It is complicated but we can discuss this among all,As far as the legislation known as the BitLicense (23 NYCRR 200) which makes it a federal offense to sell virtual currency to people living in New York unless you have applied for the license , For that reason I think that poloniex dont want take a risk listing NYC because it  could increase the likelihood of that NY citizens buy or sell it with them.
