You don't think that someone like him would be constantly on the look out for ways he might be able to hide the location and extent of his assets?  Remember that he had to get permission from the NZ High Court to borrow money to pay his legal bills earlier this year and to sell some of his assets.  I suspect that he'd rather not be in a similar situation in the future.

He'd be in a shitload of trouble if it became known to authorities that he'd somehow managed to use hidden assets to buy $5 million worth of Bitcoins so either this is a beat up or he's trusted the wrong people.

To add a bit to this, I e-mailed Taslim as well and got a response back from him today. 

I specifically asked if they had any information from the original claims process that Bitcoinica set up previously, and he replied that they do not.  So even if you submitted a claim previously through Bitcoinica, you will almost certainly need to re-submit your claim along with supporting information through the liquidator.

You will absolutely need to submit a claim to the liquidator.  Even when the liquidator has the full records of the company this is still required by law.  I'd advise people to make their claims as accurate as possible.  Liquidators can reject disputed claims and they also have the power to subordinate claims under certain circumstances.  People need to bear in mind that this is a legal process and that knowingly providing false information is an offence which can bite you in the ass.  If you try to game the system you may end up not being paid at all.

If they were maintaining AML compliance then they're legally required to keep the information for a number of years.  That doesn't mean they can use the information however they want.  Nothing on their website actually over-rides privacy laws or laws specific to financial information.

The T&C excerpt posted by augustocroppo only gives them the right to reproduce things like comments on their service or posts to a blog on their site - it has nothing whatsoever to do with how financial or personal information can be used.

I think of this each time I have to cash out some of my bitcoins to pay a recurring monthly bill.  I lose a little in exchange fees when I cash out and because I am paying the bill with a credit card I know that the merchant is taking a hit on the merchant fees as well.  

I'm always kind of curious about why people use credit cards to pay their monthly bills if they object to the way the processing system is set up.  Is there no simple way of paying your bills by direct deposit in the US because that's how people here pay things like their rent, their electricity bills, their car registration and insurance, their phone bills, etc.  The money in the merchant's account within a couple of days (often overnight and it can be the same day if customers are with the same bank).

I only use my Mastercard when the merchant doesn't accept direct deposit or where they'll only ship immediately for credit card transactions.

Why would you not apply extended verification to cheques and money orders when the first bounce on a regular basis and the second are counterfeited/stolen often enough to be cautious about supplying goods and services until you've been able to cash them?

Not if exchanges weren't used.  While I suspect this report is bullshit, don't forget that there are people out there who'd welcome the chance to dump large amounts of Bitcoins under the radar - pirate, for one - and who don't need to get market price for them to make substantial profits.

It was never clear whether bitcoinica attitude about this it was lawful  ...

Only the liquidator can answer any questions about that.  Hopefully he'll be able to sort out his account and post here soon.

Maybe next time people will ask for a credit report before loaning money to a stranger.  That is what they are for.

For the record, his credit report used to look fine.

If he hasn't defaulted on anything which gets reported to credit reporting agencies, it still will.

It's not going to help that the funds taken during the MtGox intrusion were returned largely in $.

40,000 BTC and USD 40,000 went missing.  At today's price of USD 11.70 that's a total of USD 508,000.

According to Patrick Murck, USD 100,000 and 20,000 BTC were returned, for a total of USD 334,000.

Of course there are still funds frozen on AurumXchange which Zhou said on the one hand belonged to a friend and on the other hand said could be returned to MtGox.  God knows whether AurumXchange will release those to the liquidator given that Zhou claimed they weren't his.  And we don't know how much was in the MtGox account at the time of the intrusion (but presume that it was roughly enough to cover claims at the rate of USD 5 per BTC which was applied when the refund process began).

This is the standard format used for creditor's claims in NZ (this one's the one for estates administered by the Official Assignee).

Private liquidators usually have their own claim forms.  You can see an example of one at the end of this First Report to Creditors (this is a different company from the one handling the Bitcoinica liquidation).

These just give you a general idea of the type of information required.  The company handling the liquidation will likely have its own form but the basic information required will be the same.

Absolutely they should be able to withstand a run.  I'd reasonably expect some minor delays while they transfer BTC to their hot wallet in batches (so the hot wallet never contains all user funds) and that hard currency transfers might be affected by transaction limits at the bank's end but they should still be able to return user funds within a few days at most.

They refused to offer a Dwolla or Paypal withdrawal option and that was the big problem.  The bank fee was too high making the exchange less usable for anyone doing small volumes. 

I don't blame any exchange for not offering Dwolla or PayPal - they only way you can mitigate risk with them is to put a hard limit on the amount of transactions you have active with them at any given time like MtGox does and that causes delays which users find unacceptable.

Mr Bitcoin is probably a better model for someone trying to operate in Australia.  We're simply not used to delays in financial transactions and we're not used to having to pay for them.  Selling Bitcoins for cash gets rid of a lot of the issues which plague exchanges, although it might still ultimately run into issues with banks down the track if the volume of cash transactions gets high enough.  It also remains to be seen how willing people are to go to the bank given that we do such much banking and bill paying online (I seriously can't remember the last time I stepped foot inside a bank).

As to the creditor report & claim form. Is this typically sent to creditors by regular mail? Or might they send it by email as well?

I'm asking since I recently moved and am unable to update my records with Bitcoinica (for obvious reasons).

It depends on the liquidator.  Some set up an online claims process and some don't - I'd be a little surprised if they didn't in this case because the window for lodging claims is often quite short and nobody's going to want to deal with the headaches of lost or delayed snail mail.  Very often reports to creditors are made by email these days, but I'm pretty sure that you can elect to receive them by snail mail.

I admit that I'm very curious to see who waives their claims in liquidation and to what extent - it will have a significant impact on the funds which will be available to the liquidator for distribution to unsecured creditors.

It's probably worth pointing out that although some liquidators ask for proof of claim to be submitted with the claim, the claims aren't generally formally validated until the liquidator is ready to make disbursements.  This is to save on liquidator fees.

Also, perhaps you could email Taslim back and advise him to ask the mods to be whitelisted.  He won't be able to post outside Newbies otherwise.

Also, can I suggest copying your post with the liquidator's reply into a new thread with an attention-grabbing title which makes clear that the liquidator is seeking contact from Bitcoinica users (maybe "Bitcoinica liquidator wants to hear from users" or something similar).  People have become jaded by these old threads going nowhere so they might not check them for updates.

He's got month left to make it happen.  When it doesn't, he'll have some bullshit excuse about negative energy, egos and such.  Of course if he actually refrains from eating and sleeping for a month - as opposed to just waffling about it - he'll be in a psych unit or a hospital by then so he won't have to deliver on anything.
