made a report to the HM (i.e Head of Management).

So what the corporate rules should be then? Dont gamble with crypto at work? First of all, if employee managed to access gambling site by using company device (pc, laptop, tablet), then its admins fault that he does not restrict them or even made it free internet access for a device that is used to operate with banking software. If that employee has used his own device to gamble at work, that is not really a crime. Bank can not interfere in employee life. As well as bank should not give a damn about employees hobby, passion, maybe even addiction, as long as employee does his job perfectly.

Every corporate have its rules and that will be different from one to another. But they have the same rules that will prohibit their employee playing gambling, whether they use crypto or fiat. They are work in the corporate, and if they are doing other things besides working, that still break the rules, right? Maybe that will not a crime but we must understand about the point doing other activities that is not related with your work description is not allow. So even if he using his own device to gamble at work will not be allow because he is still in his work/office. That will be different if he is in public area or in his home. The rules is something that all employee needs to obey and HRD can do anything if they found their employee doing something that is not as their work description.

Correct. Whatever reason he has either it's crypto gambling or he is just playing online crypto games while using the bank's computer then it doesn't matter. It's work hours and it means he must do his job. Obviously, he is not working because he also told the judge that he ain't crypto gambling but only playing crypto games. That's a stupid thing to say and maybe he thought he could save his job by saying that since the only accusation to him was that he was playing crypto games.
He just made things worse by saying that and he probably be blacklisted by the bank to other banks so that they won't hire him when he tries to get a job again.

I think it's not the involvement of crypto that led to his dismissal of duties but rather the fact that it's an habitual gambler as stated it's more reasons to level any charges against him, basically because as a banker the finances ain't safe any longer cause he might one day loan from the bank to keep up his gambling habits and you know what that means, then using crypto as the in game currency is another charge cause we all know the challenges between the government and crypto community so they can go miles in bringing you down.

So what if a person takes out a loan from a bank? He didn't steal the money. He'll have to pay it back sooner or later. So I don't see any problem here. Why are you making it up out of thin air? I'm not an HR nor the owner of a bank, but maybe they see his habits on gambling as "detrimental" to the company hence, they fired him. They might think that this kind of thinking might affect his overall performance on his work that's why they fired him. I don't side anybody here, but the mere fact that even the judges sided on the bank is enough proof that this is over already. This is my first time seeing at an employee getting fired just because he's a habitual gambler, but nevertheless, it happened, and I believe there's a deeper story behind this one that isn't included in the article.
